PLEASE NOTE: There is a 10% buyer's premium for online purchases plus a 5% online bidding fee. Payment is due at the end of the auction. PLEASE NOTE: We may allow you to pay for items you win using an online payment service powered by WePay, Inc.("WePay"). Your use of the WePay payment service (the "Payment Service") is solely governed by WePay's Terms of Service and Privacy Policy located at www.wepay.com/legal (collectively, the "WePay Terms"). All transactions, using the Payment Service or otherwise, remain subject to the applicable terms and conditions herein (including the refund policies posted therein). You may not use the Payment Service to engage in activities prohibited by the WePay Terms or otherwise to violate applicable law.
If you use the Payment Service, you will be required to provide information regarding your credit card or other payment instrument. You represent and warrant to All American Auction Company that such information is true and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. You agree to pay All American Auction Company the amount that is specified for the item(s) you are purchasing in accordance with the applicable terms and conditions herein. If after three (3) business days you fail to pay for the items you win in full, All American Auction Company reserves the right to charge your credit card on file the entire amount due (including the hammer price, buyer's premium, all applicable taxes and other charges).
In the event you file a chargeback with your credit card facility to reverse or invalidate a processed payment, All American Auction Company and WePay have the right to contest any such chargeback in accordance with the WePay Terms. We and/or WePay may request necessary information from you to contest the chargeback. If the chargeback is contested successfully, your payment will be released to WePay. If a chargeback dispute is resolved in your favor, you will recover the chargeback amount through your credit card facility.
IF YOU DO NOT AGREE DO NOT BID! All online bids will incur a 15% buyer's premium. Declined credit cards will result in legal actions being taken. Any credit card that is denied will automatically incur a $20.00 additional fee & bidder will be added to auction's no bid list and receive an unpaid item strike with online auction service. Texas Sales tax is 8.25% and will be added to all winning in state bids + buyer's premiums unless All American Auction has a valid Sales Tax exemption form on file from the Texas buyer. Tax exempt forms may be emailed to jim@aaauction.net. All items designated as pick up ONLY or buyer must make arrangements shipping are totally the responsibility of the buyer. Auction house will determine how to ship items as designated as shipping available. If you wish to make other arrangements you must call 254-716-4688 within 24 hours of auction end to notify the staff of your wishes. While every effort is made to execute and honor absentee and phone bids, the auctioneer is not responsible for failure to execute a bid. All bids are time stamped. In case of identical bids, the first bid received will take precedence. Item ownership is conveyed immediately following the fall of the auctioneer's hammer. While we try to handle and store all items with great care we will have no liability for any loss or damage to an item after the hammer has fallen. All merchandise sold "as-is, where-is," no warranties are expressed or implied, all sales are final. No returns, refunds or exchanges. Merchandise is sold to the highest bidder, in-house bidder is tie winner.
Persons attending during exhibition, sale, or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the auction company from liability therefore. Neither the auction company nor its principal or seller shall be liable by reason of any defect in, or condition of, the premises in which the sale is held.
