By placing a bid, you are acknowledging your acceptance of these Terms and Conditions NOTE: THIS IS AN ONLINE ONLY AUCTION EVENT. Auction Closing Date: Bidding continues until the last lot is finished. Lots will begin closing at a rate of 1 per minute until the last item is sold. Registration: All registrants must provide name, address, email address, phone number and valid credit card number in order to register. Note that the address on the registration must match the mailing address on file with your credit card company. Payment: Payments may be made by Visa, MasterCard, American Express or Cash on Pickup Buyers Premium: A 15% Buyers Premium for all Credit Cards will be added to the final bid price and included in the total sale price. Sales Tax: No Sale Tax for this Auction High Bidder Notification: At the conclusion of the auction winning bidders will receive an email advising of the items won as well as provided with an invoice for payment. Bidders will receive an email only and are responsible for checking your email account. Removal for this auction is Sunday September 30th pickup time will be from 1pm to 4pm This is a 1 day pickup ONLY, NO OTHER ARANGEMENTS will be made. We will be there the 1 day only. All invoices will Charge all Credit Card at the end of the auction no cash will be accepted at this auction. We will also Charge all Credit cards on file of those cash buyers that do not show up or that do not call or answer our call within the last 30 mins prior to closing of the pickup time. So please let us know you are on the way or that you are not coming our time is important as yours. We try to make it painless as possible. After we charge all CC at the end of the Auction you will be sent an invoice for the items that you won. You do not have to bring it with you. We will have a copy on site for you. If you are out of state and need to make arrangement to pickup please contact us prior to bidding. These Terms and Condition are binding and will not be changed without prior discussion. Non Payment: If you do not pay you will be placed on our prohibited list until taken care of. This will also be sent to any and all other Online Auction Site and Auctioneers that use the HiBid platform. So you may or may not be able to bid on any other HiBid Platform auctions until payment is taken care of. Shipping: Due to the size of most of these items you will have to make arrangement with us PRIOR to bidding on any item. Most will have to be shipped by frieght or moving company. Again please let us know prior to bidding if you are thinking about having anything shipped. Staggered Closing: The online auction moves fast and closes 1 items every minute. The automatic system will close the bidding on intervals. Dynamic Closing. The closing time of an asset is automatically extended an additional 1 minute whenever a bid is placed within the last 2 minutes of the asset's closing time. BUYER BEWARE: By placing a bid, the bidder acknowledges that s/he has entered into this agreement as the result of a thorough inspection, or acknowledged opportunity to inspect, of the merchandise being purchased and that all merchandise is sold in an "AS-IS, WHERE-IS, and AS-INSPECTED" condition with any and all faults. While descriptions are believed to be correct, the Auctioneer and the Seller make no warranties or guarantees, expressed or implied, as to the genuineness, authenticity or merchantability of, or defect in any item, and will not be held responsible for any discrepancies or inaccuracies. No warranties are made as to the merchantability of any item or their fitness for any purpose. ALL SALES ARE FINAL. It is understood and agreed that the Auctioneer is acting as an agent only and shall in no case whatsoever be held liable by either party for the performance of any term or covenant of this agreement or for damages for non-performance thereof. Purchaser does hereby indemnify and hold harmless Auctioneer, Auction Firm and Seller from any and all damages and claims of any type whatsoever caused by the removal of the item(s) purchased. Please inspect the lot numbers and read the descriptions. You are bidding on the described item, always read the item description. IMPORTANT! The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchase, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items. Choose Wisely: We want everyone to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. The Auctioneer reserves the right to add or remove items from the auction - split or combine lots - add minimum bids or reserve prices - cancel, suspend, extend or reschedule an individual item and or auction event - make changes to the auction closing times or inspection or removal times. Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by the Cuyahoga County Court of Common Pleas in Cuyahoga County, Ohio. Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price. The above-stated Terms & Conditions of Sale cannot be altered except in writing by The Auctioneer. This Auction will run from Thursday 9/20/18 to Thursday 9/27/18 with pickup on Sunday 9/30/18 from 1pm-4pm Auction contains many great items as Riding Lawnmower, Push Mower, Nice Broyhill bedroom furniture, kitchen table set, roller blades, ice skates, transistor radios, DVDs, Twin bed with mattress, 2 full/queen beds with mattress,Patio furniture, Lawn chairs, Tools, 2 Camping Jeep Tents, Sporting Goods, wooden toy chest/bench, furniture pieces, Couches,Treadmill, Board Games, Vintage Coca Cola and a Pepsi Wooden Crate, DVD and VCR Players, JVC Compact Component Stereo system, Matchbox and Hot Wheel Cars, Sports and other Cards, Flashlights, Knives, and much more. Pickup will be ONE DAY ONLY. if you can not make it that day please do not bid. If you win any of the furniture please make sure you bring your help to move it. All invoices will be charged after the auction ends. No cash will be accepted at the site. If there are any questions please let us know. If the winning bidder is out of state or needs the items shipped we will take back to the warehouse and ship those items out within 4 business days. All others will need to be pickup on the day of pickup.
