1. REGISTRATION: Bidders must enter a valid Visa, MasterCard, Discover, or American Express card along with required contact information. There may be a $1.00 charge to your card for verification that will be refunded.
2. PICK UP DATE/TIME: Pickup Tuesday, Sept 12 from 1:00 PM - 5:00 PM. Other dates / times by appointment - we will work with you! Please contact us at 419-612-1908 if you need to make other pick-up arrangements.
3. BUYERS PREMIUM: A 15% Buyers Premium will be collected on ALL purchases.
4. SALES TAX: 7% Ohio sales tax applies to all in-state invoices unless you have furnished us with a Sales and Use Tax Unit Exemption Certificate.
5. PAYMENT: Please contact us PRIOR TO BIDDING for cash or card at pick-up option (no checks). Otherwise, your credit card on file will be automatically charged after the conclusion of the auction for the entire amount of your purchase. Please be sure to have an available balance on your credit card to cover your online purchases.
6. REMOVAL: This is an ONLINE ONLY AUCTION. Please note pick-up day / time. If you are unable to make the scheduled pick-up, please contact us at 419-612-1908 or consider the shipping option. Purchases will be released upon presentation of a paid email receipt. Please insure that you, or anyone picking up items on your behalf, have your paid receipt at the pickup location. All Buyers accept that pickup may be electronically recorded and monitored. Unless other arrangements have been made before the close of scheduled pick-up time, items left may be considered abandoned and the amount of your purchase surrendered as a removal fee up to the total amount of your purchase for disposal of your item(s). NO REFUNDS OR CHARGEBACK'S WILL BE GRANTED.
7. SHIPPING: USPS / UPS shipping is available for all items, unless otherwise noted in the lot listing. Please refer to the Shipping / Pick-up details for more info.
8. RESERVE AUCTION: All online auctions presented by Heritage Hills Online are "Reserve" auctions. Therefore, the company reserves the right to change, modify, add to or delete any lot descriptions or photos; remove items from the sale; split or combine lots; add minimum bids or reserve prices; cancel, suspend, extend or reschedule an individual item and / or auction event; change auction closing time, inspection, or removal times; rescind the sale of any or all items regardless of high bid upon auction conclusion; suspend or cancel the bidding of any buyer at any time.
9. AUCTION DESCRIPTION: All items are sold "AS IS, WHERE IS", with NO WARRANTY expressed or implied. Please inspect the lot numbers, read the descriptions and EXAMINE THE PHOTOS CAREFULLY. Colors and sharpness of the photos may vary from screen to screen. Descriptions are accurate to the best of staff ability. Condition reports are a courtesy and are an opinion. The absence of a descriptive condition report does not mean the item is free from defects. It is the bidder's responsibility to determine the condition and suitability of each lot for their own use or purpose. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. Unless otherwise noted, any items used for display or perspective purposes in the photos are not included with the lot.
10. BIDDING PROCEDURE: Bidding is open! Please be sure of your bid amount prior to submitting your bid. We will not reverse bids. If you are immediately outbid when you place your bids, then you are likely bidding against a Maximum Bid placed by another customer. Buyers use maximum bids as they have seen the convenience of this feature and do not want to risk missing the opportunity of winning the lot by placing only real time bids on items during closing. While the auction is closing, click on the FLASHING LIVE CATALOG link to see the lots closing in order with auto refreshing.
11. AUCTION CLOSING / AUTO-EXTEND: The online auction closes at a rate of one item every 30 seconds and uses the auto-extend (soft close) feature to prevent sniping. If a bid is placed within the last minute of an items closing time, that item will extend two minutes as to allow a bidder that has been outbid the chance to bid again and this function will repeat until no bid has been placed within the last minute. If you have been outbid, you will be notified by email up to the time that the auction begins to "close".
13. WINNING BIDDER NOTIFICATION: You will be contacted by email ONLY (you are responsible for checking your email). If you do not receive a paid email invoice, then you did not win any items at the online auction. If you feel you have won an item and have not received an email, you must notify us at 419-612-1908 no later than 5 PM the next day.
14. NON-DELIVERY: In the event an item is not available for pickup, the buyer must notify our onsite staff and file a claim by replying to your original emailed invoice noting what was not available within 24 hours of the pickup date. After 24 hours, the buyer agrees that there are no grounds to claim non-delivery of item.
15. DAMAGE: Any damage caused by a buyer during the preview, or during the period of removal is at the expense of the Buyer, and they will be held liable for any damages.
16. LIABILITY: Buyer assumes and does agree to indemnify and hold Heritage Hills and it's consignors harmless from any future claim that shall pertain to the fitness or use of the asset being purchased. Additionally, all Persons attending preview or during removal of goods assume all risks of damage or loss to person and property while onsite.
17. INTERNET OUTAGE: Heritage Hills Online is not responsible for technical or communication problems, website outages, browser incompatibility or any connectivity issues. In the event of an internet outage that would affect the auction during closing of lots, Heritage Hills Online reserves the right to suspend and resume the auction at a later time or date.
18. BUYERS AGREEMENT: Buyers assert that then have reviewed and agree to all terms and conditions of this auction, and acknowledge their registration is an enforceable and binding electronic agreement. Terms and conditions are designed as general guidelines and may not cover every possible scenario. These terms and conditions and their interpretations shall be governed by the laws of the State of Ohio. Auctions with ONLINE ONLY bidding are not subject to the Auction Statute 4707 and are not under the supervision of the Department of Agriculture.
