**ONLINE AUCTION**
-This is an online only auction. All bidding will be taking place online. Buyers must register via www.greinerrealestate.hibid.com to bid. Credit or debit card information is required and a $1.00 refundable authorization will be applied to make sure bidder is legitimate. Additionally, please email a copy of your driver's license to jody@greinerrealestate.com or text a photo to 641-919-9702. We will provide an exemption to the driver's license requirement if you have prior approval from Greiner Real Estate & Auction.
-Auction begins on March 1, 2023 at 7:00 a.m. and will end at 10:00 a.m. March 15, 2023. There will be a "soft close" meaning that 3 minutes prior to the end time, a timer will start and if any other bids are submitted within those 3 minutes, the clock restarts for another 3 minutes. This will continue on until no bids are submitted in the 3 minutes since the last bid.
-When using our online auction services you are making afirm commitmentto purchase said item(s) and are entering into a legal and binding contract. Bids may not be cancelled or retracted for any reason.
-Non-payingbidders orfraudulentbidding will subject you to legal recourse and possible criminal charges including any fraud and/or interstate commerce violations.
**AS-IS**
-The property is being sold "as is, where is" with no financing or inspection contingencies and buyers should have made arrangements prior to bidding at this auction. It is highly recommended that each potential buyer takes the time to personally inspect the property prior to auction. The Purchaser should be satisfied with the location and condition of the property, and all descriptions thereof, before bidding.
-The information in this brochure and all promotional materials is deemed reliable; however, no guarantee for its accuracy, errors or omissions is given. All lines drawn on maps, photographs, etc. are approximate. CSR values are derived from Surety Maps and may or may not reflect the values provided by the county assessor's office. Buyers should verify the information to their satisfaction.Neither the seller or the auction company makes any guarantee or warranty as to the accuracy or completeness of such information.
**AUCTION CLOSE**
-Ten (10%) percent of the bid price is due on the day of the auction, with the balance due at closing upon delivery of deed and abstract showing merchantable title. Immediately following the auction, the successful bidder shall enter into a written agreement with the seller.
-The execution of the contract shall take place through email and electronic document signature -OR- by written contract in person the day of auction close.
-Acceptable forms of payment:
-Bank Wire Transfer; please call for wire instructions to be emailed to you.
-Check delivery to Craig Davis's office in Washington.
**ADDITIONAL PROVISIONS**
-METHOD OF SALE: The farm will be sold on a price per acre basis. The multiplier for bidding will be 89 times the per acre bid.
-PURCHASE AGREEMENT: Successful bidder shall execute a purchase agreement immediately after being declared the winning bidder by the auctioneer. Please note: The purchase agreement will offer -NO contingencies for financing or any alterations to the agreement. Purchasers who are unable to close due to insufficient funds or otherwise, will be in default and the deposit money will be forfeited.
-TAXES: Prorated to date of possession based on the last available tax statement.
-CLOSING: On or before May 1, 2023
-POSSESSION: At closing. Buyer will be given farming rights for the 2023 crop season.
-The buyer shall be responsible for installing his/her own entrances if needed or desired.
-If future site clean-up is required it shall be at the expense of the buyer.
**INTERNET RISK**
-All Greiner Real Estate & Auction LLC "online auctions" are "Reserve" auctions. Therefore the auction company reserves the right to establish or change bidding increments, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an individual item and or auction event. Suspend or cancel the bidding of any buyer at any time. Change, modify, delete or add to descriptions, photos. Change auction closing time, inspection or removal times. Rescind the sale of any or all items regardless of high bid upon auction conclusion. Greiner Real Estate & Auction LLC permits the registration and bidding of any party as long as they meet the registration requirements and terms and condition including sellers, members, owners, employees and associates of Greiner Real Estate & Auction LLC. The auction company is not responsible for technical or communication problems, website outages, browser incompatibility or any connectivity issues. Neither the company providing the software nor the real estate and auction company shall be held responsible for a missed bid or the failure of the software to function properly for any reason.
**Agents for Sellers**
Greiner Real Estate & Auction. and its Employees act merely as agents for sellers. All auctions are with reserve unless specifically stated otherwise. Auctions are with undisclosed reserves unless advertised otherwise as "Absolute." Auctioneers, at their discretion, may place a reserve bid on behalf of the seller. All final bids are subject to the seller's confirmation. Only the top bidder will be contacted as to the status of his/her bid.
