The Seller, or any of the Seller’s agents or employees, or HIT Auctions LLC or any of its agents or employees, shall not be liable to the Buyer or to Buyer’s agents, employees, contractors, or any other persons or entities acting on their behalf in connection with such removal of the Property, for any loss, damage, personal injury or death, of any kind or character to them arising either from the use of the property of the Seller pursuant to the License granted herein, or caused by any alleged defect or condition in any building, structure, equipment or facility, or any condition on the land of the Seller, any of which are alleged to be the cause of or contributing to the aforementioned loss, damage or personal injury or death. In addition, the Buyer agrees to indemnify and hold harmless Seller and HIT Auctions LLC and their respective agents, servants and employees of and from any and all liability for any loss, damage, expenses, personal injury or death of any person or persons arising out of, or relating to the removal of the above described Property.
