Welcome to Cheyenne Auctioneers, LLC , collectively known as "Auctioneer�. We invite you to participate in our online auctions. Participation implies acceptance of these terms and conditions. If you disagree with these terms or do not understand them, please refrain from participating. Announcements made on auction day supersede prior information. All bids form a binding contract, obligating bidders to comply with sale terms and conditions. Cheyenne Auctioneers LLC wants to provide an exceptional bidding experience to all of its buyers. This is why we strongly encourage that you inspect or hire a third party to inspect items before you place your bids. All property is sold as-is, where-is without any warranty or guarantee, expressed or implied, like almost all auctions. As the highest bidder, you are the buyer and are bound by these terms and conditions. CREDIT CARD AUTHORIZATION: Bidders must provide a valid MasterCard, Visa, or American Express along with the required authorization. A deposit authorization will be processed (not charged) on the card. By registering, bidders authorize Cheyenne Auctioneers to charge the card on file. Bidders with Tax Exempt Status Please Deliver Exemption Papers Prior to the Auction. PAYMENT TERMS: We accept cash, credit (Up To 2000) and wire transfers for payment. Wire Transfer Information will be emailed to winning bidder's email on file with HiBid following the auction. Please note that all payments must be made in US Dollars. The total amount due must be paid within 72 hours following the end of the auction. Should payments not be received within this timeframe, the Auctioneer retains the right to re-offer the items for auction. It�s important to review all invoices on the day of the sale, as we won�t be making any changes to them afterwards. Items not collected after the auction may be treated as abandoned. If the winning bidder fails to complete the transaction for any reason within the 72 hours following the auction, they must pay a $250 Default Fee. In Addition, buyers will be charged a Late Fee of $25 Per Day on all items purchased that have not been paid in full within Five business days after conclusion of a Purchase Contract. Buyer shall be liable for all storage charges for any item(s) not removed within 7 days of sale and be assessed by auctioneer at a daily rate of $45.00 Per Day. Item must be picked up within 7 Business Days of the auction, or the buyer will incur storage charges. A TRANSFERABLE TITLE will be sent to the buyer by express mail or similar service within 20 business days of the auction. Buyer is responsible for vehicle registration. We do not guarantee current registration or that this item will meet local emission requirements. Titles/titling docs may be delayed due to extended processing times at DMV. AUTOMOBILES & HEAVY EQUIPMENT Terms & Conditions - DO NOT BID UNLESS YOU INTEND TO PAY FOR THE ITEM - TERMS: ALL SALES ARE FINAL. ALL ITEMS ARE SOLD "AS IS-WHERE IS" WITH ALL FAULTS AND WITH NO GUARANTEES OR WARRANTIES OF ANY TYPE, EXPRESS OR IMPLIED, INCLUDING WARRANTIES AS TO THE MERCHANTABILITY OR FITNESS FOR PARTICULAR USE OR PURPOSE. FURTHER. Any description or information given on a lot is not guaranteed, warranted, or assumed by Auctioneer, and Buyer must rely solely on his/her own inspection. Property is open to a thorough public inspection and bidders from off-site understand and acknowledge that he/she may not be able to inspect as well as if present, in person. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factors. PAYMENT, Buyer is to pay in full within (3) days of auction's end. If Buyer fails to pay in full when due, Buyer shall further be liable to the Auctioneer all sums unpaid as well as Auctioneer's collection costs, including but not limited to attorney fees and court costs, incurred in connection with Buyers non-payment. Buyer must pay for any item over $2000 by Wire Transfer (+ $30 Processing Fee) or Cash. No personal checks will be accepted. ALL ITEMS UNDER $2000 MAY BE PAID BY CREDIT CARD AND WILL INCLUDE A 3% Processing Fee Charge. The Delivery of Certificate of Title will be initiated upon full payment. REMOVAL: If paid by Wire Transfer or Credit Card, Removal of the purchase will not occur until the funds are confirmed, VERIFIED PAID! All Purchases Must be removed within 7 Days of the auction close. All costs, loading responsibility and risk of removal shall be borne by buyer. Please know the trailer size and