NEW A:UCTION TERMS:
1). Out of state buyers are required to do a money transfer for all invoices over $500. All money orders must be recieved by 3 days after the closing of the aution.
2). Titles and registrations will be mailed to buyers 10 days after payment has been made via certified mail.
Auction Terms & Conditions You are required to read and agree to all terms and conditions for this auction. (If you do not agree please do not register to bid.) All items are sold as is / where is! It is recommended that you attend the open house to familiarize yourself with the items you wish to purchase. (Example: color, size, shape, age, or overall condition). If there is no open house offered, please feel free to call us if there is a question about the condition of a lot prior to bidding. All bids are binding.
COINS & JEWELRY: We are not coin dealers, jewelry dealers or appraisers! If you need to know the condition of a coin come to open house for viewing. If coins are shipped then this is a risk youi take. We will not gaurantee age, condition or anything that has to do with coins! We receive these from consignors and do not gaurantee their information to be true. Buy at your own risk. Just like all other items we will not accept and charge backs or returns on coins or jewelry we sell!
All firearms are registered with Bid-N-Buy Realty & Auctions, Inc. Purchasers must complete a federal background check to complete any firearms transaction. Pistol purchases require a valid pistol permit. There is no additional fee for a background check. Bid-N-Buy Realty & Auctions Inc. is a federal licensed dealer and New York State licensed for pistol sales. Shipping is available, but all firearms shipped must be received by a FFL dealer. It is the responsibitity of the buyer to determine if a weapon is legal in there state. If you have questions please call our office prior to bidding.
Registration: Registration requires a credit card for verification of identification only. We will not add any charges to your credit card until auction pick up is over. Therefore, you can pay with a check or cash if you wish.
NO STOP PAYENT ORDERS OR CREDIT CARD CHARGEBACKS:
No stop payment orders or credit card chargebacks. Each bidder agrees that such bidder will not, under any circumstances, (i) issue a stop payment order with respect to any checks issued or in connection with the auction, or (ii) initiate a credit card chargeback with respect to any purchases at the auction. Each bidder further agrees that if, in violation of these terms and conditions, a stop payment order is issued or a credit card chargeback is initiated, these buyer terms & conditions will be conclusive evidence of the bidder's (i) waiver of any rights to issue a stop payment order or to initiate a credit card chargeback, and (ii) agreement not to issue a stop payment order or to initiate a credit card chargeback; and each bidder acknowledges and agrees that the auctioneers presentation of these bidder terms and conditions to the bank, credit card company, or other financial institutions against which a check was drawn or that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to, or for the account of auctioneer. If, in violation of these bidder terms and conditions, a bidder issues a stop payment order or initiates a credit card chargeback, such bidder, even if successful, will remain liable for all purchases made at the auction, and will be responsible for all costs and expense, including attorney's fees, incurred by or on behalf of auctioneer and/or seller in challenging the stop payment order or credit card chargeback and in collecting payment. Each bidder acknowledges and agrees that the covenant not to issue a stop payment order or initiate a credit card chargeback is a condition to the issuance of a bidder number to such bidder, and is being made as an inducement for the auctioneer to accept such bidder's bidder registration, to issue a bidder number, and to permit the bidder to bid at the auction. Each bidder acknowledges and agrees that auctioneer is relying on the covenant not to issue a stop payment order or to initiate a credit card chargeback in accepting such bidder's bidder registration, in issuing a bidder number, and in permitting the bidder to bid at the auction. All items are sold in as/is condition with no warranties implied or expressed. By signing this you agree to all these terms and conditions.
By registering for our online or live auctions you agree to all of our terms and conditions, an online registration will be considered a signed contract from the bidder who wishes to participate in our auction and that the bidder is accepting all of these terms & conditions. All registrations and bids are considered legal and binding.
Bidding: Once you have registered now it's time to bid. Go to view catalog. Click on an item inside the catalog that you wish to bid on. After reading the description you can now bid. Click on the "bid button". You can bid to the next increment or place a max bid. If you choose max bid the computer will bid for you up to your max amount. Preset bidding increments have been set up. As the price of an item increases the bid amount increments will increase. It is not necessary to enter a decimal point and zeros to your bid amount. The computer software will enter them for you. Some items will be sold "times the money". If it's a sold "times the money" item it will look like this "X5". Example: If an item sells for $2 dollars each and it is a X5 lot then the price will be $10.
Bidding Live: You can also bid live as the auction closes. 30 minutes before the auction closes click on "enter live auction" button. Place your bids as the increments increase.
Auction Closing: Our Internet auctions use a "soft close" format. An item will close every 10 seconds after the beginning of an auction. This gives the bidder the opportunity to bid on more than one item. If there is an advance bid inside of 2 minutes to close the bidding, that item will be extended by 2 minutes. This process will continue until there is no more bidding activity.
Payment: A 13% (10% for cash or good check) buyer's premium will be added to the final purchase price of each item. Payment is expected on pick up day. We accept most major credit cards, cash or good check. *If you fail to attend pick up, your purchases will be charged to your credit card that you registered with. If we must move your purchases back to our office there will be a 20% no show fee charged. Items can then be picked up at our office when balance due and no show fee is paid. Items will be stored for 3 days. After that point there will be a $1.00 per day fee per item. After 30 days, the items will be considered abandoned and resold. All monies will be retained by Bid-N-Buy Realty and Auctions, Inc. and any loses will be owed by delinquent buyer.
Pick up information: Pick up times are listed in the auction description, as well as the begining lots of the auction. An appointment must be made to pick up your items.
All small items that are not picked up during the scheduled pick up times will have a $20 no show fee added to the unpaid invoice. Small items will be brought to our office and you must schedule an appointment with our office to pick them up. If your items are not picked up within 2 weeks they will be considered abandoned.
If an auction is offsite from our office, all large items (like couches, chairs, dressers, appliances, tables & chairs.....Etc.) will NOT be brought to our office and a $20 no show fee will be added to the invoice. Large items will be considered abandoned.
Buyers will be charged for all items purchased wheather you pick them up or not. It is your best interest to make an appointment during the scheduled pick up times.
Sales Tax: 8% New York State sales tax will be charged on all purchases and buyer's premium. If you are tax exempt, you must sign a resale or farm exempt form.
Shipping: We ship USPS and UPS. There is a $5 per box shipping charge added to each box shipped. We will accept credit card payment or a check for shipping. If you wish to pay with a check your items will be held until the check clears. If you wish to have your items shipped please respond to your emailed invoice at the conclusion of the auction and we will contact you if we have any questions.
Firearm/Ammunition/Magazine Shipping: We are happy to help you with shipping on your firearms purchase. Be aware that we will not return any money or accept a returned firearm for any reason. We describe the guns to the best of our ability and are selling these firearms to liquidate for estates, local businesses and individuals. Purchaser must pay the actual shipping, insurance and material cost along with a $15 handling fee for EACH gun purchased. All Ammuniton and Magazines will be shipped to an FFL of your choice. Once we recieve a copy of the FFL we will begin preparing to ship your items.
