Listing Terms and Conditions
The auctioneers and their staff are employed by the sellers to sell these items at public online auction. All sales are between the buyer and the seller. The auctioneers are acting as agents of the sellers only. All sales are final, and all items are sold as-is, with no warranties expressed or implied. The auctioneer has made every effort to accurately describe the items. All comments on condition and quality of any and all items are the opinion of the auctioneer only. It is the responsibility of the bidders to satisfy themselves as to the condition and quality of the items on which they are bidding. A Buyer's Premium of 15% will be added to all sales. All bids and payments will be in the form of United States Dollars only. Missouri Sales Tax of 8.425% will be charged on all in-state purchases. All bidders must register and provide their name, address, a valid credit card, email address, and phone number at the time of registration. Your card will be charged for your purchases. No items will be shipped until all payments have cleared the auctioneer's account. All purchases will be shipped with the cost of shipping and insurance as an additional charge. The auctioneer reserves the right to refuse service to anyone. Auctioneers reserve the right to set bidding increments and lot and re-lot items prior to the fall of the gavel regardless of type of auction being conducted. Fractional increment advances may not be recognized as bids. Any listed or announced order of sale may be changed WITHOUT NOTICE by the auctioneer. Auctioneer may bid on behalf of absentee bidders. Unless otherwise indicated, all lots are offered subject to a reserve, which is the confidential minimum price below which such lot will not be sold. Reserves are agreed upon with the sellers or, in the absence thereof, in the absolute discretion of the auctioneers. The auctioneer may implement a reserve by opening bidding on any lot and/or by placing a bid on behalf of the seller. The auctioneer will not specifically identify bids placed on behalf of the seller. The auctioneer may further bid on behalf of the seller, up to the amount of the reserve, by placing successive or consecutive bids for a lot or by placing bids in response to other bidders. The winning bid in an auction will be the highest bid that exceeds any reserve (if a reserve exists). In the case of equal bids, the earliest bid received will be the winning bid. If a higher bid is subsequently withdrawn or removed then the auctioneer shall have the right to accept the next highest bid. All bids are in the form of United States Dollars only. This auction will have a soft close, with bidding extended 3 minutes on items recieving bids during the closing time. If debt collection is required, the buyer agrees to pay all attorney fees and costs incurred by the auctioneer to collect the debt. Any debt collection or dispute proceedings will be heard in the Court of Andrew County, Missouri only. We do not sell or rent your personal information to third parties for their marketing purposes. We may keep your information on file for our email list for upcoming auctions. We do not sell or rent lists of any kind. Due to Auction being online, Server & Software Technical Issues can happen: If for any reason the system goes down technical difficulties related to the server, software or any other online auction related techologies, auctioneer reserves the right to extend bidding, continue the bidding or close the bidding. Neither the company providing the software nor VanSchoiack Realty & Auction shall be held responsible for a missed bid or the failure of the software to function properly for any reason.