weight requirements when picking up and loading heavy equipment, If Buyer wishes to have the purchases shipped, all shipping coordination/logistics and costs of same Must be pre-arranged and carried-out by the Buyer. If for any reason Buyer fails to remove any purchases within the time specified, the Auctioneer shall have the right but not the obligation, to resell, discard or remove said purchase at the Buyer's sole risk and expense, without waiving any rights that Auctioneer or Consigner/Seller may have against the Buyer. Buyer shall be liable for all storage charges for any item(s) not removed within 7 days of sale and be assessed by auctioneer at a daily rate of $45.00 Per Day. Buyer is solely responsible for Loading & Transportation of any equipment won, Do not expect Consigner/Seller or Auctioneer to load equipment for you. If Buyer fails to complete the purchase of any item pursuant to these terms and conditions, any money deposited in part payment shall be first applied against Auctioneer's damages, including storage charges. In The event of resale, Buyer shall be held responsible for any deficit between the successful bid and the price for wich the item was resold and charges arising from such resale and is not entitled to any portion of any amount received by resale. Buyer agrees to reimburse Auctioneer for any and all costs incurred, including its reasonable attorneys fees, expert fees, and court costs, which result from or are incurred due to Buyer's breach or attempted breach of these terms and Conditions. In Addition, Buyer agrees to indemnify and hold Auctioneer & Consigner/Seller harmless from all loss, cost, expense and other damage (including reasonable attorney's fees and costs), directly or indirectly sustained by the auctioneer or Consigner/Seller, arising from or related to Buyer's failure to comply with these terms. BY BIDDING, BIDDER AGREES TO ABIDE BY ALL THESE TERMS. ACCEPTANCE OF TERMS: By registering to participate in a Cheyenne Auctioneers, LLC auction thru any bidding service offered by us (whether present in person, by agent, by telephone or absentee bid, or through a live internet connection), you fully understand and expressly agree to the following terms and conditions, along with the agreement to be so bound. If a purchaser breach any of these Terms of Sale, including the obligation to pay for purchased items, Cheyenne Auctioneers, LLC may seek all remedies under the law including canceling the sale and reoffering the property without reserve. The rights and obligations of the parties shall be governed by the laws of the state of Wyoming: Any bidder who registers thru one of our bidding platforms, (online, in house, absentee) must register their name, mailing address, and telephone number prior to the auction. Unless known to Cheyenne Auctioneers, LLC, all registrants are required to present two forms of identification, one of which must include a current photograph. Bidders may be required to present a valid Discover, Visa or MasterCard. 1. All items are sold AS IS, WHERE IS with all faults. There are no warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. All items are available for your examination prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials, or any other feature of items being sold. Bidding on these items is acceptance of these terms. Lots are available for inspection prior to any sale and is for your convenience to satisfy yourself as to each and every aspect of a lot. You are strongly advised to examine in person any lot on which you may bid or have it examined on your behalf before any Sale at one of our auction previews. If there is any uncertainty to any lot, we recommend you do not bid on the item in question. There are no refunds. 2. As used in these conditions of sale, the term "final bid" means the highest bid acknowledged by the auctioneer and the term "purchase price" means the sum of the final bid plus the premium payable by the buyer and sales tax if applicable. 3. The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer has the right to cancel any bid, to advance the bidding at his absolute discretion and in the event of any dispute between bidders to determine the successful bidder, to continue the bidding or to re-offer and resell the lot in dispute. In the event of any dispute after the sale, Cheyenne Auctioneers, LLC records of final sale will be conclusive. Internet bidders should be aware that auction floor bids (if Applicable) taken by the Auctioneer always supersede bids taken online, therefore it is often necessary for Internet bidders to bid again to have the contending bid on any particular item. 4. Cheyenne Auctioneers, LLC reserves the right to withdraw any lot before the sale. The record of sale kept by the auction house will be taken as final in the event of dispute. 