ONLINE ONLY TERMS & CONDITIONS OF SALE 1. Terms & Conditions of Sale for this timed online only auction process constitute a binding agreement between buyer/purchaser and Robert H. Clinton & Company, Inc., Auctioneers & Appraisers (Auction Company) 2. BUYERS/PURCHASERS: Placing a bid on items in this auction is a binding contract between you, the Seller and the Auction Company and the bid cannot be retracted. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. You are responsible for any bids placed under your bidding number and password. The security of your bidder information is your sole responsibility as you, the bidder, will be responsible for any and all bids placed under your number. If at any time you feel that your bidder number and password have been compromised due to lack of security on your part, you must notify the Auction Company immediately. ALSO: as many of these collectible bottles contain liquor and alcohol, BUYERS MUST BE 21 YEARS OF AGE and will be requested to show proof of age when items are picked up. Attempt in cataloging was made to indicate bottles that contained liquor or alcohol with an (L)designation and/or in the conditions area. 3. Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, is not responsible for any interruption in service, errors and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site provided by the Invaluable/Auctionzip online auction platform (the Site). Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction at any time. The Auction Company, in its sole discretion, may void any sale, temporarily suspend bidding and resell any item/lots that were affected by any malfunction. The decision of the Auction Company is final, binding and conclusive. Information listed on the online auction site may contain inaccuracies and typographical errors and the Auction Company does not warrant the accuracy or completeness of the content or that any defects will be corrected. 4. Mileage odometers and hour meters may be higher than what is shown in catalog at time of delivery if vehicle or machinery remains in use during the course of the timed online only auction process. Visual damage and imperfections when seen have been noted and in most cases photographed. Surfaces on items may have scratches, surface imperfections and normal wear and tear from typical use. Bidder/buyers are hereby made aware of these possibilities and purchase accordingly with the understanding that all sales are final. 8. Every item/lot offered in this timed online on only auction sells absolute without limit or reserve, unless otherwise stated in auction details and Terms & Conditions of Sale. Any false information provided when registering for this auction will result in the bidder/buyer being banded from this or any future auctions conducted by Robert H. PAYMENT: Items purchased through the timed online only auction will be paid for as follows: A) Credit Cards: Mastercard, VISA, Discover, American Express; B) Wire Transfer: any total purchase of $3,500.00 or more must be paid for by use of wire transfer of funds to the Auction Company; C) Cash and/or Personal or Business Check: at the discretion and approval of the Auction Company PRIOR to auction closing. D) NO PAYPAL Buyers will be sent an invoice for all items purchased via the email address provided in buyer’s information. Full payment to be made upon receipt of invoice and MUST BE PAID before pick-up can be made. Payment can be made by calling: Robert H. CHARGEBACKS: As a condition to registration and bidding, buyer agrees to accept all charges placed on credit card that is authorized for use at time of registration. Buyers waive any and all right concerning chargebacks or refunds for any items charged to the authorized credit card. Buyer further agrees that buyer is waiving any chargeback rights that may exist under the agreement between buyer and buyer’s credit card company. Should a chargeback be initiated by buyer, these terms and conditions will be conclusive evidence of buyer’s waiver of any chargeback rights. 16. Successful online bidders will have an 18% Buyer's Premium added to their final purchases. 