Listing Terms and Conditions
Subject to the following Zoning, Variance, Special Use Permits • The property is currently zoned AG-1 with a Special Use Permit filed currently authorizing drying, processing and selling seed corn on the subject property (case 533-S-85). • Tract 1 will require the new owner to apply for and receive a new and specific special use permit, file a variance, OR proceed with a zoning map amendment changing the property zoning to a B-1 Rural Trade or B-2 Neighborhood Business. • Tract 2 will remain and be transferred to the new owner as AG-1. • In the event that the tracts sell together in combination, the buyer will need to apply for and receive a new and specific special use permit for the property, file a variance, OR proceed with a zoning map amendment changing the property zoning to a B-1 Rural Trade or B-2 Neighborhood Business. • The buyer will have 90 days to complete any and all necessary zoning, permits, or variance processes AND close the transaction. Upon written request a one time 30 day extension shall be granted should it be needed to complete the approval process outlined by the Champaign County Dept. of Planning & Zoning. Any new zoning approval is not necessarily guaranteed – contact the Department of Planning and Zoning for more information. Tract 1 is exempt from the above if the buyer is a farmer or planned use of the buildings is for agricultural equipment storage. • Real estate shall sell subject to owners’ approval. • 10% earnest money deposit due within 24hrs of auction with balance due within 90 days.