5. DISPUTE BETWEEN BIDDERS: If any dispute arises between two or more bidders, bidding online or in house, the auctioneer may decide the same or may immediately put the lot up for sale again and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. The purchaser assumes complete responsibility for items at the fall of the hammer. 6. Some lots may carry reserves or minimum selling prices. This is a figure set by the consignor and the auction house below which a lot will not be sold. Our auction house will execute the reserve bids. The reserve will not exceed the low estimate. Estimates are subject to change at any time prior to the offering of each lot. 7. We are pleased to offer online, absentee and phone bidding for prospective bidders who cannot be present at the auction. An absentee bid form must be completed and faxed or emailed to our gallery. Absentee bids will be executed competitively and confidentially. All bids are held in the strictest confidence and must be received 24 hours prior to the auction. Leaving an absentee or phone bid on a lot indicates your willingness to open the bidding at one half the printed low estimate and gives the auctioneer the authority to open the bidding at that level. Cheyenne Auctioneers, LLC shall have the right to withdraw any item at any time for any reason and to default any sale in the event of an error or dispute. In the case of identical absentee bids, the bid received first will prevail. Bidders are encouraged to submit absentee bids at least 24 hours prior to the auction. We reserve the right to pre-authorize credit card deposits. In bidding online, you acknowledge and agree that each bid submitted is irrevocable and cannot be amended or corrected, even if submitted in error and notified to us. You accept full liability for all bids submitted. Cheyenne Auctioneers, LLC will not be held responsible for any errors or failures, whether human or technology related, to accurately execute bids. WE ACCEPT NO LIABILITY FOR ANY FAILURE OR DELAY IN EXECUTING BIDS OR ANY ERRORS ASSOCIATED IN BIDS PLACED VIA AN ONLINE BIDDING PLATFORM SERVICE. 8. BIDDER'S INFORMATION - We sell 80 -100 lots per hour. A buyer�s premium will be applied to the purchase price of all auction items sold of 10%. All items are sold AS IS, WHERE IS, WITH ALL FAULTS and ALL SALES ARE FINAL. 9. Title of the offered lot shall pass to the buyer upon the fall of the auctioneer's hammer and announcement by the auctioneer that the lot has been sold. The buyer shall forthwith assume full risk and responsibility for the lot and shall pay the full purchase price. Cheyenne Auctioneers LLC Reserves the Right for family or friends to place bids in our online auctions and each will be held responsible to the same terms and buyer�s premiums. 10. No lot shall be removed from Cheyenne Auctioneers, LLC possession until the buyer has paid in full the purchase price thereof. In addition to other remedies available by law. PAYMENT TERMS: During Registration all bidders agree that Certain Invoices will be automatically charged within 24 Hours to the credit or debit card bidders put file. When registering for our auctions all bidders agree to allow Cheyenne Auctioneers LLC permission to proceed in a one-time charge for the total amount of won auction items. ALL ACCOUNTS MUST BE SETTLED WITHIN 3 DAYS OF THE AUCTION DATE! All payments must be made in US Funds. Payment shall be in Cash, Visa, MasterCard, Discover, bank wire transfer (a fee will be charged for wire transfers or other transactions which will be the responsibility of the buyer). We reserve the right to not issue a buyers number or to withhold merchandise if appropriate credit has not been established. We reserve the right to require bank checks for large purchases. Invoice(s) totals greater than $2,000.00 must be paid by Wire Transfers (fees may apply). Acceptance of these terms through any bidding platform constitutes permission to charge successful bids to credit cards if payment is not received within 3 days of the auction. A Wyoming State Sales Tax of 6.00% or Equivalent County Tax will be added