17. PICK-UP AND REMOVAL: All items/lots purchased must be paid for before leaving the property. Due to the Covid 19/coronavirus guidelines, specific APPOINTMENT TIMES will be made once invoice has been paid. Individuals picking up purchases will be required to wear face masks, protective gloves, other protective clothing and observe the 6 feet “social distancing” as required by the State. IMPORTANT: AS SOME OF THESE COLLECTIBLE BOTTLES CONTAIN LIQUOR AND/OR ALCOHOL, BUYERS MAY BE ASKED TO SHOW PROPER IDENTIFICATION WHEN PICKING UP. Scheduled appointments for pick-up will be on Thursday, October 22, 2020 from 9:00 AM to 6:00 PM; Friday, October 23, 2020 and Saturday, October 24, 2020, from 9:00 AM to 12:00 NoonEST. Due to COVID 19 limitations, buyers will be requested to schedule pick-up via www.signupgenius.com . In order to maintain “social distancing”, although appointment times will be set, if a buyer has not finished removal, it may be necessary for the next pickup appointment to wait. We would appreciate everyone’s patience and cooperation through the pick-up and removal process. The Auction Company and the Sellers will make every reasonable effort to accommodate and facilitate a smooth, orderly load out process with buyers. We will also adhere to the COVID-19 guidelines: MASKS, GLOVES & SOCIAL DISTANCING, ETC. Attached is a Liability Release Waiver – COVID-19/Coronavirus Pandemic for your review. Buyers and/or their designated shippers will be requested to sign this Waiver before picking up purchases. 18. SHIPPING: BUYERS ARE RESPONSIBLE FOR PICKUP, REMOVAL AND SHIPPING ARRANGEMENTS. At time of pickup buyers, buyers’ agents or shippers must present a paid invoice. Buyers should also bring appropriate packing items, tools and equipment required for removal of purchases. Another shipper for larger quantities is Craters & Freighter 215-234-8090 (phone). Any and all costs with respect to packing, handling, shipping and transportation will be paid for by the buyer (whether the bidder/buyer has made his/her own shipping arrangements or the buyer opts to use the local shipper listed above). Again, payment in full must be received by Robert H. Clinton & Company, Inc., Auctioneers & Appraisers before any purchased items/lots are released either to the buyer, buyer's designated agent or shipper. Anything NOT REMOVED by the close of the SPECIFIED PICKUP TIMES, the purchased items shall be considered abandoned by the Buyer and the Auction company shall have the right to removed, resell and/or discard said items. Monies paid to the Auction Company for purchases shall remain with the Auction Company to offset expenses incurred by same. 19. In no event will the liability of Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, to any buyer with respect to any item/lot exceed the purchase price actually paid by such Buyer for such item/lot. 20. These conditions of sale shall be governed by the laws of the Commonwealth of Pennsylvania. The bidder/buyer agrees that any suit for the enforcement of this agreement may be brought and any action against Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, in connection with the transactions contemplated by this agreement shall be brought in the courts of the Commonwealth of Pennsylvania or any federal court sitting therein. The bidder/buyer consents to the nonexclusive jurisdiction of such courts and waives objections that it may now or hereafter have to the venue of any such suit. 21. If the buyer breaches any of its obligations under these Conditions of Sale, including his/her obligation to pay in full the purchase price of all items/lots for which he/she was the highest successful bidder, Robert H. Keeping in the COVID 19 guidelines, the Auction Company believes that using SignUp Genius will limit person to person contact at any one time for pickup/load out for all concerned.  Plus this will also provide flexibility to the purchaser in scheduling times most convenient for them based on availability.  Information regarding SignUp Genius will be listed in the purchasers invoice.
 
In everyone's best interest, we are still requiring protective masks, gloves, clothing, etc. to be worn during the pickup/load out process.  Also, a COVID 19 Liability Release Waiver will be forwarded at time of invoicing.   There will be a requirement that this Waiver be signed at time of pickup by either the purchaser or purchasers authorized representative and/or shipping agent.

Keeping in the COVID 19 guidelines, the Auction Company believes that using SignUp Genius will limit person to person contact at any one time for pickup/load out for all concerned.  Plus this will also provide flexibility to the purchaser in scheduling times most convenient for them based on availability.  Information regarding SignUp Genius will be listed in the purchasers invoice.
 
In everyone's best interest, we are still requiring protective masks, gloves, clothing, etc. to be worn during the pickup/load out process.  Also, a COVID 19 Liability Release Waiver will be forwarded at time of invoicing.   There will be a requirement that this Waiver be signed at time of pickup by either the purchaser or purchasers authorized representative and/or shipping agent.

