-By bidding in this auction, you are consenting to the following terms, so please read carefully: -All potential buyers must register online at bontragerauction.com or bontragerauction.hibid.com and follow instructions for registering. -Registered buyers will be required to forward proof of funds, bank letter of credit, proof of savings or a pre-qualification letter from your bank by Friday Oct. 19 at noon, no exceptions. This can be faxed to Bontrager Real Estate & Auction Service at 585-343-4530 or emailed to todd@bontragerauction.com. Failure to provide this documentation could result in bid nullifcation. -Property will be sold "As-Is". There are no exceptions to this clause, including but not limited to compliance with any local, state, or federal government regulations. Fixtures are sold in "As-Is" condition. No warranties, guarantees, or representations are implied by the seller or seller's agent. -Property sells as per deed description. -Property will be sold subject to the owner's acceptance of the final bid. -10% buyer's premium added to the final bid, resulting in purchase price -Upon acceptance of the final bid, $15,000 deposit is required in cash, or certified bank draft or funds (no personal checks are accepted). -Upon acceptance of the final bid, the contract of sale (which has already been reviewed by the seller's attorney) will be signed by all parties, and becomes a legal binding contract. If a bidder wishes to have attorney approval of the contract, it must be reviewed prior to bidding. The buyer can also elect to waive attorney approval. -Bontrager' Auction Service is exclusive agent for the seller. -Closing to take place approximately 45 days from the auction date. -Buyer shall possess the property at closing. -Property closing is not subject to buyer financing. Any financing must be arranged ahead of time and be ready for closing within the 45 day time frame. -Contract may be canceled by the seller and seller's agent if the buyer does not comply with the terms of the contract. In that case, the buyer will forfeit any deposits and be held liable for any deficiency which may result in a resale of the property. -Cooperating Brokers are protected if they comply with the following: 1. Brokers must register their clients (with client approval) prior to viewing the property. (Broker registration form is found at bontragerauction.com). 2. Brokers must attend the open house (Oct. 13th, 11 a.m. - 2 p.m.) with their client. 3. All brokers must have registered their clients with Bontrager Real Estate & Auction Service by Friday Oct. 19th at 6 p.m.). Commission to cooperating brokers who have met these requirements is 3% of the high bid. -Successful bidder must be available by phone immediately following the auction.
