However, in some cases, the opportunity to make payment via online credit card process may be available and, if so, will be noted in your email you will receive with your invoice. This is a combined auction event that consists of "live", onsite bidding as well as the opportunity to leave "absentee" bids online. Please make sure you place your highest "maximum" bid online BEFORE the online bidding closes at NOON, Saturday, October 3, 2020. The "live" portion of the auction begins at 4 pm. At that time, absentee bids will be carried to the "live" auction for competitive bidding. An auction representative will bid on your behalf during the live auction. As "live" floor bid are received, an auction representative will bid on your behalf up to your maximum bid. If "live" floor bidding stops before you maximum bid is recognized, you will get that item at that amount (we do not automatically take your highest bid, so therefore, you may get an item below your maximum bid you placed online). However, there will be no opportunity to change your high bid online after the online bidding closes at noon - so be sure to leave your highest bid amount BEFORE noon, October 3rd. The auction will be conducted by Farrell Auction Service, LLC (Auctioneer) on behalf of the owners of the property, referred to as the Seller. Auctioneer is not responsible for acts of Seller. 1. Registration required with a valid credit card. Before you bid, know that items are required to be removed from the Auction Location on the designated pickup dates and times (or by prior appointment). By registering to bid or placing a bid, you agree to be bound by all terms & conditions and any other announced terms and conditions of sale or rules of the site. Bidder agrees that bids placed on the internet shall have the same legal effect as if he/she attended a live auction in person and are responsible for full payment and further agree to NO Credit Card Chargebacks. The agreement constituets a valid, binding contract between individuals participating in the auction with the intent to purchase property, referred to as the Bidder or Buyer, and Seller/Auctioneer. 2. You are responsbile for payment and removal of all items you "won"/"purchased" from this auction. Failure to make prompt payment or to remove items within the stated times under the terms and conditions of this auction, may result in you being refused the right to bid or participate in other Farrell Auction Service, LLC auctions. Your failure to pay may also be reported to "HiBid" and may be shared with other auction companies using this bidding platform. The auction company is not responsible for "miscued" bids or mistakes by bidders for any reason. 3. All property is sold "as-is" and it is the bidder's responsibility to determine the exact condition of each item. You may call if you have any questions not covered in our descriptions or pictures. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Absolutely NO refunds will be offered. All sales are final. There is no warranty offered, expressed or implied, by Farrell Auction Service, LLC or Sellers for any property. This includes, but not limited to, the merchantability or fitness of any property for a particular purpose. All property sold AS-IS, WHERE-IS, and with all faults and defects therein. ALL SALES ARE FINAL. 4. The auction company reserves the right to refuse service or decline registration to any person. 5. Items not picked up are considered abandoned and become the property of Farrell Auction Service LLC, unless the auction company has been contacted prior to the scheduled pickup dates/times. The Auctioneer does not ship, nor does the Auctioneer hold items beyond the published removal times (unless prior arrangments have been made). The Auctioneer will not issue you a refund if you are unable to pick up and safely remove your items during the published removal times. DO NOT BID IF UNABLE TO PICK UP! Please bring ample help with you for loading your items and show up so that you have ample time to remove your items before the ending of the pickup time. All items within the "lot" you purchased must be removed. Some items are large and may require disassembling to remove. Come prepared with proper vehicle, packing materials, boxes and manpower to load your purchases. If you have questions on a particular lot, please contact us before bidding. If you think you will use the services of a packing/shipping company, please make arrangments directly with them and ensure these services are available BEFORE you bid. 6. Farrell Auction Service, LLC or the property owner(s) is not responsible for accidents or losses while on sale property. Buyer assumes full responsibility of property at time of purchase, and all risk of losss and damage to property. 7. Terms on bidding site take precedence over any listed terms on this site.The bids are advanced at pre-set increments available on the bidding web page which may be changed at any time at Farrell Auction Service, LLC's sole discretion. Farrell Auction Service, LLC may, at times, accept items with reserve prices. In cases where a "reserve price" has been set, the seller or Farrell Auction Service, LLC reserve the right to "no sale" an item not meeting reserve (or advance a bid up to the reserve price). This is a Public Auction and as such, all qualified bidders may bid including members of the auction company, family members, employees and others on their own behalf or purpose. 8. Photographs and Descriptions: The Auctioneer posts item descriptions and photographs to aid bidders in the bidding process, and we make a reasonable effort to ensure that the descriptions and photographs reasonably represent the items or lots being offered for sale. In some photographs, photos of nearby lots may appear to be joined or included within a lot picture or the wrong photograph may be displayed for a given item. Please review the lot picture and the description before bidding. Measurements given in catalog descriptions are approximated.
