All bidders and participants in this auction sale hereby agree that they have read and fully understand the following terms. By participating in this auction sale, bidders and participants further agree to be bound by the terms and conditions of auction contained herein.
Online only auction. Bidding will close on September 26th at 6:00pm CST ( soft close).
AUCTION LOCATION: Online Only
METHOD OF SALE: ONLINE.ONLY
SUBJECT TO PRIOR SALE: The seller reserves the right to sell the property prior to the auction. All pre-auction offers must be submitted to United Country � Hudson Properties.
BUYERS PREMIUM: The contract purchase price will include a Buyer�s Premium equal to 10% of the high bid amount.
DOWN PAYMENT: A 10% non-refundable down payment (per property), shall be due immediately following the auction by end of business 09/27/2024. The down payment may be made in the form of a direct wire transfer, cashier�s check, : Crocket County Abstract Co. located at 1108 Ave. E, Ozona TX 76943.
NOT SUBJECT TO FINANCING: The real estate purchase agreement is NOT subject to the Bidders ability to obtain financing, so all Bidders must have any needed financing arranged prior to bidding at the auction. Down Payment deposits are �non-refundable� in the event a Bidder cannot complete closing.
ACCEPTANCE OF BID PRICES: All successful bidders will be required to enter into Purchase Agreements immediately following the close of the auction. All final bid prices are subject to the Sellers acceptance or rejection. (Sells with reserve)
EVIDENCE OF TITLE: A current Owners Title Policy will be provided by the seller at seller�s discretion.
DEED: Title shall transfer by Warranty Deed
CLOSING: The balance of the real estate purchase price is due at closing, which will take place on or before October 28th, 2024. Closing will be held at. Crocket County Abstract Co. located at 1108 Ave. E, Ozona TX 76943. Closing and Recording fees to be paid by the buyer.
POSSESSION: Possession stated herein is subject to successful closing and transfer of title.
REAL ESTATE TAXES: All real estate taxes will be prorated to day of closing
PROPERTY INSPECTION: Auctioneer strongly recommends that any prospective Bidder personally inspect the Property prior to the Auction. Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries, and due diligence concerning the property. Inspection dates have been scheduled and will be staffed with auction personnel. Further, Seller disclaims any and all responsibility for Bidders safety during any physical inspection of the property. No party shall be deemed an invitee of the property by virtue of the offering of the property for sale.

ACREAGE: All acreage, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos and mapping program.
SURVEY: Buyer will be responsible for any survey requirements.
AGENCY: United Country--Hudson Properties, United Country � Garrett Really & Auctions and its representatives are exclusive agents of the Seller.
WATER SHARING AGREEMENT: In the event that the property does not sell as a whole all parties will be required to enter into a shared well agreement. ( tracts sold separatley from the water station will have access to the water well per this agreement. ) See shared well agreement .
WATER WELL INFO: The well has been drilled, cased and a storage tank set. Asubmersible pump is needed for the well to be operable. Choosing and installing the pump will be the buyers responsibility. Sellers/Brokers make no representation of the water quality or well volume. Water well test available upon request. 30 GPM, 640' depth, 500bbls storage tank, and power has been recently upgraded to service the well.
LOT 1 ACCESS: A 30 foot easement will be granted down the existing caliche road to LOT 1 ( 161 acre tract ) across LOT 2 ( 119 acre tract.) to be described by new survey
Exclusions: There are two piles of crushed rock near the water station that will not convey with the land. Seller will have these moved off prior to closing.

The SELLER and/or Auction Company reserves the right to (pause) the online auction bidding in the event of any internal or external technology failure, to preserve the integrity of the auction event and maintain a fair and impartial bidding environment.
