1- L'encanteur d�clare qu'il est encanteur-mandataire pour des tiers et ne peut en aucun cas �tre consid�r� un expert sur les lots � vendre, mais comme encanteur professionnel pour la bonne conduite de l'encan.
2- L'acheteur reconna�t par son ench�re, �tre satisfait des renseignements re�us sur place ou au site internet Encanwestisland.com and Encanwestisland.hibid.com s'il y a lieu. L'acheteur reconna�t qu'il est possible qu'il ait des d�fauts cach�s, il accepte les particularit�s propres � la " vente par encan ", sachant que les items sont usag�s, il s'en d�clare enti�rement satisfait et ach�te � ses risques et qu'il n'y a aucune garantie. L'acheteur admet qu'il a pos� toutes les questions jug�es n�cessaires � l'encanteur relativement aux proc�dures de la vente et plus particuli�rement pour les items convoit�s et d�clare que le tout est clair, net et pr�cis et sans ambig�it� et en est enti�rement satisfait.
3- L'acheteur reconna�t qu'il n'y a pas eu de n�gociation de prix au pr�alable , le prix offert est fait librement et a son enti�re satisfaction.
4- L'acheteur reconna�t avoir examin� lui-m�me les items convoit�s et/ou l'avoir fait examiner par un autre expert � sa satisfaction et accepte tous les vices vus et non vus et d�clare qu'il fera une offre en cons�quence en toute connaissance de cause.
5- L'acheteur reconna�t que la totalit� des termes et conditions de vente fait partie int�grante du contrat de vente et exon�re les mandants et l'encanteur de toute responsabilit� et renonce � tout recours.
6- Modalit�s de paiement: comptant ou autre si sp�cifi�.
7- Les frais d'encans sont de 15%, sauf sur indication contraire.
8- Lorsqu'un lot est vendu, l'acheteur en devient le seul responsable.
9- Toute ench�re est consid�r�e l�gale et irr�vocable: aucune ne peut �tre annul�e pour raison de mauvaise description, de l'�tat, de d�fectuosit�, d'application ou d'utilit� de quelque fa�on que ce soit ou pour toutes autres raisons.
10- L'encanteur se r�serve le droit de mettre une mise � prix sur tout lot. Les mandants se r�servent le droit de surench�rir ou mettre une mise � prix sur leurs items.
11- L'encanteur peut retirer, omettre ou ajouter tout lot � la vente.
12- Advenant un malentendu, l'encanteur peut remettre imm�diatement en vente tout lot faisant l'objet dudit malentendu, l'acheteur s'en remet � la d�cision finale de l'encanteur.
13- Ni l'encanteur, ni les mandants ne sont responsables des erreurs ou des omissions dans la description, cette derni�re ne constitue qu'un guide seulement. L'acheteur se fie � ses connaissances, � son examen des items convoit� et � son jugement.
14- Toutes descriptions quant � la condition, l'�tat, le bon fonctionnement ou l'ann�e de fabrication de chaque item ou lot n'est en aucune fa�on une garantie r�elle ou implicite, les marchandises �tant vendues lot par lot tel que vu sur place aux risques et p�rils de l'acheteur, a moins de sp�cification contraire.
15- Aucune r�clamation ne pourra �tre faite apr�s l'adjudication d'un lot. La manutention, le chargement, le transport, le reconditionnement, l'usage, la disposition, la possession de toute autre utilisation deviennent la seule et unique responsabilit� de l'acheteur d�s l'adjudication.
16- Aucun acheteur ne pourra prendre qu'une partie des lots achet�s, tous les lots achet�s sont consid�r�s comme �tant un seul et unique achat "en bloc" et tous les d�p�ts sont applicables "en bloc" � l'ensemble "en bloc" des achats et non sur un lot en particulier.
17- L'acheteur doit prendre possession de ses biens � ses propres frais, risques et responsabilit�s dans le (1) jour ouvrable suivant l'adjudication, sauf sur indication contraire.
18- Tout d�p�t sera retenu ou saisi par l'encanteur si le solde d� sur l'ensemble de tout achat n'est pas pay� dans le (1) jour ouvrable suivant la vente. Si l'acheteur, dans le m�me d�lai, refuse de prendre possession de la totalit� de ses achats, d�clinant par ce fait m�me tout droit de propri�t�, l'encanteur en conservera le droit total de possession. L'encanteur pourra � sa discr�tion, assurer, remiser, disposer ou revendre ces biens sans avis a l'adjudicataire et si le produit net de la revente est inf�rieur au prix offert originalement par l'adjudicataire, ce dernier en sera tenu responsable et devra, sur demande, payer tout d�ficit encouru sans aucun prot�t, plus les int�r�ts, les frais et les dommages-int�r�ts selon les dispositions de l'article 1765 du Code civil du Qu�bec.
