TERMS OF SALE - The terms and conditions for this auction are absolute and cannot be altered in any way. If you do not understand any of these conditions, please contact Sandra Ryals BEFORE bidding. Once you place a winning bid you have entered a legally binding contract.
WARRANTY EXPLANATION - Everything is sold "AS IS, WHERE IS" without guarantees of any kind. If you bid without asking questions about your concern(s), then you accept FULL RESPONSIBILITY for the condition and completeness of the item(s). We do not guarantee items that do not belong to us. The seller no longer needs these items and refuses to guarantee the condition. It is YOUR responsibility to inquire BEFORE you bid on them.
INTERNET BIDDING - Due to varying Internet speeds, browser controls, wireless signals, and other communication problems we DO NOT GUARANTEE that your bid will be accepted on any item. Do not wait until the last possible second to place a bid. If an item is not on your invoice, then your bid was not the last and highest bid recorded and there is no recourse.
PAYING FOR YOUR ITEMS - You may pay for your items when you come to remove them with cash or good check, or with a credit/debit card Failure to pay for your items by the end of the removal period will result in the suspension of your bidding privileges at future auctions.
FAILURE TO SETTLE YOUR INVOICE - Any item(s) that are not paid for AND removed during the Stated Removal Period will result in your bidding privileges suspended for future auctions. Once the invoice has been settled, your bidding privileges will be re-instated.
DESCRIPTION OF ITEMS - While descriptions and counts are believed to be accurate, they are NOT GUARANTEED. If more information is needed, please contact Sandra Ryals.
HOLD HARMLESS AGREEMENT - The buyers hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the sale or during the removal of the items purchased. Buyers remove purchases at their own risk.
REFUNDS AND ADJUSTMENTS - Absolutely no adjustments, claims or refunds will be allowed after the item(s) are removed from the auction site. ANY CLAIMS MUST BE MADE WHILE THE ITEMS ARE ON THE AUCTION PREMISES. In no event will auctioneer's or seller's liability to buyer ever exceed the purchase price paid.
BUYER'S PREMIUM - The expenses of conducting the auction are shared between the seller and buyer. The buyer's expense is called a BUYER'S PREMIUM and is set at 10%.
SELLING TIMES THE MONEY - If there is a small box in the corner of the picture with an "x" and "number", then you are bidding one unit and your bid will be multiplied by the number of units.
REMOVAL SELECTION - If we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.)
REMOVAL PERIOD - The scheduled removal time will be printed on the bottom of your invoice. We do not provide manpower, tools, or equipment. PLEASE BRING YOUR OWN. Any item remaining after the SCHEDULED REMOVAL PERIOD is subject to be considered ABANDONED, with no refund or recourse to the buyer.
RESERVE PRICES - The seller reserves the right to set a minimum acceptable price on any item in the auction. The seller authorizes Sandra Ryals, Auctioneer to bid for the seller up to, but not above this reserve price. This notice within the terms and conditions meets the laws governing auctioneers and does not violate any law within the state of NC.
1. All items are sold "as is" , "where is" without guarantees of any kind, expressed or implied. All descriptions advertised are believed to be correct but never guaranteed. No statement by auctioneer or Fuquay Auction Company employee or associate shall be considered a warranty; it is only an opinion and should not be considered a guarantee of authenticity. All items should be examined and inspected closely before bidding. The bidder hereby agrees to accept any item the way it is and has to use his/her own judgment whether bidding live, online, by phone, or by absentee.
2. By bidding you signify that you have examined the item, chosen not to examine the item, or have hired an independent agent to examine the item for you.
3. All items are to be paid for the day of the auction. No item is to be removed from the auction premises until it is paid for in full.
4. Sales tax will be added to each item unless you are a dealer and provide a valid tax-exempt number.
5. By registering and receiving a bidder's number or participating by absentee, phone, or online bidding at Winstead's Auction Company you are agreeing to all of the terms of the auction.
6. Any Statement / Information Regarding Pick-up Location, Time, or Shipping, in the current auction listing takes precedence over auction terms.
7. All sales will have an 10% buyer's premium fee added to total amount.
Cash accepted upon pick up of items, with prior approval from auction company. Personal/Business checks accepted with prior approval from auction company. All payments should be made within 3 days of the close of the auction. Any unpaid invoices will result in an unpaid item strike and/or revocation of bidding privileges.
Items may be picked up in person at Bostic and Wilson 105 S Main St Fuquay Varina, NC 27526.
