- AUCTION: You are bidding on items on auction. This is not retail. If you are the winning bidder, payment is required, and there are no returns.
- HOW DO I PAY FOR MY ITEM? Payment must be made with credit card. If the item is greater than $1,000, then certified funds are required. After the auction has concluded, Arling Auctioneers will send an invoice via email to your email that you have provided. Within that invoice, there is a link to make payment for your items. If you do not receive an invoice within 12 hours post auction, please check your junk/spam email folder. If it is not in those folders, please contact the Auction Company.
- DURING PAYMENT, ARE THERE CREDIT CARD FEES? Yes. Credit cards are not free to process. You, the buyer, will pay the applicable credit card fees during the payment process (2-4%).
- HOW DO I GET MY ITEM? After conclusion of the auction, Arling Auctioneers LLC. will send an email to your email that you have provided, as well as a text message to the phone number that you have provided. These are duplicate messages. Within each message is a link to schedule a pickup time on June 6 or 7, at the specified location. You are required to bring adequate manpower to remove your items, as Arling Auctioneers LLC does not provide loading assistance.
- WHERE DO I GET MY ITEM? You will pick your item up from the location provided within the Item Pickup email/text that you will receive after the auction has concluded.
- CAN I HAVE MY ITEM SHIPPED? It is up to you. You, the buyer, are responsible for arranging shipping of your purchase. If you are struggling to arrange proper shipping, Arling Auctioneers LLC. Does have a shipping company that can handle the task, and we would be happy to provide you their contact information, just ask.
- WHAT IS THE BUYERS PREMIUM? 5.0% (Online Only. No B.P. for live on-site bidders)
- WHAT IS A BUYERS PREMIUM? It is an advertised percentage of the high bid or flat fee added to the high bid and become part of the purchase amount at settlement.
Any statements made day of sale supersede prior statements or advertisements.
Each auction lot will be sold one at a time and in sequential order. This is a LIVE SIMULCAST auction. Lot closings will be when the auctioneer declares the item “SOLD”. If a bid is placed as the auctioneer states “SOLD”, it is the sole discretion of the Auctioneer to determine if a lot will be opened back up, or if the sale is final. In the event of any website malfunctions, or technical difficulties on our end, the Auctioneer will determine if the auction will be paused until recovery, or if the auction will continue by selling lots sequentially to live on-site bidders.
LIVE IN PERSON BIDDERS, WE DO NOT PROVIDE LOADING ASSISTANCE! Before bidding be sure to have brought plenty of help to remove your items. You are responsible to furnish ALL labor, carts/dollies and packaging materials. If you are unable to secure the labor or proper equipment for removal at the noted time and location then PLEASE-DO NOT BID!!! Please respect our guidelines and our staff’s time.
*BUYER’S PREMIUM: A buyers premium will be charged to online purchases ONLY. No buyers premium for on-site live bidders. A 5.0% online buyer’s premium will be charged on each online purchase... A buyer’s premium, an advertised percentage of the high bid or flat fee added to the high bid, will be added to the high bid and become part of the purchase amount at settlement. The buyer’s premium will include the Auctioneers online service charge as well as any applicable credit card fees. Buyer agrees to these provisions and will pay the applicable buyer’s premium.
Sales Tax: This auction is an estate. In the state of Ohio, as such, all items being sold are exempt.
Payment:
Buyer specifically waves the right to dispute or deny payment for any purchases made with a credit card. Credit card chargebacks are NOT ALLOWED.
An invoice will be sent to your registered email address following conclusion of the sale. If you do not receive an invoice, please contact the Auction Company. Payment will be required no later than 48 hours after receipt of invoice.
Accepted forms of payment for live on-site buyers are: cash, check, certified funds, or credit card. Accepted forms of payment for internet buyers are: certified funds (wire transfer), or credit card. Credit card purchases will be accepted up to a $1,000 limit. Large ticket purchases over $1,000.00, MUST be settled for with wire transfer. Buyer will be responsible for paying applicable wire transfer fees. No item will be released or transferred until payment has posted to our account.
Basic Auction Terms & Conditions:
Arling Auctioneers LLC. retains the right to govern goods and services sold to clients and to maintain the level and integrity of our business. Arling Auctioneers LLC. has the right to terminate the auction at any time; withdrawal from sale of any item; to sell at this auction items not listed; to group one of more lots into one or more selling lots or to subdivide into two lots or more selling lots. The auction company also reserves the right to sell all of the items listed in bulk.
No Liability:
a) Arling Auctioneers LLC. assumes no liability for your purchases. The buyer assumes and does agree to indemnify and hold the auction company and seller harmless from any future claim that shall pertain to fitness or use of the asset being purchased. b) Persons attending during exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the Auction Company from liability therefore. Neither the Auction Company nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held.
Bidders:
a) All bidders must register for bidder's numbers using proper ID or proper information.
b) Any employee of Arling Auctioneers LLC. may bid at any auction if they wish to purchase an item.
c) All items become the sole responsibility of the purchaser when the auctioneer confirms your bid as the successful winner. We are not responsible for lost or stolen items.
Loss of Bidding Privileges:
a) If you have failed to pay for an item, or failed to timely pick-up items, your bidding privileges will be revoked. Your privileges may be restored by paying for the item or repaying for the loss of the revenue due to the items not having been sold and by placing a credit card on permanent file whereby future purchases will automatically be charged. You will only be given this chance one time. Repeated tardiness, or nonpayment will result in permanent denied bidding privileges.
Delinquent Accounts:
a) The bidder that has not paid for or has not removed their items from the auction site, will be subject to the cost of storage, trucking, re-sale, deficiency balances, collection fees, and any legal fees for recouping a loss due to the bidder's negligence.
Reserves:
a) Any and all items that Arling Auctioneers LLC. agrees to sell are subject to a reserve as per Ohio Revised Code Section: 4707.
Compliance with the Terms of Sale:
a) In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. b) Arling Auctioneers LLC. is in complete accordance with Ohio statutes and Ohio Revised Code.
Warranties: a) Everything is sold “AS IS/WHERE IS” with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final.
Conditions of Items Sold:
a) All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “as is” and without recourse.
Arling Auctioneers LLC. requires any and all buyers to preview and make your own opinion of conditions.
Bidder Registration:
Bidders must be 18 years of age or older, and are required to register for the auction. In registration, Bidder must submit information found to be current, complete, and accurate for proper identification. Auctioneer does not sell or rent this information. Auctioneer uses email mailing lists to notify customers about online and live auctions. Customers who do not wish to be notified should contact the office of the Auctioneer and request removal from the email mailing list. Bidder is responsible for security of his/her bidding number/user name and password, and any and all bids placed under the assigned number-ID. Auctioneer should be notified immediately if Bidder believes number and/or password have been compromised. Auctioneer reserves the right to terminate registration, deny any person for any reason permission or access to bid, to reject any and all bids, and to suspend or ban Bidder from bidding, at Auctioneers sole discretion. Bidder registration is not transferable or assignable.
Online Bidding Information:
Bidder acknowledges that hardware malfunctions, software malfunctions, viruses, and similar issues do occur and are beyond the knowledge, scope, and control of Auctioneer. We are NOT responsible for your system malfunctions, connection to the internet or your e-mail client stopping any of our e-mails to you in regard to bid confirmations and or outbid notifications.