to all final purchases. International buyers are responsible for tariffs, taxes or assessments of shipped items to the buyer�s country. ON-LINE BIDDERS: ITEMS WILL NOT BE ALLOWED TO BE PICKED UP UNTIL AN INVOICE IS RECEIVED AND PAYED FOR VIA EMAIL OR IN PERSON. International Buyers are solely responsible for shipping arrangements. Due to issues with Tracking packages overseas International Buyer will need to contact and arrange for shipping. WON ITEMS MUST BE REMOVED FROM OUR AUCTION HOSE WITHIN 7 Business DAYS OF THE END OF THE AUCTION. Items are stored at the risk of the Purchaser. A 24 hour notice is required for any items that are to be picked during pickup hours. Welcome to Cheyenne Auctioneers, LLC , collectively known as "Auctioneer�. We invite you to participate in our online auctions. Participation implies acceptance of these terms and conditions. If you disagree with these terms or do not understand them, please refrain from participating. Announcements made on auction day supersede prior information. All bids form a binding contract, obligating bidders to comply with sale terms and conditions. Cheyenne Auctioneers LLC wants to provide an exceptional bidding experience to all of its buyers. This is why we strongly encourage that you inspect or hire a third party to inspect items before you place your bids. All property is sold as-is, where-is without any warranty or guarantee, expressed or implied, like almost all auctions. As the highest bidder, you are the buyer and are bound by these terms and conditions. CREDIT CARD AUTHORIZATION: Bidders must provide a valid MasterCard, Visa, or American Express along with the required authorization. A deposit authorization will be processed (not charged) on the card. By registering, bidders authorize Cheyenne Auctioneers to charge the card on file. Bidders with Tax Exempt Status Please Deliver Exemption Papers Prior to the Auction. PAYMENT TERMS: We accept cash, credit (Up To 2000) and wire transfers for payment. Wire Transfer Information will be emailed to winning bidder's email on file with HiBid following the auction. Please note that all payments must be made in US Dollars. The total amount due must be paid within 72 hours following the end of the auction. Should payments not be received within this timeframe, the Auctioneer retains the right to re-offer the items for auction. It�s important to review all invoices on the day of the sale, as we won�t be making any changes to them afterwards. Items not collected after the auction may be treated as abandoned. If the winning bidder fails to complete the transaction for any reason within the 72 hours following the auction, they must pay a $250 Default Fee. In Addition, buyers will be charged a Late Fee of $25 Per Day on all items purchased that have not been paid in full within Five business days after conclusion of a Purchase Contract. Buyer shall be liable for all storage charges for any item(s) not removed within 7 days of sale and be assessed by auctioneer at a daily rate of $45.00 Per Day. Item must be picked up within 7 Business Days of the auction, or the buyer will incur storage charges. A TRANSFERABLE TITLE will be sent to the buyer by express mail or similar service within 20 business days of the auction. Buyer is responsible for vehicle registration. We do not guarantee current registration or that this item will meet local emission requirements. Titles/titling docs may be delayed due to extended processing times at DMV. AUTOMOBILES & HEAVY EQUIPMENT Terms & Conditions - DO NOT BID UNLESS YOU INTEND TO PAY FOR THE ITEM - TERMS: ALL SALES ARE FINAL. ALL ITEMS ARE SOLD "AS IS-WHERE IS" WITH ALL FAULTS AND WITH NO GUARANTEES OR WARRANTIES OF ANY TYPE, EXPRESS OR IMPLIED, INCLUDING WARRANTIES AS TO THE MERCHANTABILITY OR FITNESS FOR PARTICULAR USE OR PURPOSE. FURTHER. Any description or information given on a lot is not guaranteed, warranted, or assumed by Auctioneer, and Buyer must rely solely on his/her own inspection. Property is open to a thorough public inspection and bidders from off-site understand and acknowledge that he/she may not be able to inspect as well as if present, in person. