Real Estate Auction Terms and Conditions:
Bidders on real estate must be registered with name, address, valid phone #, driver license #.
Sale is Subject to Sellers' Confirmation: The final bid price may be accepted or rejected by Seller within up to 48 hrs.
Warranties & Contingencies: The property is being sold "as is" with no warranties from the seller or auctioneer. The sale will not be contingent on repairs. Seller does not intend to make any repairs. If you bid, you are agreeing that you have inspected the real estate and improvements and are satisfied with its condition at the price you bid.
Financing: Sale will not be contingent on financing. If you require financing, it must be arranged before bidding.
Buyer Premium: A 10% buyer premium will be added to the final bid price to determine the contract price.
Purchase Agreement: At the conclusion of the auction, the successful bidder will sign a purchase agreement at the contract price. When accepted and signed by the seller, this agreement becomes the purchase contract.
Down Payment: Upon signing the purchase agreement, Bidder will submit to the auction company a $2,000.00 down payment as earnest money to be deposited upon seller's acceptance of bid price and held in escrow until closing. If bid price is rejected, the earnest money will be returned to the bidder.
Acceptable Payment: Cash, cashiers check, or direct deposit, company or personal check.
Closing: The balance of the purchase price will be required in approximately 30 - 45 days at closing. If you cannot close you will forfeit your earnest money.
Title: At closing, Seller will provide an owners title insurance policy and a general warranty deed free of all liens and encumbrances but subject to any easements of record.
Property taxes will be prorated as of the date of closing.
Closing costs: Seller pays 1/2 closing fee and 1/2 of Revenue Stamps, Owner's Policy of Title Insurance, deed preparation. Buyer pays, 1/2 closing fee, 1/2 of Revenue Stamps, recording cost and any other expenses incurred by Buyer, including, but not limited to, Loan Policy of Title Insurance, hazard insurance premiums, survey, fees of Buyer's attorney and any other fees associated with Buyer's loan.
