Auction Location: The auction will be conducted from our corporate offices located at 278 N. Third St., Williamsburg, OH 45176 – approximately 1.5 mile from the property.
Terms: All bidders must register and obtain a bidder’s number at the auction site prior to bidding. Registration begins at 11:00AM. The purchaser will be required to make a 10% down payment and sign a Contract to Purchase and an Ohio mandated Agency Disclosure at the auction conclusion. The down payment will be accepted by cash or check with positive ID. The purchaser shall also sign the provided personal demand note for the amount of the purchase price to secure the contract. Real estate taxes will be pro rated to the date of closing.
No residential property disclosures are available from out of state Trustee. Purchaser shall purchase on an “AS-IS, WHERE-IS, WITH ANY FAULTS” basis. No contingencies will be added to the purchase contract.
Buyer’s Premium: A ten percent buyer’s premium will be added to the high bid amounts to determine the final selling prices to be paid by the purchaser.
Closing/Possession: The closings must take place on or before February 21, 2017. All tracts are selling free and clear of any and all liens. The purchaser shall receive an insurable title at closing. The properties will be conveyed by Trustee’s Deed. Possession will be given to the purchaser on date of closing. The closing must be conducted by an attorney, title company, or Bank/Lender of the purchasers choosing. The expense of the closing shall be paid by the purchaser.
Documents. The following documents will be available on our website at www.SempleSells.com. Property Information Packets, Aerials, all Signatory Papers, Buyer/Broker Client Registration Forms, and Surveys will be available for download.
CAUV Recoupment. Purchaser agrees that Purchaser shall either use the Real Estate for agricultural purposes or expressly waives any Seller payment to Purchaser of the estimated agricultural tax savings subject to CAUV recoupment.
Barns for deconstruction and/or removal. There will be 3 large post and beam barns designated for sale, dismantling, and removal. The purchasers of these barns, if different than the purchaser of the real estate, shall have until June 1, 2017 to disassemble and remove their purchases. During this time the barn purchasers shall have ingress and egress over the driveways/land to accomplish the removal.
Inspections: All property inspections must be completed prior to bidding. Please see website for interior inspection dates. The properties are being sold in their “as is, where is” condition.
Agency: Semple International, Inc. is acting exclusively as agent for the seller.
Buyer Broker/Agent Co Op Commission: Up to a 3% buyer broker/agent commission is offered to Ohio licensed real estate brokers/agents. To qualify, Broker/Agents must register their client with the auction firm on auction firm provided forms no later 24 hours prior to the auction. Forms are available below.