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factors. PAYMENT, Buyer is to pay in full within (3) days of auction's end. If Buyer fails to pay in full when due, Buyer shall further be liable to the Auctioneer all sums unpaid as well as Auctioneer's collection costs, including but not limited to attorney fees and court costs, incurred in connection with Buyers non-payment. Buyer must pay for any item over $2000 by Wire Transfer (+ $30 Processing Fee) or Cash. No personal checks will be accepted. ALL ITEMS UNDER $2000 MAY BE PAID BY CREDIT CARD AND WILL INCLUDE A 3% Processing Fee Charge. The Delivery of Certificate of Title will be initiated upon full payment. REMOVAL: If paid by Wire Transfer or Credit Card, Removal of the purchase will not occur until the funds are confirmed, VERIFIED PAID! All Purchases Must be removed within 7 Days of the auction close. All costs, loading responsibility and risk of removal shall be borne by buyer. Please know the trailer size and weight requirements when picking up and loading heavy equipment, If Buyer wishes to have the purchases shipped, all shipping coordination/logistics and costs of same Must be pre-arranged and carried-out by the Buyer. If for any reason Buyer fails to remove any purchases within the time specified, the Auctioneer shall have the right but not the obligation, to resell, discard or remove said purchase at the Buyer's sole risk and expense, without waiving any rights that Auctioneer or Consigner/Seller may have against the Buyer. Buyer shall be liable for all storage charges for any item(s) not removed within 7 days of sale and be assessed by auctioneer at a daily rate of $45.00 Per Day. Buyer is solely responsible for Loading & Transportation of any equipment won, Do not expect Consigner/Seller or Auctioneer to load equipment for you. If Buyer fails to complete the purchase of any item pursuant to these terms and conditions, any money deposited in part payment shall be first applied against Auctioneer's damages, including storage charges. In The event of resale, Buyer shall be held responsible for any deficit between the successful bid and the price for wich the item was resold and charges arising from such resale and is not entitled to any portion of any amount received by resale. Buyer agrees to reimburse Auctioneer for any and all costs incurred, including its reasonable attorneys fees, expert fees, and court costs, which result from or are incurred due to Buyer's breach or attempted breach of these terms and Conditions. In Addition, Buyer agrees to indemnify and hold Auctioneer & Consigner/Seller harmless from all loss, cost, expense and other damage (including reasonable attorney's fees and costs), directly or indirectly sustained by the auctioneer or Consigner/Seller, arising from or related to Buyer's failure to comply with these terms. BY BIDDING, BIDDER AGREES TO ABIDE BY ALL THESE TERMS. ACCEPTANCE OF TERMS: By registering to participate in a Cheyenne Auctioneers, LLC auction thru any bidding service offered by us (whether present in person, by agent, by telephone or absentee bid, or through a live internet connection), you fully understand and expressly agree to the following terms and conditions, along with the agreement to be so bound. If a purchaser breach any of these Terms of Sale, including the obligation to pay for purchased items, Cheyenne Auctioneers, LLC may seek all remedies under the law including canceling the sale and reoffering the property without reserve. Cheyenne Auctioneers, LLC reserves the right to withdraw any lot before the sale. The record of sale kept by the auction house will be taken as final in the event of dispute. 5. DISPUTE BETWEEN BIDDERS: If any dispute arises between two or more bidders, bidding online or in house, the auctioneer may decide the same or may immediately put the lot up for sale again and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. The purchaser assumes complete responsibility for items at the fall of the hammer. 6. Some lots may carry reserves or minimum selling prices. This is a figure set by the consignor and the auction house below which a lot will not be sold. Our auction house will execute the reserve bids. The reserve will not exceed the low estimate. Estimates are subject to change at any time prior to the offering of each lot. 7. We are pleased to offer online, absentee and phone bidding for prospective bidders who cannot be present at the auction. An absentee bid form must be completed and faxed or emailed to our gallery. Absentee bids will be executed competitively and confidentially. All bids are held in the strictest confidence and must be received 24 hours prior to the auction. Leaving an absentee or phone bid on a lot indicates your willingness to open the