AZTEC NEW MEXICO: Bankruptcy Auction for the Estate of Samson Blue
Absolute Auction: Selling to the Highest Bidder- No Minimums, No Reserves - may be subject to back taxes due at time of closing, see below tax disclaimer
Bidding Registration: Online bidder hereby agrees that they must properly register for this online auction by:
● Complete and sign the Online Auction Terms and Conditions
● Complete and sign the Bidder Registration Form
● Submit and Initial Bid Form
● If working with a Buyer Agent- submit agent signed Broker Participation Agreement
Buyer’s Premium: A 10% Buyer’s Premium will be added to final bid and included in total Contract Price.
Purchase Contract: Winning bidder hereby agrees to enter into an Auction Buy/Sell Contract to Purchase the property(s) immediately upon being declared the Winning Bidder by the Auctioneer. Upon the close of the auction the winning bidder will be forwarded via email an Auction Buy/Sell Contract to Purchase the Property(s) for electronic signature. Purchase Contract must be signed and returned, along with earnest money deposit, no later than 24 hours from being declared the Winning Bidder
Earnest Money Deposit: Upon being declared the Winning Bidder an earnest money deposit of Ten Percent (10%), of the total Contract Purchase Price (which includes the Buyer’s Premium), must be be wire transferred, or hand delivered in the form of a Cashier’s Check, to San Juan County Abstract and Title Company. Wire Transfer Instructions will be emailed to the winning bidder and verified through a phone call.
Closing: Closing shall be on or before April 16, 2023. Out of state buyers will be afforded the opportunity to close via email, mail and wire transfer of certified funds.
Title Insurance: A Special Warranty Deed will be supplied by the Seller at the Seller’s expense giving marketable title subject to restrictions of record (located in the Property Information Package (PIP) located on Company website). Title Insurance will be at the Buyer’s expense.
Property Taxes: The property taxes will be paid from the sale proceeds at closing, if there are sufficient sales proceeds to pay the taxes. If not, the sales proceeds will pay commissions, closing costs in full and taxes to the extent possible. The Buyer will be responsible for the balance of any property taxes still due a time of closing. A copy of the back taxes have been provided to all Registered Bidders (located in the Property Information Package (PIP) located on Company website)
Easements and Oil and Gas Leases: The sale of the property(s) is subject to any and all easements and oil and gas leases of record.
Sold Subject to Unlawful Occupants: It is the sole responsibility for Buyer to be aware and verify that there may be unlawful occupants and are buying properties subject to. It is the responsibility of the Buyer/New Owner to follow through with any eviction proceedings necessary to remove such occupants.
Survey: Sellers are not required to provide a survey of the property. If the buyer desires a survey, it shall be at the buyer’s sole expense.
New Mexico Gross Receipts Tax (“GRT”): Buyer to pay the GRT in the amount of TBD of the commission or Buyer’s Premium
No Financing Contingency: By participating in this auction, bidders hereby agree that their bid shall NOT be subject to the bidder’s ability to obtain financing and there are no financing contingencies. We encourage you to have a full written approval before bidding. The balance is due in cash or new loan at closing within 30 days.
Property Information Package: A package of information has been assembled for this property and may include; disclosures, title documentation, back taxes, oil leases and easements of record, surveys, inspection reports, etc.
Property Previews: Public Previews are scheduled on specific dates and times. It is highly recommended that all bidders personally inspect the property prior to placing any bids in the auction. Property inspections are the sole responsibility of the bidders.
Conduct of Auction: Conduct of auction and bidding increments are at the discretion of Prestige Auction Real Estate Auction. Prestige Auction Real Estate Auction reserves the right to deny any person admittance to the auction.
