TERMS AND CONDITIONS
1. FULL PAYMENT SHALL BE MADE ON DATE OF SALE, BEFORE BIDDER/BUYER LEAVES THE PREMISES.
2. ANNOUNCEMENTS: The Auctioneer's announcements take precedence over printed matter.
3. NO WARRANTY: The descriptions of items appearing in advertising prior to the sale are believed to be correct. Nevertheless, neither those descriptions nor any oral statement made by Owner or Blue Skies Auction, Inc. concerning any item shall be construed as a warranty, either expresses or implied. ITEMS ARE SOLD "AS IS-WHERE IS with all faults."
4. PAYMENT: Purchases must be paid in full within 15 minutes of conclusion of the auction. If payment is made by Visa or MasterCard, Buyer specifically waves the right to dispute or deny payment for any purchases made with credit card. If any check given as payment is returned for any reason, including, but not limited to, insufficient funds, or stop payment, Buyer agrees that they are responsible for and required to pay all attorney's fees incurred by Auctioneer as a result thereof together with all court costs, arbitration costs and associated expenses. Additionally, in the event of non-payment, stopped payment or bad check, Buyer understands, agrees and specifically conveys to the Auctioneer the right to repossess, at any place, including the Buyer's location or residence, the merchandise involved.
5. RECEIPT: A Buyer will be furnished a receipt at time of payment. This receipt must be authenticated by the checkout person before Buyer will be permitted to remove purchases from the sale premises.
6. REMOVAL: Merchandise becomes the full responsibility of Buyer when the Auctioneer says "SOLD", and the Buyer assumes all risk of loss and damage to property until removed from the sale premises. Buyer and Blue Skies Auction, Inc. agree that merchandise may remain on the sales premises for a period of time following the sale at the risk of the Buyer. The date by which all merchandise must be removed from the premises will be announced by Blue Skies Auction, Inc. at the sale and/or stated in writing. Bidder agrees to pay any storage charges assessed by Blue Skies Auction, Inc. on any item or items not removed by Bidder/Buyer by the removal deadline, or forfeit merchandise entirely, if premises are not available after designated removal period.
7. NO REFUNDS OR ADJUSTMENTS: Errors in estimate of merchandise inventory will be adjusted, but no adjustment will be made after merchandise has actually been removed from the location where it was sold or after the removal date announced by Blue Skies Auction, Inc. at the sale, whether or not the property has been removed. All adjustments must be authenticated by management. No adjustments will be made for lost or stolen items.
8. PERSONAL AND PROPERTY RISK: Persons attending during exhibition, sale, or removal of goods assume all risks of damage of or loss to personal property and specifically release the auctioneer from liability. Neither the Auctioneer nor the principal shall be liable by reason of any defect in, or condition of, the premises on which sale is held.
9. RESALE: Blue Skies Auction, Inc. reserves the right to resell any property not paid for in full on sale day. The Buyer shall be responsible to Blue Skies Auction, Inc. for any expenses for resale and collection costs and damages or shortages resulting from resale.
10. DISPUTES BETWEEN BIDDERS: The Auctioneer shall designate the Buyer after each item of merchandise is auctioned. If a dispute arises between two or more bidders, the Auctioneer reserves the right to reopen bidding. The Auctioneer's designation of the Buyer shall be final and absolute.
11. AGENCY: The Auctioneer is acting as an agent only and is not responsible for the acts of its principals.
