*A $5 handling fee per shipping box is added for shipping of items.
*A $5 handling fee for bringing back items to the office per lot will be added for those customers with a 3 day pick up window.
IMMEDIATELY FOLLOWNG THE END OF THE AUCTION, CREDIT CARDS ON FILE WILL BE CHARGED AND RECEIPTS WILL EMAILED. IF YOUR CREDIT CARD IS DECLINED AN ADDITIONAL 3 % CHARGE WILL BE ASSESED TO PROCESS A CREDIT CARD A SECOND TIME.
Please ask all questions prior to the close of the auction. Look carefully at the photos and/or attend the preview as stated in the listing. All sales are final!
Payment:
Invoicing is done through Currency Pay at the close of the auction. Your card on file will be charged directly following the close of the auction. Visa, MasterCard, American Express & Discover are valid forms of payment. We also accept e checks, please contact Kedra at 765-625-1714 to make those arrangements. DO NOT ASSUME you can just pay cash without making prior arrangements. This is grounds for permanent banishment! Payment is due 24 hours following the close auction.
Bring Backs:
In the event of an emergency, you are unable to attend the pickup, the auction company can provide transport for (small, manageable) items to be taken to our office in Farmland for a pick up within 72 hours. There will be a $5.00/ item fee added to your bill. Please note that this is in a per person basis and arrangements MUST be made in advance. Please call Kedra at 765-625-1714 to make those arrangements.
Shipping:
After your initial payment for your purchase, your card on file will be charged for the cost of shipping plus a $5 per packaged box. We try and ship your items via USPS. Some items due to size or weight will need to be shipped via USPS. We have had too many issues with FedEx (lost packages, broken packages, etc) so we prefer not to use them.
Terms & Conditions:
The Sale of Items- Wagner Auctioneering and Real Estate has the right to terminate the auction at any reasonable time; withdrawal from sale any item; to sell at this auction items not listed; to group one of more lots into one or more selling lots or to subdivide into two lots or more selling lots. Wagner Auctioneering and Real Estate also reserves the right to sell all of the items listed in bulk.
No Liability- Wagner Auctioneering and Real Estate assumes no liability for your purchases (if you buy a lawnmower, bulldozer, or other such item, and you don't know how to use it and get injured, we are not liable). The buyer assumes and does agree to indemnify and hold the Auction Company and seller harmless from any future claim that shall pertain to the fitness or use of that asset being purchased.
Documents- All documents must be completed in full by buyers and sellers. For example: Death Certificates, Letters of Authority, Creditor Liens, and UCC's when purchasing vehicles, firearms, etc.
Loading Equipment- Wagner Auctioneering and Real Estate does not lend, lease, or borrow any equipment, nor deliver sold goods.
Consignors- All consignors must fill out a contract with Wagner Auctioneering and Real Estate, sign forms and abide by our terms listed.
Bidders- All bidders must register for bidder's numbers with proper ID. Payment- Purchases must be paid in full within 24 hours of conclusion of the auction. Payment may be made by Visa, MasterCard, American Express or Discover with no extra fees. Wire transfers will incur an extra fee. Buyer specifically waves the right to dispute or deny payment for any purchases made with credit card.
Removal- No goods will be removed until paid in full. Purchaser is responsible for removal of all purchased items. No abandonment of purchased items is allowed. Purchaser will be responsible to pay the full cost of removal or disposal of abandoned items. Wagner Auctioneering and Real Estate shall not, in any event, be liable for non-removal or abandonment or for any other matter to any purchaser of any lot.
Paid Receipt- Removal of purchased items shall be at the expense, liability, and risk of the purchaser. Purchases can be removed upon presentation of paid receipt to Auction staff. Purchased goods must be removed within the parameters listed in the auction description or sold for storage in our upcoming sale.
NSF Funds- A fee for Non-sufficient Funds (NSF) checks per occurrence will be charged. NO CREDIT ALLOWED
Reserve Prices- We are governed by the Indiana Statutes and all items sell with a reserve unless advertised. Wagner Auctioneering and Real Estate has the right to publish or disclose any minimum due to confidentiality. Vehicles sell with owner's confirmation.
Bidding- No consignor, seller, or agent for seller has that right to bid on their consigned goods.
Employee Bidding- Any employee of Wagner Auctioneering and Real Estate may bid at any auction if they so wish to purchase an item.