ONLINE ONLY TERMS & CONDITIONS OF SALE 1. Terms & Conditions of Sale for this timed online only auction process constitute a binding agreement between buyer/purchaser and Robert H. Clinton & Company, Inc., Auctioneers & Appraisers (Auction Company) 2. BUYERS/PURCHASERS: Placing a bid on items in this auction is a binding contract between you, the Seller and the Auction Company and the bid cannot be retracted. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. You are responsible for any bids placed under your bidding number and password. The security of your bidder information is your sole responsibility as you, the bidder, will be responsible for any and all bids placed under your number. If at any time you feel that your bidder number and password have been compromised due to lack of security on your part, you must notify the Auction Company immediately. ALSO: as many of these collectible bottles contain liquor and alcohol, BUYERS MUST BE 21 YEARS OF AGE and will be requested to show proof of age when items are picked up. Attempt in cataloging was made to indicate bottles that contained liquor or alcohol with an (L)designation and/or in the conditions area. 3. Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, is not responsible for any interruption in service, errors and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site provided by the Invaluable/Auctionzip online auction platform (the Site). Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction at any time. The Auction Company, in its sole discretion, may void any sale, temporarily suspend bidding and resell any item/lots that were affected by any malfunction. The decision of the Auction Company is final, binding and conclusive. Information listed on the online auction site may contain inaccuracies and typographical errors and the Auction Company does not warrant the accuracy or completeness of the content or that any defects will be corrected. 4. During catalog preparation if any vehicles, machinery, equipment or mechanical items were operating or had been operating when disconnected, this information may be noted for informational purposes. Mileage odometers and hour meters may be higher than what is shown in catalog at time of delivery if vehicle or machinery remains in use during the course of the timed online only auction process. It should be expressly understood that all items sell AS IS WHERE IS with all faults known and unknown. Purchasers should bid accordingly and understand all purchases are final. 7. Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, has made every reasonable effort to provide potential purchasers with accurate information regarding condition of items/lots listed in the timed online only auction inventory and does not assume responsibility for errors and omissions. Visual damage and imperfections when seen have been noted and in most cases photographed. Surfaces on items may have scratches, surface imperfections and normal wear and tear from typical use. Bidder/buyers are hereby made aware of these possibilities and purchase accordingly with the understanding that all sales are final. 8. Every item/lot offered in this timed online on only auction sells absolute without limit or reserve, unless otherwise stated in auction details and Terms & Conditions of Sale. Auction Company will identify any items offered with a reserve. 9. Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, reserves the right to withdraw any item/lot at any time prior to its being sold. 10. All potential buyers must register per the Invaluable/AuctionZip terms and must be approved by Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, to be able to bid at the on-line auction. Any false information provided when registering for this auction will result in the bidder/buyer being banded from this or any future auctions conducted by Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, reserves the right to reject any bid it considers harmful to the conduct of the sale. Further, Robert H. PAYMENT: Items purchased through the timed online only auction will be paid for as follows: A) Credit Cards: Mastercard, VISA, Discover, American Express; B) Wire Transfer: any total purchase of $3,500.00 or more must be paid for by use of wire transfer of funds to the Auction Company; C) Cash and/or Personal or Business Check: at the discretion and approval of the Auction Company PRIOR to auction closing. D) NO PAYPAL Buyers will be sent an invoice for all items purchased via the email address provided in buyer’s information. Full payment to be made upon receipt of invoice and MUST BE PAID before pick-up can be made. Payment can be made by calling: Robert H. CHARGEBACKS: As a condition to registration and bidding, buyer agrees to accept all charges placed on credit card that is authorized for use at time of registration. Buyers waive any and all right concerning chargebacks or refunds for any items charged to the authorized credit card. Buyer further agrees that buyer is waiving any chargeback rights that may exist under the agreement between buyer and buyer’s credit card company. Should a chargeback be initiated by buyer, these terms and conditions will be conclusive evidence of buyer’s waiver of any chargeback rights. 