Purchases become the responsibility of and shall be and remain at the risk of the Purchaser immediately upon acceptance of his bid.  It shall be the responsibility of the Purchaser to insure his purchases immediately.

NOTICE – Policy for international Buyers: all international buyers must provide a current, valid passport for identification purposes and a $5,000.00 deposit. The deposit must be made with US funds in form of cashier’s check or wire transfer.

SALES TAX: All sales are subject to sales tax.

SALES TAX EXEMPTIONS: Buyers with a VALID exemption certificate are not required to pay sales tax for equipment and miscellaneous, but MUST present a copy of their certificate at time of registration at EACH SALE.

EXPORTERS:  If you take possession of your purchase in the United States, you must pay sales tax. You must provide the following in order not to be charged:

Bill of Lading – All export purchases must be removed by a trucking company. The trucking company will provide a Bill of Lading with the purchases listed.

NOTE: No items will be released without this document or you may pay tax and be reimbursed once the Bill of Lading or a Dock Receipt is received.

No sale shall be invalidated by reason of any defect or inaccuracy in any of the lots by reason of their being incorrectly described in this listing or elsewhere and no liability shall be borne by the Auctioneers in respect of any such fault or errors.  These listings have been prepared only as a guide based on information from sources generally believed to be reliable and from the Consignor but the accuracy thereof cannot be guaranteed or warranted by the Auctioneers.  Bidder acknowledges that it is the responsibility to inspect all equipment and to make his own inquires.

There shall be no guarantees or warranties, expressed or implied statutory or otherwise of any nature whatsoever.  Each and every lot will be sold “as is” “where is”.  Specifically, but not to restrict the generality of the foregoing, the Auctioneers make no representation or warranty on any of the lots which are the subject of the auction.

Since the property sold is second-hand property, seller makes no warranty of any kind and sells the goods on an “as-is” basis, further, seller makes no warranty of any kind whatever, expressed or implied: and all implied warranties of merchantability and fitness for a particular purpose are hereby disclaimed to the seller. 

All necessary documents will be mailed within 7 days of the payment. Availability of these documents is subject to provision of the same by the Consignor.

Every person at the Auction site before, during and after the auction sale shall be deemed to be there at his own risk with notice of the condition of the premises, the activities on the premises, and the conduct of the third parties and the Bidder shall advise his agents and employees.

"Cash or Company Check" accompanied by current “Bank Letter of Guarantee”, made payable to Alex Lyon & Son. Everything Sells “AS IS, WHERE IS.” The following charges will apply on all purchases: (1.) For each unit $35,001.00 and above, a 5.99% administration fee will be assessed when paying with cash or good check. (The standard fee of 8.99% will be assessed when paying with credit card); and (2.) For each unit $1,001- $35,000, a 10% administration fee will be assessed when paying with cash or good check, and a 13% fee will be assessed when paying with credit card. (3.) For each unit $0- $1,000, a 12.5% administration fee will be assessed when paying with cash or good check, and a 15.5% fee will be assessed when paying with credit card.

The Bidder is responsible for knowing which item he/she is bidding on. If he/she is unsure, he/she should inquire or not bid. When you become the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor “mistakes”.

***NOTE** As of February 1, 2018, successful online bidders will now pay an additional 2.5% internet buyers fee with a $700 per item cap. 

All property is sold “AS IS”, WHERE IS" and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Alex Lyon & Son may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Alex Lyon & Son be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.

Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Alex Lyon & Son shall endeavor to describe in detail each item and any pertinent information about it.  Alex Lyon & Son will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.

Please be aware that in addition to the description of each lot being a guide in regards to the condition of the lot, this also applies to the terms in which that lot is sold. It is the buyer's responsibility to listen to the audio or view the chats to know the terms of the purchase. i.e. an individual lot can be sold times the money per piece, per group within the lot, choiced with other lots times the money per piece within each lot, or in any other way the auctioneer announces a lot is to be sold. This will be announced over the audio as well as sent via chat. There is no guarantee this will be noted in the description of a lot, and may not be announced until just prior to a lot being sold. Functionality of the audio or the chat box cannot be guaranteed. A winning internet buyer is still responsible for purchasing a lot or lots in the way in which it or they are sold, regardless of whether or not it is denoted in the description, or if the audio or chat window are fuctioning properly.

Please note that each bid made is legally binding until the lot has been "Sold" online. i.e. the person running the software has hit the "Sold" button and "Sold" is displayed online. This includes if the auctioneer as accepted bid(s) higher than the highest internet bid. The auctioneer reserves the right to revert to the last highest inernet bid, so long as the lot is still open and the bid is still available to "sell" to. This includes if the auctioneer has said "sold" on site. Again, an internet bid is legally binding until the lot is "sold" online, regardless if the auctioneer has attained bids higher than the current highest internet bid or has said "sold" onsite.

Alex Lyon & Son is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Alex Lyon & Son or anyone else if the Internet service fails to work correctly before or during the live auction. Alex Lyon & Son will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Alex Lyon & Son reserves the right to withdraw or re-catalog items in this auction.