Compliance with The Terms of Sale- In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages.
Indiana Laws- Wagner Auctioneering and Real Estate is in complete accordance with Indiana statutes and Indiana Administrative codes, Title 25, Title 812, Department of Revenue Tax Bulletin #20, and Reference IC 6-2-4. Sold Items- All items become the sole responsibility of the purchaser when auctioneer confirms your number as successful bidder. Although the auction company will exhibit reasonable care to safeguard purchases until removed by purchaser, no refunds or adjustments will be allowed for any shortages. We are NOT responsible for stolen or lost goods.
Keeping Order- Auctioneers have the right to refuse service or eject any person obstructing the auction process. Appraisals are NO guarantee of auction prices; nor can we establish a value for sentimental reasons. The Auction Company, when acting as Agent, is not responsible for the act of its principals.
NO Warranties- Everything is sold "AS IS/WHERE IS" with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final.
Sales Tax- Sales tax will be charged and collected on all purchases, as required by appropriate state/local laws. Sales tax exemption number, where applicable, must be presented at the time of bidder registration. To qualify for any available exemption, buyer must sign any required form.
Dispute between Bidders- If there is any dispute between two or more bidders, the auction company or its' auctioneer, may decide the successful bidder. The decision of the auction company, or its' auctioneer, shall be final and absolute.
Condition of Items Sold- All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse.
Nominal bids- Any bid that is merely a nominal bid may be rejected by the Auction Company or the Auction Company may reject fractional advances, if in their judgment it may adversely affect the sale.
Absentee (proxy) Bids - Absentee bids may be presented to the auction company in writing and must be accompanied by credit/debit card number, which will be verified for you maximum bid amount and applicable Buyer's Premium prior to the sale. Buyer may deliver to auction company maximum bid in certified funds to be refunded in full, if Buyer does not gain the successful bid. Said bids are subject to all terms and conditions of sale as listed herein or announced at the auction sale. All absentee bids will be held in confidence.
Auction Company may have a principal interest in this sale. Seller may NOT bid on his/her own items at auction as per state laws.
Personal and Property Risk- Persons attending during exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the Auction Company from liability therefore. Neither the Auction Company nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held.
Records- The record of sale kept by the Auction Company, the audio tape of the auction and the bookkeeper records will be taken as final in the event of any dispute.

Due to the passing of Mr. Drake we have been asked to liquidate all of the persnonal property. The real estate has sold and ALL items will need to be picked up on the scheduled puick up date of 04/27/2024 from 10am-2pm EDT. All items left will be considered abandoned and disposed of. 601 Leather? Rocking Reclining Chair Very nice and clean reclining, rocking chair. Possibly is true leather unsure, maroon type color, very nice chair, made by Best Home Furnishings. 602 Floral Pattern Wingback Straight Chair Cloth covered wingback floral straight chair, very clean and nice, does have arm covers, made by Charles Custom Furniture. 603 Pair of Brass Appear Touch Lamps Set of very nice touch lamps, both these do work as they should, almost a brass tarnished color, very nice set of lamps. 604 Three Cushion Floral Print Sofa Three cushion floral print sofa, very clean and nice, does match floral straight chairs, made by Charles Customer furniture. 605 Floral Pattern Wingback Straight Chair Very nice and clean wingback floral print straight chair does have arm rest covers, made by Charles Custom Furniture and mate to lots 602 & 604. 606 Ottoman Mauve colored cloth ottoman, nice and clean mauve colored ottoman, wooden legs and feet, very nice piece. Was used with one of the chairs. 607 Eagle & Candle Stick Holders This wall hanging eagle is a ceramic type material with no major damage, does come with what appear to be pewter or some type of metal candle stick holder, no markings on any of the pieces. 608 Fireplace Tools & Wood Holder Set of heavy metal fireplace tools, comes with shovel, broom and poker. Also, lot features a nice metal wood bundle holder. All in good condition. 609 Leather? Reclining Chair Very nice possible leather reclining chair, in very good condition with a lot of life left in it. Unsure of maker. 610 Wooden Decor Pieces Set of wooden decor pieces, bowls and one is a wheel barrow with nut cracker set in it. All in good condition. 