*A working phone number MUST be provided. If we are unable to contact you via phone, text or email this could cause you to be declined from all future auctions.
*A $5 handling fee per shipping box is added for shipping of items.
*A $5 handling fee for bringing back items to the office per lot will be added for those customers with a 3 day pick up window.
IMMEDIATELY FOLLOWNG THE END OF THE AUCTION, CREDIT CARDS ON FILE WILL BE CHARGED AND RECEIPTS WILL EMAILED. IF YOUR CREDIT CARD IS DECLINED AN ADDITIONAL 3 % CHARGE WILL BE ASSESED TO PROCESS A CREDIT CARD A SECOND TIME.
Please ask all questions prior to the close of the auction. Look carefully at the photos and/or attend the preview as stated in the listing. All sales are final!
Payment:
Invoicing is done through Currency Pay at the close of the auction. Your card on file will be charged directly following the close of the auction. Visa, MasterCard, American Express & Discover are valid forms of payment. We also accept e checks, please contact Scott at 765-348-6538 to make those arrangements. DO NOT ASSUME you can just pay cash without making prior arrangements. This is grounds for permanent banishment! Payment is due 24 hours following the close auction.
Bring Backs:
In the event of an emergency, you are unable to attend the pickup, the auction company can provide transport for (small, manageable) items to be taken to our office in Farmland for a pick up within 72 hours. There will be a $5.00/ item fee added to your bill. Please note that this is in a per person basis and arrangements MUST be made in advance. Please call Scott at 765-348-6538 to make those arrangements.
Shipping:
After your initial payment for your purchase, your card on file will be charged for the cost of shipping plus a $5 per packaged box. We try and ship your items via USPS. Some items due to size or weight will need to be shipped via USPS. We have had too many issues with FedEx (lost packages, broken packages, etc) so we prefer not to use them.
Terms & Conditions:
The Sale of Items- Wagner Auctioneering and Real Estate has the right to terminate the auction at any reasonable time; withdrawal from sale any item; to sell at this auction items not listed; to group one of more lots into one or more selling lots or to subdivide into two lots or more selling lots. Wagner Auctioneering and Real Estate also reserves the right to sell all of the items listed in bulk.
No Liability- Wagner Auctioneering and Real Estate assumes no liability for your purchases (if you buy a lawnmower, bulldozer, or other such item, and you don't know how to use it and get injured, we are not liable). The buyer assumes and does agree to indemnify and hold the Auction Company and seller harmless from any future claim that shall pertain to the fitness or use of that asset being purchased.
Documents- All documents must be completed in full by buyers and sellers. For example: Death Certificates, Letters of Authority, Creditor Liens, and UCC's when purchasing vehicles, firearms, etc.
Loading Equipment- Wagner Auctioneering and Real Estate does not lend, lease, or borrow any equipment, nor deliver sold goods.
Consignors- All consignors must fill out a contract with Wagner Auctioneering and Real Estate, sign forms and abide by our terms listed.
Bidders- All bidders must register for bidder's numbers with proper ID. Payment- Purchases must be paid in full within 24 hours of conclusion of the auction. Payment may be made by Visa, MasterCard, American Express or Discover with no extra fees. Wire transfers will incur an extra fee. Buyer specifically waves the right to dispute or deny payment for any purchases made with credit card.
Removal- No goods will be removed until paid in full. Purchaser is responsible for removal of all purchased items. No abandonment of purchased items is allowed. Purchaser will be responsible to pay the full cost of removal or disposal of abandoned items. Wagner Auctioneering and Real Estate shall not, in any event, be liable for non-removal or abandonment or for any other matter to any purchaser of any lot.
Paid Receipt- Removal of purchased items shall be at the expense, liability, and risk of the purchaser. Purchases can be removed upon presentation of paid receipt to Auction staff. Purchased goods must be removed within the parameters listed in the auction description or sold for storage in our upcoming sale.
NSF Funds- A fee for Non-sufficient Funds (NSF) checks per occurrence will be charged. NO CREDIT ALLOWED
Reserve Prices- We are governed by the Indiana Statutes and all items sell with a reserve unless advertised. Wagner Auctioneering and Real Estate has the right to publish or disclose any minimum due to confidentiality. Vehicles sell with owner's confirmation.
