TERMS & CONDITIONS
Before bidding online at Fulsom Auctions, you must read and accept the Terms and Conditions of bidding. Read these terms carefully. When you sign your bidder registration Agreement or click the "Accept" button online, you enter into a binding legal agreement with Fulsom Auctions. Your e-mail address will automatically be added to our mailing list and you will receive notifications of upcoming auctions upon accepting these terms and conditions.
REGISTER TO BID: Simply answer a few basic questions. We collect credit card information to verify your ability to bid. This is a secure site, all data is encrypted and PCI compliant and SSL certificates are maintained. If you are the successful bidder your credit card will be charged unless prior arrangements have been made. All bids are final and cannot be retracted.
MAXIMUM BID: If you chose to leave a maximum bid and the item sell below your maximum you will only be the charged the final bid amount. The Auction Flex software will bid the predetermined minimum bid when you are out bid and if you check the "outbid notification box" you will be notified if you are no longer the high bidder.
BIDDING & PURCHASING: All bids submitted are final and irrevocable. If you are the highest bidder and the auction house indicates the lot as sold to you, you are the new owner of that item. All sales are final. Every item becomes the responsibility of the new owner as soon as the auction house indicates that an item has been sold. If you are the highest bidder, you are responsible for insuring your purchase immediately.
AUCTION ITEMS: All items are sold on a "as is" basis. Please feel free to contact Fulsom Auctions with any questions and we encourage you to visit the preview. The seller and Fulsom Auctions assume no responsibility for errors or omissions. Fulsom Auctions may attempt to describe the merchandise in advertising, on the internet and in the catalogue, but makes no representations. In no event shall Fulsom Auctions be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. The Bidder shall be the sole judge of value. Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Fulsom Auctions shall endeavor to describe in detail each item and any pertinent information about it.
SOFT CLOSE. Fulsom Auctions Online auctions will have the soft close policy in place. If a bid is placed within the last 2 minutes of a sale that item, the close time of the item will be extended and will remain open as long as there are active bids.
RESERVE: Seldom are items sold with Reserve. If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a 'reserve', you will be required to pay a minimum amount in order to win the item.
STRATEGY: We recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.
PAYING FOR YOUR PURCHASES: There is no cost to register for an auction. When an auction closes, we will charge your credit card with the winning bid amount, plus applicable Buyers Premium and taxes, as stated in terms of auction Shipping cost is the responsibility of the buyer.
PICK UP of items MUST be made within the hours specified for the auction. A Paid Item Receipt will be supplied to the Purchaser and will be required in Order to Remove Items from the Site. Buyers cannot take possession of or remove their purchases from the auction site until the total purchase price (including applicable taxes or fees) has been paid in full. Items not picked up will be considered abandoned and will be disposed. Shipping arrangements are not available. Any damage caused to property during removal of your items will be assessed and charged to the buyer.
ADDITIONAL TERMS: Fulsom Auctions reserves the right to add, remove or change items once this auction has been catalogued and published. Fulsom Auctions has the right to cancel or postponed the auction at any time without notice. Once on-site; Fulsom Auctions and/or the Landlord are not responsible for any accidents; you and your property will have entered the premise at your own risk and will assume your own liability. The Auction House has the right to accept and/or reject any and all bids. All transport or shipping expenses expenses are those of the successful bidder.
