All items are available for your examination prior to bidding. We recommend prospective bidders examine all items in which they have an interest. Submitting any bid, either via the internet or absentee, on any item, signifies the bidder has examined the items as fully as desired or that bidder/buyer has chosen not to examine them and acknowledges their acceptance of all terms and conditions of sale, as well as the respective rights and obligations of Incredible Antiques shall be governed by and construed and enforced in accordance with the laws of the State of Texas. In the event a bidder refuses to comply with any terms of sale, including failure to pay for any item, Incredible Antiques has the right to pursue all legal remedies available under the laws of the State of Texas at the Bidder's expense. 5. Some of the lots in this sale are offered subject to a reserve. The reserve is a confidential minimum price, below which the lot will not be sold agreed upon by the consignor and Incredible Antiques. In most cases, the reserve will be set below the estimated range, but in no case will it exceed the estimates listed. 6. RETURN POLICY: ALL Sales are FINAL. No Refunds, Credits or Exchanges shall be given. 7. PAYMENT: At the end of the auction you will a receive an invoice to pay online. Or you can pay with a credit or debit card upon in person pickup during pickup time. We have an in-house credit card processing payment system you can use to pay for items When you are picking up. If the invoice is not paid for by the end of pickup time your card on file will automatically be charged. This total will include a 18% buyer's premium and any applicable taxes. Incredible Antiques will email (to address provided on the account) the Winning Internet Bidders and Winning Absentee In-House Bidders an invoice within 24 hours of the end of the auction. If you do not receive an invoice within 48 hours, it is your responsibility to contact Incredible Antiques directly at 1-817-800-0174 to confirm we have the correct email address on file. A dispute will be entered for any invoice not paid within 7 (seven days). 8. We accept the following methods as payment for U.S. auction purchases Only: American Express, Visa, MasterCard, Discover, Cash 3% Discount, and Wire Transfer. Winning Auction price above $3,000 is Wire Transfer ONLY. WE DO NOT ACCEPT PAYPAL. Cash is accepted for in person payments only. If paying by credit card, the billing and shipping address must be the same. If we are prevented by fire, theft, or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid, by the purchaser for such property, with proof of receipt. 9. BUYER'S PREMIUM: A buyers' premium, which is an additional fee that a winning bidder is required to pay above the auction price, will be applied to all auction purchases added to the hammer price of each. For all Internet Bidders, the buyers' premium is 18%, payment method and 3% discount on cash payment. 10. RETURN POLICY: ALL Sales are FINAL. No Refunds, Credits or Exchanges shall be given. 11. PICKUP: All merchandise must be picked up within 5 Business Days of the date of sale. Items left beyond 5 Business days after the sale are subject to a $10 per item per day fee, NO EXCEPTIONS. Any storage fees accrued must be paid prior to item being picked up. Buyer is responsible to contact us directly to schedule pickup/shipping of the items. Pickup hours are Monday-Saturday only, from 11am-5pm CST, for 5 business days following the sale at our 1801 Susan Dr, Suite 100, Arlington, TX 76010 location. We have an in-house credit card processing payment system you can use to pay for items IF you are picking up within the 5 Business days after the auction. It is your responsibility to let Incredible Antiques know that you will be picking up and paying for your items within the 5 days after the auction to avoid a dispute starting. 12. After 10 calendar days, item(s) not picked up shall be considered ABANDONED, in which case the winning bidder (buyer) will forfeit ownership and items will be sold or donated without further notice. Incredible Antiques is not required to refund, credit or compensate the winning bidder (buyer) after this time. 13. SHIPPING: We can provide shipping service for smaller items Above $50. Larger items we can help you find a shipper, or if it's in the area we can arrange someone to bring it by for an additional cost (determent on the items). We help the shipping service you provided load the items. After it leaves our dock, Incredible Antiques shall not be held liable or responsible for any damaged items. We ship through UPS and USPS. We ship within a week after the payment is received. We are no shipping company and we take our time to get the items safely over to you. Shipping cost are added as follows: shipping fees plus $5 wrapping materials. 14. Occasionally you may notice that an item is re-listed. This can be due to a variety of reasons such as a winning bidder in a previous auction not paying for the item, multiple types of the same item or it is one of the few items listed with a reserve and the reserve was not met. 15. While Incredible Antiques makes every effort to call to the attention of bidders the use of after-market parts in items such as clocks, jewelry and watches sold, the use of such parts or stones shall not constitute a warranty or representation that the items are original in their entirety. These modifications, customizations, and alterations may impair the ability of the original manufacturer to repair such item or certify the item as authentic. 16. Electrical items offered are often of some age. We strongly recommend a licensed electrician inspect any light fixtures (lamps, chandelier, etc.) prior to having them installed. Incredible Antiques accepts no responsibility for the wiring or lack of wiring of any item. 17. ABSENTEE AND INTERNET BIDDERS: are offered as a courtesy and Incredible Antiques accepts no responsibility for a missed bid or withdrawal of any lot for any reason with or without notice. 18. NOTICE TO INTERNET BIDDERS: Auctioneer has full discretion in the event of a tie bid and will recognize the bid that he/she sees first. Therefore, it is possible for an item to sell to an Absentee bidder at the exact bid left by an internet bidder. For example, if an internet bidder leaves a bid of $500, but the auctioneers received a Absentee bid for $500 at the same time the internet bid comes across, the auctioneer may recognize the Absentee bidder and the item would sell at that bid to the Absentee bidder if there are no advances. 19. Incredible Antiques is not liable for malfunctions, errors or omissions (hardware, software, electronic, human or otherwise) whether or not due to Incredible Antiques. fault or negligence, resulting in the inaccurate transmittal of bids, the failure to execute bids or any other irregularity. 20. Incredible Antiques reserves the right to withdraw any lot at any time before the auction without liability. The auctioneer reserves the right to reject any bid not commensurate with the value of the property offered. Auctioneer reserves the right to make verbal corrections at the time of sale. 21.