Bidding- No consignor, seller, or agent for seller has that right to bid on their consigned goods.
Employee Bidding- Any employee of Wagner Auctioneering and Real Estate may bid at any auction if they so wish to purchase an item.
Compliance with The Terms of Sale- In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages.
Indiana Laws- Wagner Auctioneering and Real Estate is in complete accordance with Indiana statutes and Indiana Administrative codes, Title 25, Title 812, Department of Revenue Tax Bulletin #20, and Reference IC 6-2-4. Sold Items- All items become the sole responsibility of the purchaser when auctioneer confirms your number as successful bidder. Although the auction company will exhibit reasonable care to safeguard purchases until removed by purchaser, no refunds or adjustments will be allowed for any shortages. We are NOT responsible for stolen or lost goods.
Keeping Order- Auctioneers have the right to refuse service or eject any person obstructing the auction process. Appraisals are NO guarantee of auction prices; nor can we establish a value for sentimental reasons. The Auction Company, when acting as Agent, is not responsible for the act of its principals.
NO Warranties- Everything is sold "AS IS/WHERE IS" with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final.
Sales Tax- Sales tax will be charged and collected on all purchases, as required by appropriate state/local laws. Sales tax exemption number, where applicable, must be presented at the time of bidder registration. To qualify for any available exemption, buyer must sign any required form.
Dispute between Bidders- If there is any dispute between two or more bidders, the auction company or its' auctioneer, may decide the successful bidder. The decision of the auction company, or its' auctioneer, shall be final and absolute.
Condition of Items Sold- All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse.
Nominal bids- Any bid that is merely a nominal bid may be rejected by the Auction Company or the Auction Company may reject fractional advances, if in their judgment it may adversely affect the sale.
Absentee (proxy) Bids - Absentee bids may be presented to the auction company in writing and must be accompanied by credit/debit card number, which will be verified for you maximum bid amount and applicable Buyer's Premium prior to the sale. Buyer may deliver to auction company maximum bid in certified funds to be refunded in full, if Buyer does not gain the successful bid. Said bids are subject to all terms and conditions of sale as listed herein or announced at the auction sale. All absentee bids will be held in confidence.
Auction Company may have a principal interest in this sale. Seller may NOT bid on his/her own items at auction as per state laws.
Personal and Property Risk- Persons attending during exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the Auction Company from liability therefore. Neither the Auction Company nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held.
Records- The record of sale kept by the Auction Company, the audio tape of the auction and the bookkeeper records will be taken as final in the event of any dispute.

Due to Mr. Wright selling his home and moving to an assisted living facility we have been tasked with selling his items with living and working in the Yorktown area for many many years. Due to putting the home on the market, all items will need to be picked up day of pick-up. If they are not they will be forfieted and disposed of. 1 Small Cast Iron Stand Small ornate cast iron plant stand. Small glass insert in middle of top, measurements in photos. 2 Easter Bunnies & Basket Small resin type decor piece with three bunnies, comes with porcelain and ceramics baskets. All appears to be good. 3 Snow Globes Set of various snowglobes, all appear to be good. Music box in one or two. 4 Christmas Decor Small amount Christmas decor, glass snowman candle holder, and small resin house. 5 Candle Holder & Boxes Small green colored candle holder and small ceramic boxes, all appear to be good. 6 Brass Appearing Lamp Small table lamp, brass appearing, does work and good cord. Measurements in photos. 7 Angels Small grouping angles, various styles and pieces. Various materials as well, all look to be good. 8 Willow Tree Figurines Nice set of Willow Tree figurines, photos of all bottoms and titles, all appear to be in good condition. Very neat and in good condition. 16 Dresser w/ Mirror Large dresser with mirror, mid century modern design, good clean piece with small mirror. Very nice and clean stand, double doors, good hardware, mid century modern design, measurements in photos. 18 Albums, Look Magazine & More Two LP albums, a 1960's Look magazine and some other music periodicals that feature Kenny Rogers and more. All look to be in good condition. 