You must be registered to bid in the auction. We recommend you do this at least one day before the auction. You will have to enter credit card information into the HiBid platform in order to bid. This is for identification purposes ONLY. Purchases will not be charged to this credit card under any circumstances. 2. The only forms of payment we accept are Zelle, cash, wire transfer and cashier's checks. 3. There is a 20% buyers premium applied to all final bid amounts. 4. There is a 7% sales tax due unless you are exempt. 5. Payment for all lots is due by: Tuesday 8/13 at 5PM 6. Any bidder who does not pay their invoice in full by this date will be subject to: A. Forfeiture of lots. B. Collection efforts for monies owed including bid price, buyer's premium and collection costs to include attorney's fees. C. A lawsuit to seek specific performance of bid . D. Any additional actions permitted by Florida law. 7. All persons attending the auction or removing goods assume all risk of damage or loss to persons or property. The auctioneer, seller, landlord, trustee and or agent shall be released from all liability. 8. All bidders are highly encouraged to attend inspection. 9. The auctioneer and its agents provide descriptions, information and photographs only as guidelines with no guarantee as to accuracy. 10. ALL PROPERTY IS SOLD AS IS WHERE IS. This means we make no guarantee as to the condition or authenticity of any items in this auction. ALL SALES ARE FINAL. Once an item has been sold, please do not ask us to remove it from your bill. This denies others the opportunity to buy an item they may have been interested in. 11. Removal dates are: 8/13, 8/14 and 8/15 ABSOLUTELY NO EXCEPTIONS 10AM to 4PM. All lots must be picked up by this deadline. All lots not picked up by this deadline will be subject forfeiture of the lot without compensation of any kind. Neither auctioneer or seller are obligated to provide loading of your items. Be sure to bring sufficient personnel, boxes etc. 12. Shipping There is NO shipping for this auction. If you need items shipped, you will need to arrange the shipping. Regardless, all items must be picked up by 4PM on 8/15. 13. The auctioneer reserves the right to group, break or withdraw lots at its discretion. The auctioneer has discretion over any disputed lots and reserves the right to reopen bidding on any such lots. 14. Any person who bids in bad faith or attempts to disrupt the auction will be restricted from bidding and banned from future auctions at the auctioneer's sole discretion. Auction bids are binding contracts in the State of Florida and we will take all necessary steps to protect our seller's interests. See section 6. 15. The auctioneer has sole discretion to reject fractional bids. 16. Lots may sell bid times the piece. Please be aware of what you are bidding on. 17. Bidders must take entire lot won. Any corrections for overages or shortages must be made before leaving the pickup premises. NO CLAIMS OF SHORTAGES WILL BE RECOGNIZED AFTER YOU LEAVE. 18. Any past due amounts owed to the auctioneer will accrue late charges at the maximum rate allowed under Florida law. Bidder agrees to reimburse auctioneer and/or the seller for any attorney's fees, costs, collection fees that may be incurred in order to collect past due amounts. 19. Venue for any disputes arising from this agreement shall be Broward County, Florida. 20. Any announcements made by the auctioneer will take precedence over any previously made verbal statements, ads, or publications of any type. 21. No items can leave the auction site without payment in full for all lots purchased. 22. We reserve the right to ban any individual, company, or any type of legal entity from bidding in this auction at our sole discretion. 23. By registering for this auction, you consent to receiving updates via email, text, or telephone call. We do not sell your contact information to any third parties. 24. Auctioneer may its discretion accept and make proxy, absentee or telephone bids for the benefit of the seller. However, auctioneer accepts no responsibility if such bids are not made. 25. Some of the items in this auction are past expiration date. We have tried to photograph as many labels as possible to show dates. Please come to inspection prior to the auction if you are bidding on date sensitive items. There will be absolutely no refunds after the auction including for past date items.
