By registering for this auction you agree to the following terms and conditions. This is a legal binding contract between you, referred to as the “Bidder” and East Lansing Auction referred to as the “Auction House”. Pick-up/Shipping: FREE SHIPPING is provided for most of the items, limited to the United States. It is imperative that the accurate shipping address is included during the registration process. Please review the item specifications to ascertain whether it qualifies for complimentary shipping. For pick up items, a scheduled appointment is mandatory, and pick up is restricted to the specified location, which will be communicated to you subsequent to the conclusion of the auction via email. The appointment period is scheduled to commence one week following the conclusion of the auction. The pick-up location will be in Lansing, MI. Should you prefer to have your item shipped, please inform us at your earliest convenience. Upon notification, we will calculate and provide you with the applicable shipping fee. Please note, payment of the shipping fee is required in advance of the item's dispatch. Payment Method: Payment is exclusively accepted through debit or credit cards. You agree to pay for your entire invoice in full. After the auction has been completed, the Auction House is going to charge the card on file for the items. Failure to pay for your entire invoice within 7days will result in the auction house taking legal action against the full invoice amount plus any other penalty and/or removal fees. Buyer's Premium: The bidder acknowledges that a buyer’s premium of 20% will be applied to the hammer price of each auction item. When submitting a bid, it is important to factor in this buyer’s premium and bid accordingly. For instance, if an item is successfully auctioned for $100, the buyer’s premium would amount to $20, resulting in a total of $120 (excluding Michigan’s 6% sales tax). Upon receipt of an Under-Minimum Offer, we reserve the right, at our sole discretion, to present this offer to the Consigner. The Consigner shall then have the option, but not the obligation, to accept the Under-Minimum Offer. Should the Consigner decide to accept an Under-Minimum Offer, it is acknowledged that the sale price of the item will be less than the minimum bid previously established. Consequently, the Consigner will receive a reduced sale amount for their item. Notwithstanding the acceptance of any Under-Minimum Offer, East Lansing Auction will retain its agreed-upon percentage of the sale price as commission for facilitating the sale. Acceptance of an Under-Minimum Offer by the Consigner and the completion of the sale transaction shall be considered final. By accepting the offer, the Consigner agrees to the sale terms and acknowledges that the item will be sold for the offered amount. It is at the sole discretion of East Lansing Auction to determine which, if any, Under-Minimum Offers are presented to the Consigner for consideration. Not all Under-Minimum Offers may be communicated to the Consigner. East Lansing Auction reserves the right to modify these terms and conditions at any time without prior notice. All participants in the auction process are encouraged to review these terms regularly to stay informed of any changes. CLAIMS LIABILITY: The bidder or purchaser agrees to save the Auction House from any and all actions, claims, debates, demands, judgements, liabilities, costs, and attorney's fees arising out of, claimed on account of, or in any manner predicated upon loss of or damage to property and injuries, illness or disabilities to or death of any and all persons whatsoever, including members of the general public, or to the property of any legal or political entity including state, local or interstate bodies, in any manner caused by or contributed by the bidder or purchaser, it agents, servants, employees, or any person subject to its control while in, upon or about the sale site and/or the site on which the property is located, or while the property is in the possession of or subject to the control or the bidder or purchaser, its agent, servant or employees after the property has been removed from Consignor's control. Storage Fees and Unclaimed Lots All items won at our online auctions must be paid for and collected within 8 days from the 1st day if designated pick up dates sent via email. If not settled and collected within this period, a storage fee of $2 per lot, per day will accrue and items may be resold at the bidder's expense. Bidders agree to pay these storage fees. Items will not be held beyond 13 business days post-auction. After this, items will be deemed abandoned and resold. Bidding Errors and Software Malfunctions: In the event of a bidding error, the bidder must promptly contact the Auction House. Bidding errors cannot be rectified after the bidding has concluded for those items. If a bidding error occurs on the last day of the auction, it may not be possible to address the issue in time, and the bidder may be responsible for paying the invoice amount. The Auction Houses will not assume any bid is an error. If there is a malfunction in the software and/or bidding system used by the Auction House, the bidder agrees not to hold the Auction House accountable. Lot Removal: We retain the right to withdraw any lots or items from the auction, even if there are already bids on them. This action can be taken at any time without prior notice, including, but not limited to, after the auction has concluded. SALES TAX: Buyers will be charged all applicable taxes unless SATISFACTORY PROOF OF EXEMPTION is provided to Auctioneer prior to payment. If satisfactory proof is not provided, Buyer will pay all applicable taxes to Auctioneer. No taxes will be refunded once the tax has been collected. Proof of exemption, subject to approval by Auctioneer, includes VALID RESALE CERTIFICATES, EXEMPTION CERTIFICATES, VALID CRS only, and any other documents as governed by applicable local, state, and federal laws deemed acceptable at Auctioneer's sole discretion. Taxes are calculated AFTER the buyer's premium. These Terms and Conditions can be changed at any time without notice. If a bidding error occurs on the last day of the auction, it may not be possible to address the issue in time, and the bidder may be responsible for paying the invoice amount. The Auction Houses will not assume any bid is an error. If there is a malfunction in the software and/or bidding system used by the Auction House, the bidder agrees not to hold the Auction House accountable. Lot Removal: We retain the right to withdraw any lots or items from the auction, even if there are already bids on them. This action can be taken at any time without prior notice, including, but not limited to, after the auction has concluded. SALES TAX: Buyers will be charged all applicable taxes unless SATISFACTORY PROOF OF EXEMPTION is provided to Auctioneer prior to payment. If satisfactory proof is not provided, Buyer will pay all applicable taxes to Auctioneer. No taxes will be refunded once the tax has been collected. Proof of exemption, subject to approval by Auctioneer, includes VALID RESALE CERTIFICATES, EXEMPTION CERTIFICATES, VALID CRS only, and any other documents as governed by applicable local, state, and federal laws deemed acceptable at Auctioneer's sole discretion.
