We know you are anxious to begin bidding, however it is critical that you fully understand and agree to the following terms and conditions of this online only auction. By participating in this auction, you agree to the following terms and conditions. Braun and Helmer Auction Service and the seller do not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. All vehicles & equipment are being sold as running unless otherwise stated in the listing. Braun and Helmer Auction Service has attempted to provide accurate descriptions of all items, however, it is your exclusive responsibility as a bidder to determine the condition and suitability of each lot. Printed statements, descriptions and counts by Braun and Helmer Auction Service staff are provided in good faith and are matters of opinion. Vehicles are in running order unless noted in the description. The pictures and descriptions provide information on the condition. It is not the policy of Braun and Helmer to hide any issues or problems with the vehicles. If most cases we can provide additional pictures or information up to 24 hours prior to auction day. We recommend that you bid early and become familiar with the software. Not everyone has high speed internet and it make take longer for you to place your bids. Something to consider is that at the end of the auction, there may be as many as 40 people bidding the same amount at virtually the same time. Because of this we do not guarantee that your bids will be executed to your satisfaction. Braun and Helmer reserves the right to reject any bids. The bidding increments for this auction will be $250.00 for Vehicles and will vary on equipment based on value. Buyer's Premium: A buyers' premium of 4% of the high bid will be added to the high bid to determine the final selling price for the auction lot. The Michigan State sales tax (6%) will be paid at the Secretary of State. Payment: Braun and Helmer Auction Service accepts the following forms of payment: Cash, Cashier�s Check, Personal or Company Checks. (Checks made to Braun and Helmer Auction Service.) No checks outside of the state of Michigan are accepted (unless approved). 1st time bidders who plan on spending more than $20,000 must be approved. (Call David @ 734.368.1733) If you are paying by cash or certified check you will be given the title at pick up. If you pay by check we will mail the title by certified mail after 10 days. Additionally we will be glad to arrange face to face pick up after the 10 days. Merchandise becomes the full responsibility of the buyer at time of payment and the buyer assumes all risk of loss and damage to property at that time. Braun and Helmer Auction Service reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the Buyer will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property. Inspection Dates & Time: Vehicles: Wednesday August 14th from 10am to noon Located at: 3001 South State Street, Ann Arbor, MI Equipment inspection will immediately follow at 2550 Draper Dr., Ann Arbor, MI 48105 from 12:30-1:30 PM AUCTION BEGINS: 9 AM Thursday August 15th, 2024 AUCTION ENDS: 7 PM Thursday August 24th, 2024 MERCHANDISE PICK UP: Vehicles: Friday-Saturday August 23th & 24th from 9 AM-2 PM. Pickup location: 3001 South State Street, Ann Arbor, MI (Yellow Parking lot @ Wolverine Tower behind Wendy's and Buffalo Wild Wings) Equipment: Friday-Monday August 23th & 26th from 9 AM-2 PM. Pickup location: 2550 Draper Dr., Ann Arbor, MI 48105 (Drive down the long winding driveway to the back of the lot- follow B&H signs) Pickup: All items, must be picked up on the published move out date(s). Buyers are responsible for rigging, loading, and moving all items purchased without assistance from Braun and Helmer Auction Service. The University of Michigan will have a piece of equipment on site to help load some of the bigger items however they are not responsible for any damages that occur when loading. **Very important: With exception of previous arrangements with Braun and Helmer Auction Service, you MUST pick up your items on the specified date(s). If your items are not picked up within 10 days Braun and Helmer Auction Service reserves the right to forfeit your items. Auction Ending: Beginning at the stated closing time, the auction software will conclude bidding for one lot each thirty seconds in catalog order with the following exception: if a bid is placed in the last 60 seconds of that lot closing, the bidding for that individual lot will remain open for an additional minute. Some lots may be grouped together so that a bid on one lot will extend the time on all lots in that group. Debt Collection and Interest Charges: The buyer agrees to pay all reasonable attorney fees and other costs incurred by Braun and Helmer Auction Service in its efforts to collect unpaid funds from the buyer. The buyer agrees that a fee of 10% of the outstanding balance per month be added to any unpaid balance due Braun and Helmer Auction Service. Any debt collection or dispute proceedings will be heard in Ann Arbor, Michigan. Limitation of Liability: If, for any reason, Braun and Helmer Auction Service is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of Braun and Helmer Auction Service, if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser. Non Paying: In addition to the above, understand that we are working for our seller. We have zero tolerance for non-paying bidders and we will proceed aggressively to rectify such situations. Age Requirement All bidders must be 18 years of age or older. Bidder Information and Security: All registration information the bidder provides to Braun and Helmer Auction Service shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify Braun and Helmer Auction Service if they believe that their bidder number and password have been compromised. Thank you for your interest and participation. The University of Michigan Online Only Auction will take place online starting on Thursday, August 15th at 9 AM and will run through Thursday, August 22nd at 7PM. The vehicles and equipment are located at 2 separate locations. There will be a live in person preview for the vehicles on Wednesday, August 14th from 10AM-Noon Located At 3001 South State Street, Ann Arbor MI and a live in person preview for the equipment immediately following at 2550 Draper Drive, Ann Arbor MI from 12:30- 1:30PM. Pickup times for the Vehicles will be Friday and Saturday August 25th & 26th from 9 AM - 2 PM. Pickup times for the Equipment will be Friday and Monday August 25th & 27th from 9 AM - 2 PM
