Listing Terms and Conditions
PROCEDURE: The property will be offered in two (2) individual tracts using the �Buyer�s Choice and Privilege� method of sale, in which the high bidder can purchase either or both offered tracts. Bidding for each separate tract will be in dollars per acre and the full prices calculated based on the assumed stated acreage for each tract regardless of the actual number of acres that may be calculated by an accurate survey of the premises. DOWN PAYMENT: A 10% down payment will be due from the successful high bidder(s) within 24 hours the close of the auction and the declaration of the high bidders. The down payment can be made by wire transfer to the account of the title company acting as closing agent. Routing information will be provided. The balance of the purchase price is due at closing within 30 days of the close of the auction. THIS SALE IS NOT CONDITIONAL UPON THE HIGH BIDDERS OBTAINING FINANCING. ACCEPTANCE OF BIDS: Each successful high bidder shall enter into a purchase agreement in writing on a form provided by Sellers� agents. This sale is with reservation of rights of the Sellers and is subject to approval of the Sellers whom may reject any and all bids in their discretion. TITLE EVIDENCE: Sellers will provide a commitment for a policy of title insurance for the purchasers and pay the cost for the initial search owners� premium, revenue stamps and one-half the closing agent�s fee. Purchaser shall be responsible for the final title search, any mortgagee coverage, recording the Warranty Deed from Seller, and one-half the closing agent�s fee and usual and customary Purchase charges. REAL ESTATE TAXES: Sellers shall be responsible for paying the 2023 and 2024 general real estate taxes which shall be prorated between the parties by the closing agent to the date of closing based on the amounts paid in 2023 for 2022. POSSESSION: Purchasers will be entitled to possession following closing. MINERAL INTERESTS: No minerals are being sold with the surface of this real estate.
