We reserve the right to withdraw any product before the sale and shall have no liability whatsoever for such withdrawal. Bidding You must honor all successful bids placed in any auction. In the event you complete a successful bid, you will be obligated to pay the full amount of the successful bid and shall complete the transaction with the Company or the respective seller. A "successful bid" is defined as the highest bid in a regular auction (one with no reserve price) or the highest bid in a reserve auction that meets or exceeds the reserve price. By bidding in an auction you agree to honor all listed terms of sale including, but not limited to, method of payment, appropriate state sales tax, and shipping and handling fees. You are required to provide accurate and complete personal information on your registration and you hereby further agree that whether you are acting as a principal, an agent, or an officer or director of a corporation, or otherwise in any capacity whatsoever, you are personally liable for the payment of the purchase price, buyer's premium and taxes payable with respect to any product auction which you are the successful bidder By bidding on a product you represent and warrant that any bids placed by you are not the product of any collusive or other anti-competitive agreement and are otherwise consistent with federal and state antitrust law. We reserve the right to reject any bid, in our sole discretion. Final Sale All purchases through the Website or as a result of visits made by you are governed by these Terms of Use. ALL PURCHASES MUST BE PAID IN FULL WITHIN 48 HOURS OF RECEIPT OF INVOICE. Invoices will be e-mailed within 24 hours of auction closing. All sales are subject to sales tax, unless buyer provides Company with a valid tax exempt form. Payment shall be made by cash, electronic funds transfer, cashiers check or a personal or company check accompanied by a bank letter of credit. Title to a product will not pass until we receive full payment in the form described above. In addition to other remedies available to us by law, in the event payment is not made in full within 48 hours of receipt of invoice, we reserve the right (i) to impose interest on the amount due from the date of sale equal to 18% percent per annum, or the highest rate permissible by law, whichever shall be less, and/or (ii) treat the purchased product as property of the bidder and hold possession and/or resell such product without notice and use the sale proceeds therefrom to recover any loss or cost incurred due to bidder's failure to pay. Rigging/Removal of a sold product is the sole responsibility of the buyer and must be completed by the posted date. Rigging/Removal may not begin until payment has been made in full and the auction sale is complete. Recommendation or approval of Riggers by Company, by any employee or agent of Company, or by any affiliated entity of Company shall be done only as an accommodation to the buyer. Such recommendation or approval shall not cause Company to be liable in any way for any act or omission of any such Rigger. Selection of a Rigger is solely within the discretion of the buyer, and the buyer acknowledges and agrees that it shall have no rights or remedies against Company, any employee or agent of Company or any affiliate of Company based upon any act or omission by a Rigger. Geographic Restrictions The owner of the Website is based in the state of Florida in the United States. We provide this Website for use only by persons located in the United States. We make no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. BAJA Bid welcomes you to our Sypris Electronics "Sealed Bid" Auction! Inspection: Bidders are invited to preview and inspect all of the equipment prior to the bidding deadline. All on-site preview / inspection visits must be scheduled in advance and completed during the allotted times. Bids: Bidders are encouraged to submit their absolute maximum bids when entering their offers. All formal bids must be submitted before 5pm EST on October 12, 2017. Buyer's Premium: The Buyer's Premium for buyers paying via Cash, Certified / Cashiers Check or Bank Wire will be 16%. If payment is made using an accepted credit card; the Buyer's Premium will be increased to 19% to cover the associated processing fees. Payment: All winning bidders will be contacted before 5pm EST on October 17, 2017. An invoice will be provided detailing the items that were purchased and the payment is due at that time. This entire payment must be received with in 48 hours after receipt of the corresponding invoice. The preferred payment methods are cash, certified check or bank wire transfer. American Express, Visa or Mastercard credit cards may be accepted depending on the final sale price and specific conditions. The payment must be paid in US dollars. Shipping & Removal: The buyer is responsible for all shipping related arrangements, expenses and liabilities. (EXW Origin) The removal of all equipment must be completed before 5pm EST on October 26, 2017. *** NO EXCEPTIONS *** All items not removed on or before the removal date shall be subject to storage fees. Any items not removed prior to the above mentioned removal deadline will be considered abandoned and Baja Bid shall have no further obligation to the buyer with respect to the purchased items. Note: The sellers have the right to set reserve prices and purchase their own equipment. The seller also reserves the right to sell their equipment individually or as a package. This decision is solely theirs and will be based on what makes more business sense for their organization.