16. Successful online bidders will have an 18% Buyer's Premium added to their final purchases. 17. PICK-UP AND REMOVAL: All items/lots purchased must be paid for before leaving the property. Due to the Covid 19/coronavirus guidelines, specific APPOINTMENT TIMES will be made once invoice has been paid. Individuals picking up purchases will be required to wear face masks, protective gloves, other protective clothing and observe the 6 feet “social distancing” as required by the State. IMPORTANT: AS SOME OF THESE COLLECTIBLE BOTTLES CONTAIN LIQUOR AND/OR ALCOHOL, BUYERS MAY BE ASKED TO SHOW PROPER IDENTIFICATION WHEN PICKING UP. Scheduled appointments for pick-up will be on Thursday, October 22, 2020 from 9:00 AM to 6:00 PM; Friday, October 23, 2020 and Saturday, October 24, 2020, from 9:00 AM to 12:00 NoonEST. Due to COVID 19 limitations, buyers will be requested to schedule pick-up via www.signupgenius.com . In order to maintain “social distancing”, although appointment times will be set, if a buyer has not finished removal, it may be necessary for the next pickup appointment to wait. We would appreciate everyone’s patience and cooperation through the pick-up and removal process. The Auction Company and the Sellers will make every reasonable effort to accommodate and facilitate a smooth, orderly load out process with buyers. We will also adhere to the COVID-19 guidelines: MASKS, GLOVES & SOCIAL DISTANCING, ETC. Attached is a Liability Release Waiver – COVID-19/Coronavirus Pandemic for your review. Buyers and/or their designated shippers will be requested to sign this Waiver before picking up purchases. 18. SHIPPING: BUYERS ARE RESPONSIBLE FOR PICKUP, REMOVAL AND SHIPPING ARRANGEMENTS. At time of pickup buyers, buyers’ agents or shippers must present a paid invoice. Buyers should also bring appropriate packing items, tools and equipment required for removal of purchases. Another shipper for larger quantities is Craters & Freighter 215-234-8090 (phone). Any and all costs with respect to packing, handling, shipping and transportation will be paid for by the buyer (whether the bidder/buyer has made his/her own shipping arrangements or the buyer opts to use the local shipper listed above). Again, payment in full must be received by Robert H. Clinton & Company, Inc., Auctioneers & Appraisers before any purchased items/lots are released either to the buyer, buyer's designated agent or shipper. Anything NOT REMOVED by the close of the SPECIFIED PICKUP TIMES, the purchased items shall be considered abandoned by the Buyer and the Auction company shall have the right to removed, resell and/or discard said items. Monies paid to the Auction Company for purchases shall remain with the Auction Company to offset expenses incurred by same. 19. In no event will the liability of Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, to any buyer with respect to any item/lot exceed the purchase price actually paid by such Buyer for such item/lot. 20. These conditions of sale shall be governed by the laws of the Commonwealth of Pennsylvania. The bidder/buyer agrees that any suit for the enforcement of this agreement may be brought and any action against Robert H. Clinton & Company, Inc., Auctioneers & Appraisers, in connection with the transactions contemplated by this agreement shall be brought in the courts of the Commonwealth of Pennsylvania or any federal court sitting therein. The bidder/buyer consents to the nonexclusive jurisdiction of such courts and waives objections that it may now or hereafter have to the venue of any such suit. 21. If the buyer breaches any of its obligations under these Conditions of Sale, including his/her obligation to pay in full the purchase price of all items/lots for which he/she was the highest successful bidder, Robert H. Clinton & Company, Auctioneers & Appraisers, may exercise all of its rights and remedies under the law including, without limitation: (a) canceling the sale and applying any payments made by the Buyers to the damages caused by the Buyer's breach and/or (b) offering at public auction, without reserve any item/lot for which the Buyers has failed to pay in full the purchase price, holding the Buyer liable for any deficiency plus all costs of sale.
