By placing a bid, you are acknowledging your acceptance of these Terms and Conditions NOTE: THIS IS AN ONLINE ONLY AUCTION EVENT. Auction Closing Date: Bidding continues until the last lot is finished. Lots will begin closing at a rate of 1 per minute until the last item is sold. Registration: All registrants must provide name, address, email address, phone number and valid credit card number in order to register. Note that the address on the registration must match the mailing address on file with your credit card company. Payment: Payments may be made by Visa, MasterCard, American Express or Cash on Pickup Buyers Premium: A 13% Buyers Premium will be added to the final bid price and included in the total sale price. Sales Tax: No Sales Tax for this Auction High Bidder Notification: At the conclusion of the auction winning bidders will receive an email advising of the items won as well as provided with an invoice for payment. Bidders will receive an email only and are responsible for checking your email account. Pickup Location: 1046 Melrose Dr Westlake Ohio 44145 Removal for this auction is Sunday October 15th from 12pm to 4pm. Therefore, it is necessary to pick up the items on this date and time stated. No other time will be allowed. Clean out starts Monday Morning. New owners moving in quickly. Bidders are responsible for their own removal. Make sure you bring your own boxing, wrapping and man power to remove your won items. Any item NOT picked up by the set time will be considered abandoned and will be forfeited. We will charge the Card on file by the end of the pickup day to pay for abandon items. If we charge the CC on file and you will you will forfeit the items and they will be trashed. No refunds or charge backs will be granted due to lack of payment or removal at designated times. Removal shall be at the expense, liability, and risk of the purchaser. No items will be released without a paid receipt. IF YOU DO NOT FOLLOW THROUGH TO PAY AND PICK UP YOUR ITEMS AFTER THE AUCTION IS OVER WE WILL CONSIDER YOUR ITEMS ABANDONED. BUT YOU WILL STILL BE RESPONSIBLE TO PAY FOR THOSE ITEMS PER THIS AGREEMENT.FUTHER ACTIONS WILL BE TAKIN IF NEED BE. If you do not pay you will be placed on our prohibited list until taken care of. This will also be sent to any and all other Online Auction Site and Auctioneers that use the HiBid platform. So you may or may not be able to bid on any other HiBid Platform auctions until payment is taken care of. Shipping: All Item/s can be Shipped if Winning Bidder wants to pay for the item/s to be shipped. We will make sure the item/s are packaged the best we can to be shipped. The larger items if need to be shipped will be at the winning bidder discretion. We will assist the best we can for those items. To ship normal item/s there will be a Handling Fee of $5.00 1st item and $2.00 for each additional item. We ship all items Priority Mail with tracking and insurance up to the 50.00 anything above that will cost extra. Bigger and heavier items may be shipped FedEx .Any questions please email or call prior to bidding. Once the auction ends we will pack up all items that were won from Out of State Bidders, weight the package, send an invoice with Shipping and Handling. process the CC on file and ship the package the next day. We will also send an email with the tracking number. This will be automatically for all Out of State Bidders. Any local winning bidders you must call us to let us know that you need the items shipped. Otherwise your items will not be shipped and at the end of pickup day your CC will be charge for the items only and will follow the rest of the Terms and Conditions. Staggered Closing: The online auction moves fast and closes 1 items every minute. The automatic system will close the bidding on intervals. Dynamic Closing. The closing time of an asset is automatically extended an additional 2 minutes whenever a bid is placed within the last 2 minutes of the asset's closing time. BUYER BEWARE: By placing a bid, the bidder acknowledges that s/he has entered into this agreement as the result of a thorough inspection, or acknowledged opportunity to inspect, of the merchandise being purchased and that all merchandise is sold in an "AS-IS, WHERE-IS, and AS-INSPECTED" condition with any and all faults. While descriptions are believed to be correct, the Auctioneer and the Seller make no warranties or guarantees, expressed or implied, as to the genuineness, authenticity or merchantability of, or defect in any item, and will not be held responsible for any discrepancies or inaccuracies. No warranties are made as to the merchantability of any item or their fitness for any purpose. ALL SALES ARE FINAL. It is understood and agreed that the Auctioneer is acting as an agent only and shall in no case whatsoever be held liable by either party for the performance of any term or covenant of this agreement or for damages for non-performance thereof. Purchaser does hereby indemnify and hold harmless Auctioneer, Auction Firm and Seller from any and all damages and claims of any type whatsoever caused by the removal of the item(s) purchased. Please inspect the lot numbers and read the descriptions. You are bidding on the described item, always read the item description. IMPORTANT! The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchase, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items. Choose Wisely: We want everyone to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. The Auctioneer reserves the right to add or remove items from the auction - split or combine lots - add minimum bids or reserve prices - cancel, suspend, extend or reschedule an individual item and or auction event - make changes to the auction closing times or inspection or removal times. Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by the Cuyahoga County Court of Common Pleas in Cuyahoga County, Ohio. Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price. The above-stated Terms & Conditions of Sale cannot be altered except in writing by The Auctioneer.

Auction will start to end at 6pm Everything that is WON will need to be PICKED up on the pickup date ONLY. If not picked up it will be thrown away on Monday. House is sold and Clean up will start Monday morning after pickup. So if you cannot make it please do not purchase. No other arrangement can be made at this time. We have no where to store it for you. However if you dont pick it up we will still charge your CC on file as per the Terms n Conditions after pickup time has ended.