19- Advenant l'impossibilit� de livrer tout lot � cause d'incendie, de vol, liens, saisies, hypoth�ques, actes de fiducie ou toute autre raison r�sultant de ce cas fortuit, le d�p�t donn� par l'acheteur lui sera remis, et ce, sans aucune responsabilit� ou autres recours contre l'encanteur ou les mandants.
20- L'encanteur peut refuser d'�mettre un num�ro d'acheteur-ench�risseur � toute personne ou annuler celui-ci � tout moment.
21- L'acheteur qui, par maladresse ou accident, cause des dommages � ses propres biens ou � ceux d'autres partis, de m�me qu'aux b�timents, autres d�pendances ou terrains, en est responsable.
22- Les prix de vente sont enregistr�s pour toute r�f�rence.
23- L'encanteur ne donne aucune garantie pr�vue par la Loi sur la Protection du consommateur et l'acheteur y consent librement.
24- L'acheteur renonce � la garantie l�gale du vendeur contre les d�fauts cach�s, et plus sp�cifiquement aux dispositions des articles 1726 et suivants du Code civil du Qu�bec.
25- Sans restreindre les termes et conditions susmentionn�s, l'encanteur se r�serve tous les autres recours permis par la loi.
* * * TERMS AND CONDITIONS FOR OUR AUCTIONS
1- The auctioneer declares that he is an agent for others and can in no way be considered an expert on the lots for sale, but as a professional auctioneer to conduct the auction.
2- By bidding, the buyer acknowledges to be satisfied with the information received on the spot or website Encanwestisland.com and Encanwestisland.hibid.com. The purchaser acknowledges that there are possible defects, it accepts the peculiarities of the "sale by auction ", where items are used, it is in fully satisfied and buys at his own risk and there are no guarantees. The buyer acknowledges that he asked all the questions deemed necessary to the auctioneer in relation to procedures for the sale and especially for coveted items and declares that all is clear, unambiguous and is fully satisfied.
3- The buyer acknowledges that there has been no negotiating of the price beforehand, the price offered is given freely and to his satisfaction.
4- Buyer acknowledges having examined himself coveted items and / or has it examined by another expert to his satisfaction and accepts all seen and unseen flaws and will bid accordingly with full knowledge of cause.
5- Buyer acknowledges that all terms and conditions of the sale as an integral part of the sales contract and exempts constituents and the auctioneer and waives all claims.
6- Terms of payment: cash or other if specified.
7- The auction fee is 15% or other if specified.
8- Once a lot is sold, the buyer is solely responsible.
9- Any bid is considered legal and binding: none can be cancelled due to bad description, condition, defect, application or use in any manner whatsoever or for any other reasons.
10- The auctioneer reserves the right to put a reserve price on any lot. Principals reserve the right to bid or put a reserve price on their items.
11- The auctioneer may withdraw, omit or add any lot for sale.
12- If there is a misunderstanding, the auctioneer may call immediately for the resale of any lot subject of misunderstanding, the buyer relies on the final decision of the auctioneer.
13- Neither the auctioneer, nor the constituents are responsible for any errors or omissions in the description; it is to be used only a guide. The buyer relies on his knowledge, his review of coveted items and judgment.
14- All descriptions about the condition, good working order, or the year of manufacture of each item or lot is in no way a real or implied warranty, merchandise is being sold lot by lot as seen on-site and at the risk of the buyer, unless otherwise specified.
15- No claims can be made after the auction of a lot. Handling, loading, transportation, reconditioning, use, disposition, possession of any other use become the sole responsibility of the buyer from the auction.
16- No buyer can take only part of lots purchased; all items purchased are considered a single purchase "block" and all deposits are applicable in a "block" for the whole "block" purchases and not on a particular lot.
17- The buyer must take possession of his property at his own expense, risks and responsibilities (1) business day following the auction, unless otherwise note.
18- Any deposit will be retained or seized by the auctioneer if the balance due on all purchases is not paid within one (1) business day following the sale. If the buyer at the same time refuses to take possession of all of his purchases, declining by the fact all ownership, the auctioneer will retain the full right of ownership. The auctioneer may at its discretion, secure, store, dispose of or resell the property without notice to the purchaser and if the net proceeds of the resale price is lower than the originally offered by the contractor, the latter shall be liable and on request, pay any deficit incurred without protest, plus interest, costs and damages under the provisions of Article 1765 of the Civil Code of Quebec.
