TERMS & CONDITIONS
BY PLACING A BID, BIDDER CERTIFIES THAT THEY HAVE READ AND WILL ABIDE BY ALL TERMS AND CONDITIONS AS STATED BELOW. IT IS THE BUYER'S RESPONSIBILITY TO UNDERSTAND ALL THE TERMS AND CONDITIONS PRIOR TO BIDDING.
All items are sold "AS IS, WHERE IS" with no warranty or guarantees, expressed or implied, by the seller or Hallberg Auction. Bidders accept all auction items/property "WITH ALL FAULTS", whether or not immediately apparent. It is strongly recommended that bidders thoroughly inspect items before placing a bid. Items are described as accurately as possible, but do not represent any guarantee by the seller or Hallberg Auction. By placing a bid, bidder signifies that they have inspected the item to their satisfaction.
By placing a bid, the bidder is entering into a contractual agreement to purchase the item(s) from the seller. Failure to follow through with payment and pickup of items could result in legal collection proceedings.
Simulcast Bidding: Online bidding (including prebids) that takes place during our live auction will be taken as bids are recieved during the auction. Bids are valid only when accepted by the auctioneer. All bids accepted are at the discretion of the auctioneer and will follow the customary sequence of any live auction.
Pictures and Item Descriptions
Multiple photos will be included in item descriptions whenever possible; however, photos may or may not fully represent the item. Lighting, surroundings and other factors can affect the perception of an item in a photo; therefore, all bidders are responsible for their own personal inspection of the item(s) before placing a bid. Photos and descriptions are to be used as a guideline only.
Odometer, Mileage & Hour Meter readings are assumed to be correct. These assumptions do not constitute a guarantee. It is up to the bidder to validate the accuracy of the reading during the inspection process. Hallberg Auction is not liable for any inaccuracies pertaining to odometer, mileage and hour meter readings.
Auction Software
Hallberg Auction will not be held liable for any software or software malfunction discrepancies.
Invoicing
An invoice and payment instructions will be sent to each buyers registered email at the close of the auction. Please read email message completely for payment instructions. Please contact us at (800) 373-2255 if you do not receive an invoice from us within 24 hours of auction close.
Payment
Successful bidders must contact Hallberg Auction within 24 hours after receiving their invoice to confirm their method of payment.
Payment must be received within 7 days after the conclusion of the auction.
If payment is not received or payment arrangements made within 7 days after the conclusion of the auction, the buyer will lose all right, title and interest to the item(s), including any and all moneys.
Auction items will not be released for pickup until payment is made in full. Failure to comply with these terms will prohibit bidder from participating in future live or on-line auctions conducted by Hallberg Auction.
Item Pickup
Removal and/or transportation of item(s) won on auction shall be at the expense, liability and risk of the buyer. Loader available the Friday, Saturday and one full week following the auction from 9 am to 5 pm without appointment. Any pickup after the Friday following the auction (8 calendar days) requires a 24-hour notice.
Returned Check Fees
A fee of $35.00 will be assessed on returned checks and may result in the bidder being denied access to future auctions. Be sure you are capable of paying immediately after the conclusion of the auction and realize your bids are not conditional upon financing.

Payments will be made to Hallberg Auction.
Forms of payment: Company/Personal Check, Cash, or Credit Card (with a 4% convenience fee for use of a credit card).

There is a 4% convenience fee per transaction for all credit card purchases.
Titles
Titles will be sent via standard mail within ten days after payment has been received, unless otherwise specified in the description of the item, and will be mailed to the address provided by bidder upon registration.
Reserve Bidding
Items on auction may have an undisclosed reserve. Sellers, Hallberg Auction, or other agent of seller may bid on items up to reserve amount in order to aid in the sale of the item.
*By placing a bid, bidder signifies that they have inspected items to their satisfaction.
*Hallberg Auction reserves the right to remove any property prior to close of the auction.
*Hallberg Auction reserves the right to reject any bid at our discretion.
*Bidders who register at any of our auctions will be included in our mailing lists to receive print or digital communication regarding upcoming auctions. Your information will not be sold to third parties and you may opt out of receiving notices at any time.
