However, The intentions of the descriptions are not to be assumed as definitive and should be thought of as opinions of the auction company on the genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property. No statement made in item information lead descriptions, full descriptions, estimate or those made during the sale should be considered an assumption of liability or warranty. Items that we deem to be questionable in nature will be described as such. Usage of this term does not imply anything other than our opinion. Artworks described as a work by a specific artist fall into our highest tier of authenticity, however, no qualified statement about the authorship is strictly implied. The term signed by the artist is believed to have been inscribed by the artist described. REPRESENTATION, WARRANTY DISCLAIMER AND NOTICE OF NO GUARANTEE All items offered for bid or sale are sold "AS IS," "WHERE IS," and without representation, warranty or guarantee of any kind, whether created by statute or by common law. AUCTIONEER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ANY WARRANTY IMPLIED BY COURSE OF DEALING, OR ANY OTHER WARRANTY, WHETHER CREATED BY STATUTE OR BY THE COMMON LAW. CONDITION, MEASUREMENTS, AND ESTIMATES Information regarding the condition, all measurements and estimates are given as a courtesy to potential bidders, and is only an opinion. These opinions should not be treated as a statement of fact. Geyer's Auction and Appraisal assume no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, possible imperfections or the effects of any aging issues. Bidders are encouraged to preview the item in person or request additional photos or measurements prior to bidding. The estimated values are shown after each lot, are the auctioneer's estimate of what each lot is likely to realize. BIDDING By bidding on any item, Bidder accepts and agrees to be bound by these Terms and Conditions, and specifically acknowledges that these Terms and Conditions constitute a binding contract. If Bidder does not agree to these Terms and Conditions, Bidder is not authorized to make a bid on or buy any item. Bidding advances shall be determined by the auctioneer and shall be at his discretion. The auctioneer has the right to refuse any bids. Some of the items offered at auction may subject to a reserve. A reserve is a minimum price agreed upon by the consignor of the property and the auction house. The auctioneer may bid on behalf of the consignor in order to reach the minimum sale amount. If the minimum amount is not reached, the auctioneer may pass the item. The auctioneer reserves the right to bid on behalf of clients and vendors, but shall not be liable for errors or omissions in executing instructions to bid. All bidders are required to complete the registration and obtain a bidder number. Absentee bidders agree to all terms and conditions. In terms of a tie in bidding between an absentee bidder and the live auction floor, the bidder at the live auction will win said item at their amount bid. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or offer the lot for resale. The auctioneer shall have sole discretion to refuse any bid, or refuse to acknowledge any bidder. Buyers premium is applied to all items sold at auction. This amount will be 15% of the high bid price for on site bidders and 20% for online bidders. Sales tax will be applied according to federal, state, and local regulations. PAYMENT Agreement Not to Dispute Credit Card Charges Bidder agrees that upon processing a credit card, debit card or other bank card, such payment shall be immediate and irrevocable, and Bidder shall not dispute, challenge or reverse any such payment or charge. Invoice totals for Out-of-state Bidders and Non-Local Bidders will be charged to the credit card on-file on the night of the auction, and at a rate of 20% Buyer's Premium. The full purchase price on all lots sold to the same buyer must be paid before removal of any of the items. The full purchase price on all lots must be paid for in full on the day of the auction regardless of when it is picked up. All items must be picked up by Sunday at 2pm. Pick up and load out is allowed during the auction and for 2 hours following the time of sale of the last auction lot. Pick up on Sunday will be between the hours of 12 (noon) to 2 pm only. Any titems not picked up where shipping arrangements have not been made or advised of with the auction company to turn the items over to the Pak Mail of Phoenix for shipment will be forfeited, including any and all monies paid for the item or items. Items which have been left unpaid and not picked up within 1 day will become property of Geyer's Auction and Appraisal and resold at our discretion. Every effort is made to safeguard merchandise throughout the auction; however, the bidder becomes solely responsible for all items purchased by him immediately following his winning bid. Therefore, he is advised to further guard his items at his own discretion. SHIPPING You must advise Geyer's Auction and Appraisal that you will need to have items shipped prior to the end of the auction day. Shipping and handling charges are to be paid directly to Pak Mail Phoenix If you require shipping, Pak Mail Phoenix will contact you about your shipping options after your invoice is paid. Please feel free to reach out to them if you have any questions about approximate shipping charges. Let them know you are calling about Geyer's Auction and Appraisal purchases and reference the auction date and lot numbers. As before, all shipping and handling charges are to be paid by the bidder and all packages must include insurance and a signature confirmation for your protection. IT IS THE RESPONSIBILITY OF THE BIDDER TO VERIFY AND CONFIRM THE SHIPPING ADDRESS AS IT APPEARS ON EACH INVOICE (Found in the Sold To section of each invoice). GOVERNING LAW AND PLACE OF VENUE This Agreement and the rights of the Parties shall be governed by and construed in accordance with the laws of the State of Arizona without the application of any conflict of law principles that would require or permit the application of the laws of any other jurisdiction. Any action at law or judicial proceeding instituted by any Party relating to this Agreement shall be instituted and maintained only in the state or federal courts in Maricopa County, Arizona. BY BIDDING, YOU ARE ENTERING A LEGAL AGREEMENT WITH GEYER'S AUCTION AND APPRAISAL AND HAVE AGREED AND ACCEPTED ALL THE TERMS AND CONDITIONS.

PLEASE NOTE: Due to space availability because of COVID-19 and to ensure the safety of our valued auction participants, the live auction has been postponed to July 24th, 2021. Session 1 - Mimbres Culture Advocational Archeologists Richard "Red" and Virginia Ellison excavated and documented dozens of sites in the Mimbres Valley and Upper Gila regions of Southwestern New Mexico, from the 1930's -1970's. Their collection spans artifacts from multiple time periods, in the Mogollon area. The vast majority of artifacts have documented provenance. The Ellison's last project was a large Salado site they owned and named "Kwilleylekia" , in the Cliff, New Mexico area. Geyer's Auction and Appraisal is proud to be offering this lifetime collection. Thousands of artifacts consisting of beautiful ceramics, stone tools, jewelry, effigies, field notes and photos from the early Mimbres to the Salado Cultures will be sold to the highest bidder. The collection will be offered in multiple auctions throughout the year.