611 Vase w/ Floral Arrangement Very nice ceramic type vase with floral arrangement in it, all flowers are slick, no markings. 612 Wooden End Table or Coffee Table Wooden end table or coffee type table, does have small shelf on bottom for reading material. 613 Floor Lamp Good floor lamp, works as it should, three way switch, comes with shade, metal base with ceramic or marble appearing piece. 614 Copper Walling Hanging Basket Small copper wall hanging basket with silk greenier in it. Great decor piece. No makers mark was found. 619 Small Brass Appear Table Lamp Small brass appearing table lamp, works as it should, really nice lamp. 620 Mid Century Modern Drop Front Secretary Mid Century Modern drop front secretary, dovetail .construction, great condition is a mate to lot 617. 621 Full Bed Frame Metal full bed frames, can take mattress and box springs if you wish, no head board or foot board, but is in mattress cover, appears to be very clean. 622 Mid Century Modern Chest of Drawers Very nice clean set of Mid Century Modern chest of drawers, dovetail construction, no makers mark found. 623 Mid Century Modern Mirrored Dresser Mate to lot 622, this a very nice and clean Mid Century Modern designed mirrored dresser, dovetail construction and no makers mark found. 624 Queen Bed Frame & Head Board Mate to lots 622 & 623, Mid Century Modern bed with frame and headboard, you are able to take mattress and box springs if you wish, mattress has been in cover. 625 Vintage Electrified Oil Lamp Hand painted glass oil lamp that has been electrified, appears to be vintage, two lights in lamp and works as it should. No major cracks or damage. 626 Floral Oil on Canvas Paintings Matching set of oil on canvas floral paintings. Bagger is missing a bolt to hold onto back. 100 engine hrs, runs and works as it should. It has been used this Spring for mowing. 691 John Deere 155C Lawn Tractor John Deere 155C lawn tractor, 48" deck, hydrostatic transmission, runs and operates as it should. Has been used this Spring for mowing, hour meter does not work, unsure of total engine hrs, 25hp engine. 692 Long Handled Tools Nice selection of long handled tools. Comes with brooms, rake, weed cutter, hedge trimmers, limb trimmer, brooms, dust pan and more. All are in useable condition, plastic rake does have some teeth missing but still in working order. 693 Scrap Metal Misc scrap metal pieces, no work bench is included in lot. Several pieces of misc metal and hardware. 694 Metal Workbench w/ Grinder & Vice Very nice workbench or welding bench with bench grinder and vice. Both work as they should. Small drop cord also with lot, medium duty. 696 Drop Cords Two drops cords, medium duty, both look to be good and good ends on both, Have not been tested. 697 Medium To Light Duty Drop Cords & Trouble Light Lot comes with tow medium to light duty drop cords as well as a nice trouble light. Has not been tested but assumed to work as it should. Stand and table come with unit. 110v 701 Pittsburgh Brand Vacuum Pump Pittsburgh brand vacuum pump, still in box, has been used but still in good condition. 702 Air Body Saw & Air Die Grinder Harbor Freight brand die grinder and body saw, both still in box, some use but light. Both air powered and in good condition. Body saw still has packing on it. 703 Wagner Steamer Wagner steamer, wall paper remover, still in box, appears to have some use but light use. Has not been tested. 704 Delta Table Saw Jig Delta brand table saw jig, works as it should. 705 Sears Craftsman Brand Transit Sears Craftsman brand transit, does have tripod (not pictured) with unit. Comes in very nice wooden case, appears to be clear and in working order. Comes with manuals. 706 Montgomery Ward Transit Montgomery Ward transit, comes with case and tripod (not pictures). Very nice metal carrying case as well, does appear to be clear and comes with manual. 707 Craftsman 1.5hp Router Craftsman 1.5hp router, has not been tested but appears to be in working order. 110v cord is good 708 Craftsman All in One Cutting Tool This is Craftsman version of a Roto-Zip, comes in carrying case and looks to be complete, has not been tested. 709 Power Tools Small lot of power tools, lot comes with 90 degree drill and belt sander, both appear to be good but have not been tested. 710 Sharpening Stones Lot of various sharpening stones, one is new still in wrapper, others have been used but still in good condition with lots of life left in them. 711 Porter Cable Double Insulated Plate Jointer Porter Cable brand double insulated plate jointer. Comes with metal case, looks to be in working order but has not been tested. 712 Brake Bleeder & Vacuum Kit Brake bleeder and vacuum kit, appears to be complete and in working order. 713 Makita Electric Sharpener Makita brand electric sharpener, looks to be complete and in working order.
