Pickin Estates Terms and Conditions 1) Bidder Requirements: No deposit require to bid. At the end of each auction you will be emailed an invoice for the total amount due, including the buyers premium fee (see 3) and sales tax if applicable (see 4). All invoices must be paid within 24 hours of each auction's end unless previous arrangements have been made. Bidders who do not pay their invoice in a timely manner will have their account canceled and will be banned from bidding on future auctions. 2) Payment: Accepted forms of payment include all major credit cards, cashiers check, money order, PayPal or cash - no personal checks are accepted. Cashiers checks and money orders should be made out to Pickin Estates. 3) Buyers Premium: A buyers premium will be added to all invoices at a rate of 12%. If making a cash payment upon pickup, contact staff@pickinestatesauction.com for a 2% discount on your buyers premium fee and revised invoice. Changes will not be made at time of pick up. 4) Sales tax: All winning bidders will be charged California sales tax, except in the event that you send us appropriate tax-exemption forms in advance of the event closing. Tax-exemption forms must be submitted per auction for each bidder number before the posted event closing date. Send completed forms and your bidder number to staff@pickinestatesauction.com - you will receive a confirmation email.?? Please note that forms without this information cannot be processed. Click here to download a tax-exemption form. 5) Bidding: Your confirmed bid is a contract with Pickin Estates that indicates your agreement to purchase the item if you have the winning bid. Some bidders will routinely increase their bids to price an item out of reach of other bidders - ALL BIDS should be reviewed before submitting. In the event of a bidding error you must contact our office at staff@pickinestatesauction.com or call (951) 751-7235 immediately to correct the error. We will not reverse any bids once auctions end. NO EXCEPTIONS. 6) Sale Terms: ALL SALES ARE FINAL - NO RETURNS OR REFUNDS. Pickin Estates does not guarantee the condition of any item. It is the responsibility of the bidder to preview all items at our warehouse prior to bidding. There will be a 2 day open house to preview items up for auction prior to each auction start date where you can inspect the items. No other days will be available for viewing before auctions end. Descriptions are given as accurately as possible and photos are provided, but physically previewing items is strongly recommended. All merchandise is sold AS IS, where is, with no guarantees or warranties on any item sold. We do not want cases of Buyer's Remorse - know what you're buying before bidding. 7) Staggered Closing: Pickin Estates online auctions close one (1) item per minute. If a bid is placed on an item within the last minute, the auction time extends an additional three (3) minutes to give other bidders a final opportunity to increase their bids. This feature works great at emulating a "live" auction. Please remember to use your refresh button often to ensure you are seeing the correct end time for each item. 8) Bidding: All items will be sold to the highest bidder. Items will show the high bidders number next to the item, if it's not your bidder number, you have been outbid. Outbid emails will be sent up to the last day of the auction. 9) Item Removal: Each auction will have designated days for items to be picked up. If you can not pick up won items on the days and times listed, please do not bid. No refunds will be made and your items will be considered abandoned if won items are not picked up. We understand that sometimes emergency situations occur, in those cases please contact staff@pickinestatesauction.com to make other arrangements. In some instances, lots will be put together in metal drawers or wood crates - these are not included in the sale unless specified so. Bring your own boxes and wrapping materials. 10) Damage: Any damage caused by a bidder during preview or while picking up will be made good by the bidder/buyer. Buyer agrees that the credit card on file will be charged for any expenses and/or repairs necessary to correct any damage incurred. (11) Disputes: Any controversy or claims arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by either Small Claims Court, State Court or arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be San Bernardino County, California. 12) Limitations: Conditions of sale cannot be altered except in writing by the auctioneer.
