BUYERS PREMIUM: A 13% buyers' premium is added to the final invoice price. A 3% discount is applied for all purchases settled with cash or check. If you are placing absentee bids, we accept cash, check, cashiers check or money order. Purchases will ship following cleared payment. S/H/I applies to absentee bids. ALL SALES ARE FINAL: No returns or exchanges are accepted once the Auctioneer accepts the buyer's final winning bid. Once the item is sold, the winning bidder becomes the new owner of the item and has effected a legally binding contract which cannot be altered or voided. NO WARRANTIES: All items are sold as is, where is without warranties, representations or guarantees, expressed or implied as to the quality, character or condition. INSPECTION: The buyer agrees to rely exclusively on his/her pre-auction personal inspection of the property. REMOVAL: Buyer agrees to remove all purchased property from the auction within 10 days of the close of auction. Any lot that remains on Montrie Auction's premises later than 5:00pm of the 10th day following the sale will incur a storage fee of $5 per day up to 30 days following the auction. Items remaining for more than 30 day is considered abandoned and becomes the property of Montrie Auction & Estate Service L.L.C. Any such items will be resold or disposed of without any reimbursement or refund to the buyer. The Buyer is fully responsible for the expense and risk of the removal of property and for any damage to property or injury to persons caused by themselves, their agents or employees that occurs during the removal of the property. If the buyer is having items shipped, the actual cost of shipping and insurance will be charged along with a $10 packaging and handling fee. BID RIGGING: Agreements among buyers at auctions not to bid against each other for the purpose of purchasing goods at low and non-competitive prices is a criminal violation of the federal antitrust laws, punishable by heavy fines and imprisonment. The Sherman Act prohibits bid rigging agreements among competitors if they affect or restrain interstate commerce. SETTLEMENT: The United States and State laws and penalties for failure to settle and pay shall apply. The buyer agrees to make complete settlement on their purchases. Credit cards will be charged on all purchases (including high bids, buyer's premium and applicable sales tax) when other payment arrangements have not been made within 24 hours after the end of the sale. Credit cards will also be charged any applicable storage fees if items are not picked up after 10 days, as described in REMOVAL terms. A $30 fee is charged for all returned checks. If you are tax exempt, we must have a tax exempt form on file for you.
