1. All persons who wish to bid in the auction must register before the sale. You must provide all of the registration information requested and agree to these Terms and Conditions. Buyers must be 18 years of age or older and have a valid driver’s license. Auctioneer reserves the right to refuse to register or admit any person at its sole discretion. 2. Prior to removal of purchases, payment must be made in cash, credit card, or by approved check. Buyer shall pay any and all applicable taxes unless exempted by law. If you are exempt you must bring a copy of your Ga. Reseller certificate, or your Ga. GATE Card. Buyer acknowledges that Seller has provided him with the opportunity to inspect the item(s) before purchasing them and the buyer has or has not so inspected the items in his sole discretion. 3. A bid by any persons shall be conclusive proof that the person has made himself acquainted with these conditions of sale and has agreed to be bound by them. 4. Though all descriptions and commentary are believed to be correct, neither Auctioneer nor Seller makes any warranties or representations of any kind with respect to the property and in no event shall be held responsible for having made or implied any warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, condition, etc. 5. ALL SALES ARE FINAL, AND ALL PROPERTY IS SOLD “AS IS, WHERE IS”. It is bidder’s responsibility to determine condition, etc. The Seller reserves the right to reject any and all bids it deems necessary. 6. The buyers shall be the highest bidder. 7. When the Auction has ended, title of the property shall pass to the highest bidder, who assumes full risk and responsibility. All property shall be removed from the premises by the purchaser at his own risk and expense within the time period announced by the Auctioneer. 8. Auctioneer or Seller reserves the right to withdraw any item before or during the sale. Auctioneer may reject a nominal or fractional bid advance if, in his estimation, it proves injurious to the sale. 9. Buyer assumes all risk and liability whatsoever resulting from the use of the item(s) sold here under, and shall defend, indemnify, and save harmless Seller and Auctioneer from any liability. 10. If the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Auctioneer and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at his option may (1) resell the property publicly or privately, with the purchaser being liable for the payment of any deficiency plus all costs incurred, or (2) cancel the sale, retaining all liquidated damages on all payments made by purchaser, Auctioneer commission and all other incidental damages will be charged. 11. A buyer’s premium will be charged in this sale. The buyer’s premium is an advertised percentage of the high bid or flat fee added to the high bid to determine the total contract price to be paid by Buyer. A (10%) buyer’s premium will be added to the amount of the high bid. (13%) for those paying by credit card. Unless noted otherwise in the description.