bidding at one half the printed low estimate and gives the auctioneer the authority to open the bidding at that level. Cheyenne Auctioneers, LLC shall have the right to withdraw any item at any time for any reason and to default any sale in the event of an error or dispute. In the case of identical absentee bids, the bid received first will prevail. Bidders are encouraged to submit absentee bids at least 24 hours prior to the auction. We reserve the right to pre-authorize credit card deposits. In bidding online, you acknowledge and agree that each bid submitted is irrevocable and cannot be amended or corrected, even if submitted in error and notified to us. You accept full liability for all bids submitted. Cheyenne Auctioneers, LLC will not be held responsible for any errors or failures, whether human or technology related, to accurately execute bids. WE ACCEPT NO LIABILITY FOR ANY FAILURE OR DELAY IN EXECUTING BIDS OR ANY ERRORS ASSOCIATED IN BIDS PLACED VIA AN ONLINE BIDDING PLATFORM SERVICE. 8. BIDDER'S INFORMATION - We sell 80 -100 lots per hour. A buyer�s premium will be applied to the purchase price of all auction items sold of 10%. All items are sold AS IS, WHERE IS, WITH ALL FAULTS and ALL SALES ARE FINAL. 9. Title of the offered lot shall pass to the buyer upon the fall of the auctioneer's hammer and announcement by the auctioneer that the lot has been sold. The buyer shall forthwith assume full risk and responsibility for the lot and shall pay the full purchase price. Cheyenne Auctioneers LLC Reserves the Right for family or friends to place bids in our online auctions and each will be held responsible to the same terms and buyer�s premiums. 10. No lot shall be removed from Cheyenne Auctioneers, LLC possession until the buyer has paid in full the purchase price thereof. In addition to other remedies available by law. PAYMENT TERMS: During Registration all bidders agree that Certain Invoices will be automatically charged within 24 Hours to the credit or debit card bidders put file. When registering for our auctions all bidders agree to allow Cheyenne Auctioneers LLC permission to proceed in a one-time charge for the total amount of won auction items. ALL ACCOUNTS MUST BE SETTLED WITHIN 3 DAYS OF THE AUCTION DATE! All payments must be made in US Funds. Payment shall be in Cash, Visa, MasterCard, Discover, bank wire transfer (a fee will be charged for wire transfers or other transactions which will be the responsibility of the buyer). Welcome to Cheyenne Auctioneers, LLC , collectively known as "Auctioneer�. We invite you to participate in our online auctions. Participation implies acceptance of these terms and conditions. If you disagree with these terms or do not understand them, please refrain from participating. Announcements made on auction day supersede prior information. All bids form a binding contract, obligating bidders to comply with sale terms and conditions. Cheyenne Auctioneers LLC wants to provide an exceptional bidding experience to all of its buyers. This is why we strongly encourage that you inspect or hire a third party to inspect items before you place your bids. All property is sold as-is, where-is without any warranty or guarantee, expressed or implied, like almost all auctions. As the highest bidder, you are the buyer and are bound by these terms and conditions. CREDIT CARD AUTHORIZATION: Bidders must provide a valid MasterCard, Visa, or American Express along with the required authorization. A deposit authorization will be processed (not charged) on the card. By registering, bidders authorize Cheyenne Auctioneers to charge the card on file. Bidders with Tax Exempt Status Please Deliver Exemption Papers Prior to the Auction. PAYMENT TERMS: We accept cash, credit (Up To 2000) and wire transfers for payment. Wire Transfer Information will be emailed to winning bidder's email on file with HiBid following the auction. Please note that all payments must be made in US Dollars. The total amount due must be paid within 72 hours following the end of the auction. Should payments not be received within this timeframe, the Auctioneer retains the right to re-offer the items for auction. It�s important to review all invoices on the day of the sale, as we won�t be making any changes to them afterwards. Items not collected after the auction may be treated as abandoned. If the winning bidder fails to complete the transaction for any reason within the 72 hours following the auction, they