Listing Terms and Conditions
Accepted Terms and Conditions: Dispersal Solutions is an Estate Liquidation Company. Enjoy our Auctions as each estate is different and each is exiting! What you may "discover" is endless; pre-owned to new, relics & salvage to vintage classics & antiques and perhaps some treasures & things that may have not seen the market in many years! Outlined below are our Terms and Conditions relevant for Bidding & Buying at Auctions Online by Dispersal Solutions. REGISTRATION & IDENTIFICATION. You must register for each individual auction in order to place bids. Basic personal is collected to verify that you are a qualified buyer. Credit Cards are not required for this Auction WINNERS' INVOICES will be e-mailed to all winning bidders within 24 hours after the close of the auction. Invoices will contain the exact pick-up ADDRESS. PRINT the Invoice and BRING it with you on pick-up day. PAYMENTS for your purchases will be made when you present your INVOICE during the allotted pick-up time(s). You will PAY before pick-up. We accept Cash and on purchases over $25.00; Visa or MasterCard. If you do not pick up during the allotted time, you will be charged the full purchase price which includes; the winning bid amount and the applicable Buyers Premium and taxes, as well as the fees as stated in terms of auction. CONDITIONS OF ITEMS SOLD: All items are sold on an 'AS IS, WHERE IS' basis, untested &/or with or without damage. Unless stated otherwise consider ALL items to be Used and Untested. Look at the photos and read the descriptions. Consider all measurements as approximate. If applicable (when there is a preview), please inspect items for yourself during our preview times. We do not guarantee the safety or regulatory compliance of any items, which may include infant and child products. CLAIMS: No responsibility is assumed by Dispersal Solutions or the Seller for any errors or omissions. No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an 'as is, where is' basis, with all faults. YOUR BIDS can be reviewed anytime by using the "Auction Catalogue" or the "Bid History" tab. Please note that no bids can be withdrawn for any reason and that all bids are legally binding and enforceable in Ontario, Canada SOFT CLOSE: Items close every second. To prevent a bidder from 'sniping', all bids made in the last minute of the auction will force an item to stay open for an additional 2 minutes. This will continue until all bidding has ceased. STRATEGY: It is recommended that you put in the maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only use the funds required to beat out the under-bidder at the prescribed bid increment. NOTIFICATION: You can choose to be notified by email during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale. ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction. RESERVE: On occasion bidders may be required to pay a minimum amount in order to win the item. RECORDS In the unlikely event of a dispute, you agree to accept as true that the information we have in our records. PICKUPS & REMOVALS: Dates and Times are published on our website & on the "Auction Information" Tab. Buyers are responsible for the complete removal of their purchases. You will be removing items from a private home; possibly from multiple floors and areas. BRING: Help, Tools, Packing Material, Etc. All removal will be conducted in a "workman like" manner. Buyers' will be charged for the full costs of any repairs of damage to property caused directly by buyer and or their agents. Any item not picked up during the posted pickup times will be considered an abandoned item. If you abandon an item, you will be held payable for the purchase price of the item plus storage, removal, transport and disposal costs. Bidding privileges will be suspended until all outstanding fees have been paid. PERSONAL & PROPERTY RISKS: We will not be liable for damage or injury to individuals or their property. BY REGISTERING AS A BUYER, YOU AGREE THAT WE ARE NOT LIABLE TO YOU FOR ANY DAMAGE TO THE ITEMS YOU PURCHASED, YOUR OTHER PERSONAL PROPERTY, OR FOR INJURY OR DEATH. CATALOGUE ERRORS & OMISSIONS If a description does not match a picture in a lot, the description takes precedence. All items are sold on an 'as is, where is' basis, with all faults. In the event an item was listed in error or an item can't be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding. By bidding you are acknowledging agreement with the terms above. DO NOT BID UNLESS YOU AGREE TO ALL OF THESE TERMS. TRESPASSING: You understand that being at the Seller's property at any time other than the preview and pickup times constitutes trespassing. Furthermore, you understand that Sellers are not to be contacted directly. Anyone found to be in violation of this clause will have their bidding privileges immediately revoked and may be subject to investigation by the authorities. COMPLIANCE WITH LAW: You are responsible for complying with all laws governing the purchase and use of the items that are offered for sale. You must comply with all laws governing the use of our service. INDEMNIFICATION: You will indemnify and hold us and our directors, officers, employees, agents and other representatives harmless from any expenses (including reasonable attorney's fees and court costs), losses or damages arising from or relating to your breach of any of your representations, warranties or obligations under these terms and conditions, or your violation of any law or the rights of any third party. DISCLAIMER OF WARRANTIES: WE DISCLAIM ALL WARRANTIES RELATING TO THE ITEMS FOR SALE, WHETHER ARISING UNDER STATUTE, OR IN TORT, OR BY IMPLICATION OF LAW OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states prohibit the exclusion of special, incidental or consequential damages, so part of the preceding limitation may not apply to you. TO THE EXTENT THAT WE ARE HELD LIABLE TO YOU, OUR AGGREGATE LIABILITY FOR ANY EXPENSES, LOSSES OR DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE OUR SERVICE WILL NOT EXCEED THE AMOUNT PAID (OR PAYABLE) BY YOU TO US UNDER THESE TERMS AND CONDITIONS. Some states prohibit the disclaimer of implied warranties in consumer sales, so part of the preceding disclaimer may not apply to you. WE DO NOT WARRANT THAT OUR ONLINE BIDDING SERVICE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ERRORS IN SOFTWARE OR ONLINE CONTENT WILL BE CORRECTED. LIMITATION OF LIABILITY: WE WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING, WITHOUT LIMITATION, THOSE ARISING FROM THE USE OR INABILITY TO USE OUR SERVICE OR THE STATEMENTS OR CONDUCT OF ANY THIRD PARTY USING OUR SERVICE. THIS LIMITATION OF LIABILITY REFLECTS THE ALLOCATION OF RISK BETWEEN YOU AND US.
