By bidding with our auction company, you are agreeing to the following.
-All sales are final. Everything is sold "AS IS" with no guarantees unless otherwise stated by the auctioneer. It is the responsibility of the bidder to assure him or herself as to the condition of items prior to bidding. Condition reports given by the staff of Bontrager's Auction Service are subjective, and while we strive to be honest, we will not be held responsible or liable for any errors in description. Buyer is responsible for examining items or obtaining adequate information about the item before bidding. Auction company does not take responsibility for buyer's failure to examine or obtain information. Merchandise is not subject to adjustments once the item has been sold.
-Bontrager Real Estate & Auction Service and its staff will not be held responsible or liable for any errors in absentee/left bids or phone bids, nor for the possible failure to execute left bids for any reason.
-Payment is due in full within the time limits posted in the auction. For this auction, all payment will be made through the credit/debit card you provide when you register. We accept Visa, MasterCard or Discover. (Please note that while you may be able to register for our auction with any credit card, we will only accept Visa, MasterCard, or Discover for payment.) 13% buyer's premium and NYS sales tax added to all items purchased. Late payment will result in a $25 late fee. Buyers with declined credit cards must provide payment information at the following link: http://www.bontragerauction.com/payment-verification/
Credit/debit card payments will not be taken over the phone.
-Additional Charges are as listed unless otherwise stated within the auction: -Failure to pick up auction purchases- $20. - Purchased items left at auction site- minimum $20 plus the cost of disposal. -Removal of purchases from auction site- $20 (large items such as vehilces, machinery, etc. will be subject to a $20 per hour removal fee. Storage at our auction facility- $10 per week. Packing materials needed at auction site: 50 cents per box. Packing/handling in preparation for shipping-$10-25 depending on size/weight/fragility of item. Transporting item to a shipping facility for professional packaging- $20.
-By bidding with our auction you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as winning bidder, and agreeing that Bontrager Real Estate & Auction Service, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. Any liability to a purchaser will not exceed the purchase price actually paid. Failure of bidder to uphold the bidding agreement as described in the Auction Terms can result in suspension of bidding privileges at Bontrager Real Estate & Auction Service.
-Successful bidders will sign their receipt at the time of merchandise pick up indicating that all items are present and in satisfactory condition. No returns, refunds or exchanges will be issued after the merchandise leaves the pick up location.
-Bontrager Real Estate & Auction Service will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
-Bontrager Real Estate & Auction Service has the right to void any sale, suspend bidding, re-sell any item/lots for any other reason.
-All sales are subject to appropriate sales tax and buyer's premium. Buyer's premium is 13% of purchase price and is subject to sales tax.
-Bids cannot be retracted once the auction begins.
-Buyers are responsible for making arrangement to pay for and pick up items within the time frames listed for the auction. Any variation, resulting in late pick up or payment will result in additional fees for removal and storage (see "Additional Fees" section). There is no delivery service for this auction. Bontrager's Auction Service is not liable for any damage to property left on the auction premises after the auction, whether or not payment has been made. We reserve the right to impose a storage fee of $10 per month for property not picked up within stated deadlines. Merchandise left 1 month after the auction is subject to sale with the proceeds covering storage and auction fees due to the auction company.
-In auctions where shipping is offered, buyer pays all shipping fees, including any tax or duty associated with shipping outside the USA. Handling charges range from $10 - $25 depending on the size/weight/fragility of the package, unless otherwise stated.
-In the event of legal proceedings arising from this contract or from the auction in connection therewith, buyer consents to being subject to the personal jurisdiction of the courts of the State of New York, Genesee County.
-For this auction, payment is by credit card only.

Collection of vintage lamps & lighting, artwork (including pieces from WNY artists such as Roy Mason, Nina Mason Booth, and Virginia Carr Mumford), many antiques & collectibles, including advertising, furniture, and much more.

SHIPPING:
Bidder must confirm with auction company that we will ship an item prior to the close of the auction. There are items that we will not ship, or that must be professionally packaged. We can be reached at 585-343-4529 or todd@bontragerauction.com.
PAYMENT: All payments will automatically be charged at the close of the auction to the credit/debit card used to register.
MERCHANDISE PICKUP DATE: Saturday, November 21st, 8 a.m. to 12 noon BY APPOINTMENT in at Bontrager's Auction Center, 8975 Wortendyke Road, Batavia, NY 14020. Customers will be assisted by appointment time. Appointments are required to limite the number of people at the site. There is only one pick up date for this auction so please plan accordingly. Note: We charge for late pickup and storage (see our terms).
MERCHANDISE PICKUP PROCEDURE:
-Bring your own copy (either on paper or electronic) of your receipt. It is up to you to make sure you have all your items and they are in the condition you expected. Once the item leaves the premises, there will be no exchanges, returns, or refunds.
-If you are unable to pick up on the scheduled date, please send someone in your place or kindly refrain from bidding in this auction. We are unable to accommodate multiple dates for pickup.
-Customers will be assisted by appointment times for pickup. It will be necessary for customers to enter the building to to remove merchandise. Masks are required by NYS law, and number of people in the building will be limited (by appointment time). Customers should come prepared to remove the items themselves and bring any assistance or tools they may need.
-There is no delivery or storage available. If purchases are not picked up there will be a minimum $20 removal fee, plus storage fees and an appointment must be made for pickup.
-Items not picked up on the scheduled date will be resold 10 days after the auction pickup to cover fees.