must pay a $250 Default Fee. In Addition, buyers will be charged a Late Fee of $25 Per Day on all items purchased that have not been paid in full within Five business days after conclusion of a Purchase Contract. Buyer shall be liable for all storage charges for any item(s) not removed within 7 days of sale and be assessed by auctioneer at a daily rate of $45.00 Per Day. Item must be picked up within 7 Business Days of the auction, or the buyer will incur storage charges. A TRANSFERABLE TITLE will be sent to the buyer by express mail or similar service within 20 business days of the auction. Buyer is responsible for vehicle registration. We do not guarantee current registration or that this item will meet local emission requirements. Titles/titling docs may be delayed due to extended processing times at DMV. AUTOMOBILES & HEAVY EQUIPMENT Terms & Conditions - DO NOT BID UNLESS YOU INTEND TO PAY FOR THE ITEM - TERMS: ALL SALES ARE FINAL. ALL ITEMS ARE SOLD "AS IS-WHERE IS" WITH ALL FAULTS AND WITH NO GUARANTEES OR WARRANTIES OF ANY TYPE, EXPRESS OR IMPLIED, INCLUDING WARRANTIES AS TO THE MERCHANTABILITY OR FITNESS FOR PARTICULAR USE OR PURPOSE. FURTHER. Any description or information given on a lot is not guaranteed, warranted, or assumed by Auctioneer, and Buyer must rely solely on his/her own inspection. Property is open to a thorough public inspection and bidders from off-site understand and acknowledge that he/she may not be able to inspect as well as if present, in person. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factors. PAYMENT, Buyer is to pay in full within (3) days of auction's end. If Buyer fails to pay in full when due, Buyer shall further be liable to the Auctioneer all sums unpaid as well as Auctioneer's collection costs, including but not limited to attorney fees and court costs, incurred in connection with Buyers non-payment. Buyer must pay for any item over $2000 by Wire Transfer (+ $30 Processing Fee) or Cash. No personal checks will be accepted. ALL ITEMS UNDER $2000 MAY BE PAID BY CREDIT CARD AND WILL INCLUDE A 3% Processing Fee Charge. The Delivery of Certificate of Title will be initiated upon full payment. REMOVAL: If paid by Wire Transfer or Credit Card, Removal of the purchase will not occur until the funds are confirmed, VERIFIED PAID! All Purchases Must be removed within 7 Days of the auction close. All costs, loading responsibility and risk of removal shall be borne by buyer. Please know the trailer size and weight requirements when picking up and loading heavy equipment, If Buyer wishes to have the purchases shipped, all shipping coordination/logistics and costs of same Must be pre-arranged and carried-out by the Buyer. If for any reason Buyer fails to remove any purchases within the time specified, the Auctioneer shall have the right but not the obligation, to resell, discard or remove said purchase at the Buyer's sole risk and expense, without waiving any rights that Auctioneer or Consigner/Seller may have against the Buyer. Buyer shall be liable for all storage charges for any item(s) not removed within 7 days of sale and be assessed by auctioneer at a daily rate of $45.00 Per Day. Buyer is solely responsible for Loading & Transportation of any equipment won, Do not expect Consigner/Seller or Auctioneer to load equipment for you. If Buyer fails to complete the purchase of any item pursuant to these terms and conditions, any money deposited in part payment shall be first applied against Auctioneer's damages, including storage charges. In The event of resale, Buyer shall be held responsible for any deficit between the successful bid and the price for wich the item was resold and charges arising from such resale and is not entitled to any portion of any amount received by resale. Buyer agrees to reimburse Auctioneer for any and all costs incurred, including its reasonable attorneys fees, expert fees, and court costs, which result from or are incurred due to Buyer's breach or attempted breach of these terms and Conditions. In Addition, Buyer agrees to indemnify and hold Auctioneer & Consigner/Seller harmless from all loss, cost, expense and other damage (including reasonable attorney's fees and costs), directly or indirectly sustained by the auctioneer or Consigner/Seller, arising from or related to Buyer's failure to comply with these terms. BY BIDDING, BIDDER AGREES TO ABIDE BY ALL THESE TERMS. ACCEPTANCE OF TERMS: By registering to participate in a Cheyenne