Auction End Time: Our on line auctions are timed events and all bidding will begin to close at specified times. There is also an auto extend feature. If a bid is placed in the final 3 minutes of an auction, the close of the auction will be automatically extended 3 minutes from the time the bid was placed. Example: if an auction item scheduled to close at 6:00 pm receives a bid at 5:58 pm, the close time will automatically extend to 6:03 pm. The auto extend feature remains active until no further bids are received within a 3 minute time frame.
Staggered Closing: This online auction closes in intervals. Please check the auction announcements for detailed information regarding these intervals. The auto extend feature closely simulates a live auction.
Notice to all Bidders: All property is sold in �AS IS� and �WHERE IS� condition. ALL SALES ARE FINAL! Bidder understands and agrees that no refunds, exchanges, adjustments, charge backs, etc., will be allowed. Property is available for inspection at specified times and it is the bidder's responsibility to determine condition. Bidder's failure to inspect any item or lot will not constitute grounds for any claim, refund, adjustment, charge back, etc. All personal property is selling absolute, meaning there are no reserve prices. Everyone with the financial means to purchase the property is eligible to bid, including family members, heirs, and the auction company.
All description information has been gathered from sources which we believe to be reliable but are not guaranteed. Auctioneer makes no warranty or guarantee of any kind with respect to condition, authenticity, provenance, source, condition, suitability for a particular purpose, etc. Auctioneer reserves the right to change, modify, delete any item or lot or description in the auction as may be necessary.
The Auctioneer reserves the right to reject any bid at his discretion.
Payment, Pickup, Shipping & Storage Terms:
Pickup/Payment Info: PAY AT PICKUP - Accepted methods of payment are cash or check. All purchased items must be removed by the deadline as noted. Any items not removed by the deadline will, at Auctioneer's discretion, be discarded or resold with proceeds retained by Auctioneer. There will be NO REFUND to the purchaser for these forfeited items.
Upon registration your credit card will be verified for authenticity and there will be a $1.00 pending charge that may appear on your statement. This charge will not be processed and will disappear after the authentication process has completed.
Item Pickup: NO SHIPPING AND PACKING SERVICES AVAILABLE. The auction company nor the sellers provide shipping, shipping preparation or transportation services for any items. Removal of items, moving, packaging, loading, transporting, shipping and shipping preparation are the sole responsibility of the purchaser.
Item Transportation: The auction contact must be notified via phone of any items that cannot be picked up on an auction pickup day. The auction company may not be able to accommodate alternate pickup dates and times. Alternate pickup times may be subject to additional fees to the buyer.
Server, Software and Other Technical Issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, the auction company reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor the auction company, nor the sellers SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by the auction company.
Disputes: Any dispute between the auction company, its Agents or Representatives and the Buyer(s) will be tried in a court of jurisdiction in the county in which the auction is being conducted (physical site of the items being sold). By bidding on the property, buyer agrees to all terms and conditions set forth.
Agency: The auction company, auctioneers and representatives are agents of the Seller. Buyer and or Bidder agrees to hold harmless and indemnify the auction company, and its auctioneers and its representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc.
Auction company employees and/or auction company may bid on and purchase auction items.
Bidder Default: It is illegal for the buyer to not complete a purchase and will result in prosecution by the sellers and/or the auction company, and loss of future bidding privileges for all other RM McGINNIS, LLC auctions.
If a bidder at any time feels his/her username, password or bidder number has been compromised due to lack of security by the bidder, notify Auctioneer immediately.