19- Should we be unable to deliver any lot due to fire, theft, links, attachments, mortgages, deeds of trust or any other reason resulting from this fortuitous event, the deposit given by the buyer will be refunded, and this, without liability or other claim against the auctioneer or constituents.
20- The auctioneer may refuse to issue a buyer - bidder number to any person or cancel it at any time.
21- The purchaser, by mistake or accident, that causes damage to his own property or those of other parties, as well as buildings, land or other dependencies, is responsible.
22- Sales prices are recorded for future reference.
23- The auctioneer makes no warranty under the Act on Consumer Protection and the buyer agrees freely.
24- The buyer waives the legal warranty against hidden defects, and more specifically the provisions of Articles 1726 and following of the Civil Code of Quebec.
25- Without limiting the foregoing terms and conditions, the auctioneer reserves all other remedies allowed by law. � 2022 Encan West Island

If you provide any information that is untrue, inaccurate, not current or incomplete, or Sebae has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Sebae has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). DESCRIPTIONS OF SERVICE Sebae provides the following services under the Auction Flex & HiBid trademarks: Integrated Web Service (for auctioneers), internet bidding (absentee, online-only, & webcast). You can learn more about these services in the following sections. HIBID INTERNET AUCTION PLATFORM & WEB SERVICE DESCRIPTION Sebae provides the HiBid (formerly Bidopia) Internet Auction Platform & Web Service ("HWS") under the HiBid trademark as a software solution for auctioneers wishing to extend the audience of their live auctions to the internet. The HWS provides various features including internet absentee bidding, internet-only auctions, and webcast auctions. The HWS is able to changes its appearance to coincide with the website that it is powering. Accordingly, the HWS powers the www.hibid.com website as well as numerous Auction Flex customer websites. This ability to change appearance is a feature of the HWS. Much like internet merchant account providers can host a secure web page for a vendor to easily process payments, the HWS hosts certain portions of the auctioneer's website to easily enable advanced features such as internet bidding. INTERNET ABSENTEE BIDDING Internet absentee bidding allows you to place a bid for an item in advance of an auction. This allows you to place bids on lots without actually attending the auction. INTERNET-ONLY AUCTIONS Internet only bidding allows you to place a bid for an item prior to the auction lot closing online. In an internet-only auction there is no live auction. WEBCAST AUCTIONS Webcast auctions allow you to bid in real-time against other bidders or place pre-bids prior to a lot going "live". Lots are sold in accordance with the Auctioneer's terms and conditions which are accessible from each lot's page. It is your responsibility to read and accept the Auctioneer's terms and conditions prior to placing your bid. When you place a bid you are agreeing to be bound by the Auctioneer's & Sebae's terms and conditions. By placing a bid you are entering into a legally binding and enforceable contract. Please keep in mind that you are bidding against other internet bidders as well as floor bidders, phone bidders, and regular absentee bidders (this list does not constitute a complete list of bidder types but does highlight the common bidder channels). The auctioneer, at their discretion, can approve or deny bidders. The auctioneer reserves the right to accept or deny bidders for any reason. Prior to approval the auctioneer may contact you to determine your credit worthiness. If the auctioneer approves your bid, the auctioneer will then process your bid in accordance with their terms and conditions. Should your bid for a lot prove successful, the auctioneer may contact you to arrange for payment & shipping (if applicable). If the auctioneer required registration via a credit card, the auctioneer reserves the right to process your winning bids to the credit card provided during registration. Sebae, through the Auction Flex & HiBid products & services, facilitates the internet bidding process between the Auctioneer & the bidder. Sebae is in no way a party to the transaction. Because Sebae is not a party to the transaction, you accept that you will have no claim or cause of action against Sebae in respect of the sale (or non-sale) of any Lot. If you have a dispute with an Auctioneer or another user of the Service with regard to the sale (or non-sale) of any Lot you agree that Sebae, its officers, agents, employees will not be liable for losses (including, but not limited to, loss of profits, special loss, indirect loss and consequential los), costs, damages, liabilities, claims, demands and expenses of any kind arising out of or connected with such dispute. You also accept that none of the aforementioned are under any obligation to take any action to resolve any dispute between you and an Auctioneer Sebae is not responsible for any typographical, pictorial or technical errors in information about Lots on the Site as provided by Auctioneers. Sebae does not evaluate Lots and does not act as a specialist or expert on any related subject matter. Sebae makes no warranties or representation of any kind or nature with respect to Lots (including but not limited to representations or warranties as to the accuracy of description, genuineness, quality, authorship, attribution, provenance, period, culture, source, origin or safety). If you have any questions, e-mail the Auctioneer directly. In particular, make sure that you understand the Auctioneer's