Auction Format: Combined live auction and webcast auction with online pre-bid

Start Date:  Tue. Sept. 26 for pre-bid

End Date:  Sat. Sept. 30 for pre-bid, live and webcast

Preview Date: Fri. Sept. 22 from 10 am to 2 pm and Sat. Sept 30 at 9 am.

Removal Dates:  Sat. Sept 30 and Mon Oct. 2

Description: Auction Sale of Restaurant Equipment

This auction has live and online bidding available.  These are the terms and conditions you agree to before placing a bid.

Terms: All items sold As-Is, Where-Is with no returns accepted.  All sales are final.  Invoices must be paid for, and items picked up no later than the scheduled pickup date.  No exceptions.  Items not removed by this time will be considered forfeited/abandoned.  It is the buyer’s responsibility to load, and properly secure items purchased.

Registration:  Buyer must register prior to bidding at any auction sale and must be at least 18 years of age.  By registering, Buyer represents and warrants that all Buyer information is accurate and complete.  By registering, Buyer also agrees that Buyer has read and fully understands these terms and conditions and agrees to be bound thereby.  Atlantic Auctions reserves the right to deny any registered bidder at any time at its sole discretion without notification.

Inspection:  Buyer may inspect the items available for auction and are urged to do so on Friday, September 22 from 10 am to 2 pm and Saturday September 30 beginning at 9 am (before the live auction).  All sale are final so please attend the public inspection.  Atlantic Auctions will not package, palletize, crate, or ship any items.

Buyers Premium:  an 18% buyer’s premium will be added to each lot purchased.

Sales Tax:  Collected for this auction.  All sales are automatically charged the appropriate sales tax.

Pickup/Removal of Assets Purchased:  Bidders are responsible for their own removal.  Any item NOT picked up by the end of the scheduled pickup day will be considered abandoned.  Removal will be at the expense, liability, and risk of the purchaser.  Purchases will be released upon presentation of a paid receipt.  Please ensure that movers or anyone picking up items on your behalf have your paid receipt at the pickup location.  No items will be released without a paid receipt.  Bidder further agrees to be held personally responsible for all purchases made on their bidder number and agrees that bidder will not charge back items which are not picked up during pickup/removal times.  Atlantic Auctions will not package, palletize, crate, or ship any items.

Payment:  Payment in full on day of sale.  Cash, certified or cashiers checks are acceptable.  Payment by credit card (VISA, Mastercard and Discover) is also accepted.

Warranty & Condition of Items Sold:  All items are sold AS IS, WHERE IS, with no warranty expressed or implied.  Descriptions are believed to be accurate but not guaranteed.  Atlantic Auctions is not responsible for the correct description, authenticity, genuineness of, or defects in any lot and makes no warranty in connection therewith.  No allowance will be made, or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted.  Descriptions have been prepared for guide purposes only and shall not be relied upon by Buyer for accuracy or completeness.  No deduction will be allowed on damaged articles as all goods are exposed for public exhibition and are sold AS IS, WHERE IS and without recourse.  When you are not certain of the condition or use of an item please bid accordingly or not at all.  Buyers are solely responsible for inspecting items during the scheduled inspection times.  Unless otherwise stated in an item description no items have been tested for functionality. 

Non-delivery Responsibility:  All purchases are made at Buyer’s risk.  Atlantic Auctions shall not be responsible if all or any part of such purchases are lost, stolen, damaged or destroyed from any cause whatsoever.

Manner of Items Sold: Atlantic Auctions reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed.  Atlantic Auctions reserves the right to temporarily or permanently end an auction during the stated auction period or extend an auction without notification.  Atlantic Auctions also reserves the right to sell all of the items listed in bulk or to sell any and all items or lots prior to the auction.   

Deposit: A $1 authorization will be automatically placed on your credit card on file with Atlantic Auctions prior to your first bid.  An additional deposit may be requested for first time bidders and bidders whose bids exceed $1,000.

Technology:  Buyer acknowledges and agrees that the internet is an unreliable , unsecure, and error-prone network.  Regarding our online and webcast auctions, Atlantic Auctions cannot and does not guarantee continuous, uninterrupted, or secure access to the online bidding service provider or the Atlantic website or that Buyer information, including auction registration and bids will be transmitted and received in a timely fashion.  Buyer agrees that Atlantic Auctions assumes no liability or responsibility for the malfunction or failure of the use of technology.

Personal & Property Risk:  Persons attending during inspection or removal of goods assume all risk of damage of or loss to person or property, and specifically indemnify and hold harmless Atlantic Auctions, landlord and Seller from any and all damages, claims and liabilities injuries to persons or property of any type whatsoever.  Atlantic Auctions, landlord and Seller shall not be held liable by reason of any defect in or condition of the premises on which the assets are located.

Indemnification:  Buyer agrees to indemnify and hold harmless Atlantic and Seller from and against all claims and liabilities relating to the condition of or use of the articles purchased or failure of user to follow instructions, warnings, or recommendations of the manufacturer, or to comply with federal, state and local laws applicable to such articles or for proximate or consequential damages, costs or legal expenses arising therefrom.

Reserve:  Atlantic Auctions reserves the right to reject any and all bids.  On lots in which there is a reserve, Atlantic has the right to bid on behalf of the Seller.

Additional Terms:  These terms may be changed or modified by Atlantic Auctions at any time without notification and other terms may be added.
