Procedure: The property is being offered by absolute public auction in 9 individual tracts, any combination of tracts or as a whole farm. There are a total of 130+/- acres included within 4 separate parcels. There will be open live bidding and simulcast bidding available at the same time. Bidding will start with individual tracts, as a whole farm and then offered in combinations. This property can be sold in any way to net the Seller the highest amount. Tract 6 must be sold in combination with tract 5 or sold to an adjoining land owner. Tract 8 must be sold in combination with tract 7 or to an adjoining land owner. Tract 9 must be sold in combination with tract 7 & 8 or to an adjoining land owner.
Agency: Bartkus Auctioneers Company and its representatives are exclusive agents of the Seller.
Down Payment: 10% Down Payment on the day of auction with the balance in cash at closing. The down payment may be made in the form of cash, cashier's check, personal check or corporate check. Your bidding is not conditional upon financing so be sure you have arranged financing if needed and are capable of paying cash at closing.
Acceptance of bid: This is an absolute public auction and will be sold to the highest bidder or bidders at the close of the auction. The Successful bidder or bidders will be required to enter into a purchase agreement at the auction site immediately following the close of the auction.
AEP Supplemental Easement and Right Of Way: Tracts 4, 5, 7 & 8 have a 130' wide easement running across them that will include terms that a new property owner will need to abide by. This easement area will restrict any permanent building, structure or improvement to be put in this area.
Farming Rights: The current farmer has this farm under contract to farm the 2021 year. The new owner will receive 1/3 of the proceeds by the end of 2021. This applies to tracts 4, 5, 7 & 8.
Easements: There will be a 25' wide easement granted to access tract 7 through tract 1 and a 25' wide easement granted to access tract 4 through tract 5 if needed. If these easements are needed the Buyer of tract 5 will have a full year from the closing date to have their own driveway installed if desired. In the event this is sold as a whole farm, there will not be any easements needed.
Electrical Service Easement: There is a primary electrical service easement that runs through the rear of tract 4 to run power to the residence on tract 5. This easement has been put there through Northeastern REMC and will remain.
Buildable Tracts: Tracts 1, 2 & 3 are being sold as possible building lots. Allen County Building department will issue one building permit per year on these three tracts because they are being split off one parcel number. This will be a first come first serve basis. Tract 4 is located on a different parcel and will not apply to any such restrictions. Buyers are responsible for obtaining any soil tests needed to comply with the Allen County Board of Health Septic Requirements but the sale is not subject to test results. All four of these tracts will have restrictions that will apply that there will be no Mobile or Modular homes to be put on them.
Evidence of Deed and Title: Seller shall provide a deed and owners title insurance policy in the amount of the purchase price at closing.
Closing: The balance of the purchase price is due at closing which will take place within 40 days or 15 days of presentation of insurable title. Closing costs for an insured closing shall be split by the Seller and Buyer 50/50.
Possession: Possession shall be the day of closing immediately after closing on all tracts except tract 5. The Sellers will retain possession of tract 5 until 45 days after closing to allow for the personal property auction.
Real Estate Taxes: Real estate taxes will be prorated to the day of closing. There are current exemptions on tract 5 including the Homestead, Over 65 and Geothermal exemptions. 2020 taxes on tract 5 were $3771.36.
Acreage: All tract acreages, dimensions and proposed boundaries are approximate and have been estimated based on aerial photos and current legal descriptions.
Survey: A new boundary survey will be completed only if this is sold in tracts. The Seller shall order the survey. The cost of the survey will be split by the Buyer and Seller 50/50. If this is sold as a whole farm, the existing legal descriptions shall be used and accepted by the new Buyer and no new survey provided.
