READ CAREFULLY BEFORE YOU ATTEMPT TO BID. Once you bid, you will be bound legally by the following terms and rules that are stated here.
1. ALL items are offered "AS IS, WHERE IS" with no warranty or guarantees, expressed or implied, by the consignor or Burke Auction Service, LLC, and ALL SALES ARE FINAL.
2. Burke Auction Company gives no warranties or guarantees as to any descriptions made on any item at any time. Items are described as accurately as possible, but do not represent any guarantee by the consignor or Burke Auction Service. Lighting, surroundings, and other factors can affect the perception of an item in a photo.
3. ALL bidders are strongly recommended/Encouraged to complete their own personal inspection of the item(s) before placing a bid. It is the responsibility of the buyer to examine the item and determine worth, condition, age, genuineness, value or any other determinative factor before they bid. Absolutely no returns, Buyers shall rely entirely on their own inspection and information.
4. By placing a bid, the bidder agrees that they have inspected the item to their satisfaction.
5. Bidders accept all auction items/property "WITH ALL FAULTS", whether or not immediately apparent.
6. NOTICE! Loading is the buyers responsibility (Furniture, appliances, etc, any item over 30lbs). Burke Auction Service employees will not load or remove your items. If assistance is needed there will be a $20 (cash) per item surcharge payable to to the staff who assisted you. Burke Auction employeeswill still assist in locating and gathering any small items under 30lbs.
7. We can ship your items. Shipping is at buyers expense, we ship USPS and UPS. Packing is charged at $1 per minute with a $6.00 per package minimum, plus box, packing and shipping label charge, Large, bulky, or fragile items are very expensive to ship. We DO NOT ship to PO BOX. We also DO NOT ship fragile items, coins, or jewelry.
8. Upon the award of bid, title and risk of loss, damage to or destruction of the purchased item, passes to the purchaser and the auctioneer shall have no liability whatsoever for any damage to or destruction of any such item.
9. No items may be removed until settled for in the manner announced. All items must be removed within the time announced in terms of sale unless prior arrangements have been made. Any Items not removed at the allotted time, unless arrangements have been made and agreed upon by Burke Auction, will be considered forfeited merchandise and will become the possession and property of Burke Auction.
10. All rights, privileges, and powers reserved or granted to auctioneer in these Terms of Sale shall be deemed reserved and granted to auctioneer's employees, advertising representative, and all owners for whom the items are being sold.
11. Online bidding is a provided service and bidders understand and acknowledge that this service may not function properly. The auction company reserves the right to pause, postpone, or cancel the auction if complications or circumstances out of our control occur.
12. By placing a bid, the bidder acknowledges that they have received, read, and understands and agrees to be bound by the terms and conditions of the auction.
Terms for Long Guns if on auction:
-Be 18 yrs old or older for long gun.
-Pay $25 transfer fee to our FFL representative.
-Either have a IA purchase permit or IA carry and conceal and/or pass a NICS Background check.
-For buyers out of state no shipping available.