Auctioneers, LLC auction thru any bidding service offered by us (whether present in person, by agent, by telephone or absentee bid, or through a live internet connection), you fully understand and expressly agree to the following terms and conditions, along with the agreement to be so bound. If a purchaser breach any of these Terms of Sale, including the obligation to pay for purchased items, Cheyenne Auctioneers, LLC may seek all remedies under the law including canceling the sale and reoffering the property without reserve. The rights and obligations of the parties shall be governed by the laws of the state of Wyoming: Any bidder who registers thru one of our bidding platforms, (online, in house, absentee) must register their name, mailing address, and telephone number prior to the auction. As used in these conditions of sale, the term "final bid" means the highest bid acknowledged by the auctioneer and the term "purchase price" means the sum of the final bid plus the premium payable by the buyer and sales tax if applicable. 3. The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer has the right to cancel any bid, to advance the bidding at his absolute discretion and in the event of any dispute between bidders to determine the successful bidder, to continue the bidding or to re-offer and resell the lot in dispute. In the event of any dispute after the sale, Cheyenne Auctioneers, LLC records of final sale will be conclusive. Internet bidders should be aware that auction floor bids (if Applicable) taken by the Auctioneer always supersede bids taken online, therefore it is often necessary for Internet bidders to bid again to have the contending bid on any particular item. 4. Cheyenne Auctioneers, LLC reserves the right to withdraw any lot before the sale. The record of sale kept by the auction house will be taken as final in the event of dispute. 5. DISPUTE BETWEEN BIDDERS: If any dispute arises between two or more bidders, bidding online or in house, the auctioneer may decide the same or may immediately put the lot up for sale again and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. The purchaser assumes complete responsibility for items at the fall of the hammer. 6. Some lots may carry reserves or minimum selling prices. This is a figure set by the consignor and the auction house below which a lot will not be sold. Our auction house will execute the reserve bids. The reserve will not exceed the low estimate. Estimates are subject to change at any time prior to the offering of each lot. 7. We are pleased to offer online, absentee and phone bidding for prospective bidders who cannot be present at the auction. An absentee bid form must be completed and faxed or emailed to our gallery. Absentee bids will be executed competitively and confidentially. All bids are held in the strictest confidence and must be received 24 hours prior to the auction. Leaving an absentee or phone bid on a lot indicates your willingness to open the bidding at one half the printed low estimate and gives the auctioneer the authority to open the bidding at that level. Cheyenne Auctioneers, LLC shall have the right to withdraw any item at any time for any reason and to default any sale in the event of an error or dispute. In the case of identical absentee bids, the bid received first will prevail. Bidders are encouraged to submit absentee bids at least 24 hours prior to the auction. We reserve the right to pre-authorize credit card deposits. In bidding online, you acknowledge and agree that each bid submitted is irrevocable and cannot be amended or corrected, even if submitted in error and notified to us. You accept full liability for all bids submitted. Cheyenne Auctioneers, LLC will not be held responsible for any errors or failures, whether human or technology related, to accurately execute bids. WE ACCEPT NO LIABILITY FOR ANY FAILURE OR DELAY IN EXECUTING BIDS OR ANY ERRORS ASSOCIATED IN BIDS PLACED VIA AN ONLINE BIDDING PLATFORM SERVICE. 8. BIDDER'S INFORMATION - We sell 80 -100 lots per hour. A buyer�s premium will be applied to the purchase price of all auction items sold of 10%. All items are sold AS IS, WHERE IS, WITH ALL FAULTS and ALL SALES ARE FINAL. 9. Title of the offered lot shall pass to the buyer upon the fall of the auctioneer's hammer and announcement by the auctioneer that the lot has been sold. The buyer shall forthwith assume full risk and responsibility for the lot and shall pay the full purchase price.