Although auction information has been obtained from sources deemed reliable, the auctioneer and sellers make no warranties or guarantees expressed or implied as to the genuineness, authenticity of, or defect in any item in the auction or the accuracy of information contained herein or announced by the auctioneer. By bidding, you signify that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the item(s) for you. Any statement made by the Auctioneer or Seller regarding the merchandise should be used as a guide only. Any error in description does not relieve the buyer of their responsibilities. THE ABILITY TO BID REMOTELY IS A PRIVILEGE GRANTED BY ALL AMERICAN AUCTION, BUT THE BURDEN OF DIVINING THE NATURE OF EACH LOT REMAINS WITH THE BUYER EXACTLY AS IF YOU WERE IN THE GALLERY PERSONALLY. THEREFORE ALL SALES ARE FINAL. NO RETURNS. NO EXCEPTIONS. All items designated as pick up ONLY or buyer must make arrangements shipping are totally the responsibility of the buyer. Auction house will determine how to ship items designated as shipping available. If auction company does not hear from buyer within 24 hours winnings will be shipped USPS Priority insured. If you wish to make other arrangements you must call 254-716-4688 within 24 hours of auction end to notify the staff of your wishes.Items not removed within a 14 day period with no pre-made arrangements will be deemed abandoned and sold for storage fees! Please bring along your e-mail receipt for items to be released. Buyers assume all responsibility for removal, loading, transportation and handling of their purchases. Buyers accept full responsibility for all costs incurred for removal. Packaging and Shipping of larger items are the responsibility of the BUYER solely. Any small items, such as coins, may be packed and shipped by the auction house. Items packaged and shipped by the auction house will incur a handling fee and actual Priority Mail shipping fees, including insurance. We will combine multiple purchases where possible. Auction house ships on Friday only. If your items are taken to professional shipper you will be notified by them of charges incurred for professional packing and shipping . If you have not received your purchase within 30 days of auction end or if you have questions about your shipment, you may contact Mark at 254-716-4688.
All American Auction makes no warranties or representations whatsoever concerning the fitness for use, safety to fire, or to store, or reliability of any firearm, ammunition, or parts or components thereof, whether antique or modern. Any use of such is entirely at the user's risk. All American Auction expressly disclaims any liability whatsoever for accident, injury, or damage resulting to any person from the use or storage of any lot.
All items are sold subject to applicable Federal and State Regulations. All modern guns must be registered. Gun registration is handled by All American Auction. Modern handgun purchasers must be Texas residents at least 21 years of age and must have a government issued photo id (driver's license). Out of state residents must have an FFL or a licensed dealer in their state to receive shipments of handguns. Modern rifle and shotgun purchasers must be at least 18 years of age and be eligible to purchase firearms. C&R lots will convey to C&R FFL holders per Federal regulations. Buyers are responsible for compliance with the laws of the state in which they reside. Please have your contact email a copy of their FFL license to jim@aaauction.net prior to bidding.
There will be NO international shipments of firearms (a weapon, esp. a portable gun or pistol, from which a projectile can be discharged by an explosion caused by igniting gunpowder, etc.)!!
Firearms can be picked up at All American Auction, 346 Main, Rosebud, Texas 76570. Shipping Availability: All American Auction provides shipping for firearms (except NRR firearms). The cost is: long guns: $70 for the first long gun; $35 for each additional long gun won. Handguns: $40 for first handgun; $20 for each additional handgun won. Please note: There may be additional fees for insurance and fees charged by the FFL holder that your firearm is shipped to. All American Auction has no control over this possible additional fee. If you bid on a firearm and do not pass the NICS check your credit card will be charged and money will NOT be refunded. If you do not follow the instructions in the terms and conditions of sale, your money will NOT be refunded. Auctioneer is licensed by the State of Texas #13414 and managed by the Texas Department of Licensing & Regulation, PO Box 12157, Austin, Texas 78711, 512-463-5522 without implication of endorsement by the State of Texas. Anyone who fails to complete any transaction associated with any bids placed with All American Auction will be sued for "breach of contract". Invoices must be paid within 7 (seven) days of auction close. All legal fees are the sole responsibility of the bidder. Any legal action arising from transactions, either being conducted online or live at our auction hall or any other location represented by All American Auction, will be conducted in Falls County, Texas, USA and under the current laws of the State of Texas, USA. All operations for this auction company are based in Texas and operated under the current laws of Texas, regardless of user or operator computer location.

Mr. Foss was an international traveler and has some interesting items for us to sell.
14 Head of cattle will be included in the sale. Property will be offered at auction by Mark Switzer at around 2:00 PM. Please join us onsite as we liquidate this country estate!!
Firearms will be kept in a secure off-site location until auction day!

Everything must go!! We will be auctioning outdoors so bring a hat or umbrella. Yard has lots of shade but you won't want to sunburn.