payment terms and shipping terms. BIDDING The Service requires you to login with your username and password prior to placing a bid on a Lot. Making bids with false information or with stolen credit card information is prohibited and illegal. Your user name and password are required in order to place internet bids. Making bids in a false name or with an invalid or stolen credit card is prohibited. Each bid carries the computer coding of the Internet provider which allows the individual user to be traced and Sebae may at its discretion release this information to enable legal action to be taken. Sebae may, in its entire discretion, refuse or remove bids where it suspects that bids contravene this prohibition. By placing a bid, you are making a binding and irrevocable offer to purchase the Item at any price up to the maximum bid amount you submit. If you win, you must complete the transaction, subject to any contractual right or other right at law to rescind the contract in certain circumstances. Failure to complete transaction without lawful reason is not only a breach of your contract with the Seller but also a breach of this User Agreement. The amount bid can be increased but cannot be decreased. The auctioneer may, at their discretion, allow you to withdraw and resubmit a bid in the case of bids containing an obvious typographical error. You may forward a request to withdraw a bid and resubmit a correct bid by immediately sending an email to the auctioneer; however, there is no guarantee that any bid will be withdrawn. Although Sebae will use best efforts to forward all bids, Sebae does not accept any responsibility for lost bids or problems with the recipient auctioneer's ability to process your bid. Moreover, Sebae cannot guarantee that bids received will be processed by the individual auctioneers. Please note that Sebae's role is limited to the provision of the Site for dissemination and publication of information provided by the Sellers. THE WINNING BID The winning bid in an auction will be the highest bid that exceeds any reserve (if a reserve exists). In the case of equal bids, the earliest bid received will be the winning bid. If a higher bid is subsequently withdrawn or removed then the auctioneer shall have the right to accept the next highest bid. NOTICE OF END OF SALE, PAYMENT & SHIPPING After the sale has ended; the auctioneer will notify the winning bidder via phone, fax or mail that they have won. If you do not receive notice that you have made the winning bid and think that you are the top bidder, you should check with the auctioneer directly. You will make all payment for Items to the auctioneer in accordance with their terms and conditions. BUYER'S PREMIUM, TAXES AND DUTIES If you are a successful bidder, you are responsible for paying any buyer's premium, taxes and duties (including any VAT, sales tax and import duties) that may be imposed on the final price paid for an Item. Accordingly, it is your responsibility to check the applicable taxes and duties that may be imposed on an Item prior to bidding for it. PRIVACY We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. COPYRIGHT All material and content as provided by the Service is protected by copyright and similar rights. You cannot use or make available any of that material for any commercial purpose. SPECIAL ADMONITIONS FOR INTERNATIONAL USE recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside. DISCLAIMER OF WARRANTIES You expressly understand and agree that: a. your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. Sebae expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. b. Sebae makes no warranty that (i) the service will meet your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the software will be corrected. c. Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. d. no advice or information, whether oral or written, obtained by you from Sebae or through or from the service shall create any warranty not expressly state in the TAC. LIMITATION OF LIABILITY You expressly understand and agree that Sebae shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Sebae has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service. EXCLUSIONS AND LIMITATIONS Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of the previous two sections titled 'Disclaimer of Warranties' and 'Limitation of Liability' may not apply to you. INDEMNITY you agree to indemnify and hold Sebae harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party. LEGAL COMPLIANCE You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service and your bidding on, listing, purchase, solicitation of offers to purchase, and sale of items. GENERAL INFORMATION The TAC constitute the entire agreement between you and Sebae and govern your use of the Service, superseding any prior agreements between you and Sebae. The TAC and the relationship between you and Sebae shall be governed by the laws of the State of Florida without regard to its conflict of law provisions. You and Sebae agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Marion, Florida. The failure of Sebae to exercise or enforce any right or provision of the TAC shall not constitute a waiver of such right or provision. If any provision of the TAC is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TAC remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TAC must be filed within one (1) year after such claim or cause of action arose or be forever barred.

We ask winners to pick up their items within 5 days (if invoice is unpaid) or 10 days (if invoice is paid) of auction closing. All sales are final and sold in as is condition. If not listed as functional in description, to be considered untested, buyer beware, sold as is.
Regular Office hours for items pick-up are as follows:
