Under and by virtue of the Power of Sale contained in that certain Deed of Trust from Dawn M. Thomason and Bruce W. Thomason to Ronda McDowell and Steve Anderson, Trustees, dated February 6, 2004 and recorded among the Land Records of Anne Arundel County, Maryland at Liber 14441, folio 085, the holder of the indebtedness secured by said Deed of Trust having appointed Martin L. Goozman and Jeffrey W. Bernstein, Trustees for the purpose of foreclosure, default having occurred under the terms thereof and at the request of the party secured thereby, the undersigned Substitute Trustees will offer for sale at public auction on the front steps of the Circuit Court for Anne Arundel County located at 8 Church Circle, Annapolis, MD 21401 on:
TUESDAY, SEPTEMBER 26, 2017 AT 12:00 P.M. (NOON)
ALL THAT FEE SIMPLE LOT OF GROUND AND THE IMPROVEMENTS thereon situate and lying in Anne Arundel, Maryland and more fully described as follows:
BEING KNOWN AND DESIGNATED AS LOT NUMBERED FIFTY (50), SECTION THREE (3), IN THE SUBDIVISION KNOWN AS “FOUR SEASONS ESTATES”, AS PER PLAT THEREOF DULY RECORDED IN PLAT REF 37/19, AND RECORDED AMONG THE LAND RECORDS OF ANNE ARUNDEL COUNTY, MARYLAND.
PROPERTY DESCRIPTION: The property is believed to be improved by a three bedroom, 2 bath, 2K ± square foot “Rambler” situated on a 1/4 ± acre lot. It is believed to include remodeled bathrooms with a Jacuzzi tub in one of the bathrooms as well as a fireplace located in the family room. The property is believed to have a tank less water heater as well as a one car garage. The property will be sold subject to a first deed of trust. Amount to be announced at time of sale.
TERMS OF SALE: A deposit of $10,000.00 in cash or certified funds will be required of the purchaser at time and place of Auction Sale. Balance due in cash or certified funds within twenty (20) days following final ratification of the sale by the Circuit Court for Anne Arundel County, Maryland. Interest to be paid on the unpaid purchase price at the rate of 4.00% per annum from day of Auction Sale to date of settlement. Time shall be of the essence with respect to settlement by the purchaser. The Substitute Trustees reserve the right, in their sole discretion, to (i) reject any and all bids, (ii) to modify or waive the requirements for deposits from bidders and other terms of sale or settlement; and (iii) withdraw the property from sale at any time before or at the Auction. The party secured herein, if a bidder, shall not be required to post a deposit or pay interest. In the event the purchaser fails to go to settlement as required, the deposit shall be forfeited and the property resold at the risk and expense of the defaulting purchaser. If the Substitute Trustees is unable to convey title, the purchaser’s sole remedy in law and in equity shall be limited to a refund of the deposit and the sale shall be considered null and void and of no effect. Taxes, ground rent, water rent and all other public charges and assessments, payable on an annual basis, including special paving taxes and/or metropolitan district charges, if any, shall be adjusted to date of Auction Sale and assumed thereafter by the purchaser. Cost of all documentary stamps, transfer taxes, document preparation, title insurance, survey costs, and all other settlement expenses incidental to the conveyance of the property shall be borne by the purchaser. The property will be sold in an “AS IS” condition, without any warranties, representations or guaranties either express or implied as to the nature, condition or description of the improvements thereon and subject to all easements, conditions, restrictions, rights of redemption, covenants, encumbrances, such state of facts that an accurate survey or physical inspection of the property might disclose and agreements of record affecting the same, if any. In the event this property is subject to a ground rent, buyer agrees to the leasehold purchase subject to the ground rent with no adjustment in the purchase price. In addition, the property will be sold subject to all existing housing, building and zoning code violations, and subject to all environmental problems and violations which may exist on or with respect to the property and subject to all matters and restrictions of record affecting the same, if any. The purchaser at the foreclosure sale shall assume the risk of loss for the above-referenced property immediately after the Auction Sale takes place. Purchaser shall be responsible for obtaining physical possession of the property. Purchaser acknowledges the requirements of MD Code, Real Property, § 14-126.1 et, seq, internet-based Foreclosed Property Registry, which requires that the purchaser register the property with the MD Foreclosed Property Registry. Conveyance shall be by Trustees’ Deed without covenant or warranty, express or implied. The purchaser releases the Substitute Trustees, the holder of the indebtedness, the Auctioneers, and their respective agents, successors and assigns from any and all claims the purchaser and/or its successors and assigns may now have or may have in the future relating to the condition of the property, including but not limited to the environmental condition thereof and expressly waives all such claims.