19 Doilies Large grouping of doilies and other sewn pieces. Some placemats and table clothes come with group as well. All look to be in good condition and clean. 20 Brass Appearing Wall Hangings Brass looking wall hangings of leaves and ivy, all appear to be in good condition. 21 Bedding Large amount of bedding, several blankets and sheets, all are in good condition and very clean. Some sheets and pillow cases as well. 22 Queen Bed & Frame Wooden head and footboard queen bed, comes with frame as well. You can take mattress and box springs. Very clean and nice, no bedding included in this lot. 23 Palm Tree Wall Wall Hanging Very nice palm tree cutout wall hanging, good condition and framed. 24 Queen Sized Bed Spread & Bedding Very nice and well made queen size bedspread and bedding, comes with pillows and sheets. Palm tree type motif. 25 Print & Candle Holders Very nice paired set of candle holders with framed print, no signature on print but still very nice. 26 Glass Topped Brass Appearing Stand Very nice and small stature decor table with glass top. Is brass colored but not sure it truly is brass. Very nice and clean table. All human depictions. 40 Resin Figure Small boy laying and reading a book. Resin type pieces, good condition. 41 Candle Stick Holders Three tiered candle stick holders, palm tree looking pieces. Comes with glass globes and metal bottoms. All look to be good. Measurements in photos. 42 Touch Lamp Small table type touch lamp, glass shade. Very nice condition, does work as it should. 43 Angels Set of three angels, in good condition, resin type pieces, no markings. One standing and two are laying down. 44 Children Angels Set of two resin type children angels, both are in good condition. 45 Plastic Lighted Angel Large plastic lighted angle, good condition, no batteries for us to test but overall looks to be in good condition. 46 Resin Angels Set of two resin type angels, all look to be good, these are marked. 47 Angels Another set of angels, all look to be good, various styles and sizes, majority are marked. 48 Glass & Ceramic Angels Set of three angles, ceramic and glass, all appear to be good. 49 Ceramic Figurines Set of two ceramic figurines, both appear to be good and are marked. 50 Old Angels A set of older people depicted as angels. These are "retired" angels, and all look to be good and marked. 51 Votive Candle Holders Set of votive candle holders, all are clear glass and look to be good. Do come with candles. 52 Picture Frames Small group of picture frames, two are Snowbaby frames, all appear to be good and have glass. 53 Ceramic Lamp Small ceramic lamp with shade, 110v, good condition and major damage. 54 Potpourri Pots Two small potpourri pots, 110v, one does have lid. These have not been tested but should be in working order. 55 Candles Various candles, some have been burned but majority have not. A couple Yankee brand in group as well. Comes with two candle lights with shades as well. One electric candle warmed that you sit candle in, has not been tested. 56 Solid Wooden End Table w/ Marble Top Very nice and well built end table, good condition, comes with solid marble top, this can be removed. No major damage to piece, made by Hammary. Measurements in photos. 57 Fenton Pieces Three pieces of Fenton pieces, all appear to be good, comes with basket, bowl and lattice bowl, two are marked and third is not. All good condition. 58 Ceramic Baskets Set of ceramic baskets, all appear to be good. Two are Easter decorated and others are just floral motif. Two do look to be vintage but are marked Made in China. 59 Glass Basket Glass basket, does look like it could be vintage, clear and green colored. No markings and appears to be good. 60 Glass Basket Deep red or black colored basket, appears to be good, no markings. Really neat color to this one. 61 Pressed Glass Basket Pressed glass basket, good condition, no markings, red to yellow color, very nice piece. 62 Silk Flowers Small group of silk flowers and greenier, all appear to be good. 63 Seashell Hanger Vintage seashell hanger, various types of shells and colors, good condition, could be used as lamp shade as well. 64 Stereo Cabinet Glass fronted stereo cabinet, top magnet on door does stick but still a good piece, pressed wood type construction, measurements in photos. 65 Leather? Reclining Chair Very nice leather? reclining chairs, very good condition, looks to have little use, button type back. Hard to make out first letter of last name. Metal construction. 110 Wicker Type Child's Chair Wicker type child's chair, very good condition, no major damage to this. 111 Leather? Reclining Chair Burgundy colored leather? reclining chair, does have some wear but still a very nice chair, works as it should.
