This is an online only auction, no live auction will be held. All items sell as is, where is with any and all faults or flaws. Items sell with no warranty stated or implied. Items have not been tested by the auction company unless it is stated in the item description. An item listed as "runs and drives" only means the item's engine started and drove forward and backward on our yard and was not tested by our company in an extensive manor. If there are obvious mechanical flaws we may point them out if we see them, but we do not test every function of every item. Bidders are strongly encouraged to come test and inspect the items themselves. Bids once placed cannot be retracted! Please read all descriptions and make sure you are prepared to complete the transaction before placing any bids! AUCTION CLOSING: The auction will begin closing at 6:00 PM Central Time on Monday, February 6th, 2023. The first item will begin to close at 6:00 PM Central time and an item will close every 30 seconds after that. The closing time of a lot will be automatically extended by 2 minutes whenever a bid is placed within the last 2 minutes on that lot. CLOSE GROUPS/LINKED LOTS: Some items in this auction are part of a closing group. Items in a closing group can be identified by the words "Close Group #" shown on the lot tile of that item in the catalog. At the close of auction the clocks on the lots in close groups will extend together, if extended bidding occurs on any of those lots in the group to allow bidders to bid on any of the lots during the close. None of the lots in the close group will close until all lots in the close group stop receiving bids. This is very similar to selling "choice" in a live auction. For you as a bidder, a close group can help you when you are interested in one of several items that are in a close group by allowing you to bid aggressively on the item in that group you like the most. Once you've exceeded the most you want to pay for the item in the group you like the most, you can then shift your bidding to one of the other items in the same group if you choose to as the bidding will still be open on the other items in the group. ITEM PREVIEW DAYS: Bidders will be able to inspect and view items at 4177 HWY V V, Berger, MO 63014 on: Monday through Friday from 8-4 while the auction is open for bidding Saturdays from 8-noon while the auction is open for bidding It is highly recommended that bidders preview the items in person. Winning bidders may pick their items up on: February 8th through 10th from 8 AM until 5 PM Saturday, February 11th from 8 AM until 2 PM February 13th through 17th 8 AM until 4 PM No load outs will be done on Tuesday, February 7th. Reasonable alternate pick-up arrangements can be made with the auction company by calling 573-834-2207 or 573-291-8075. NO SUNDAY LOAD OUTS. ALL ITEMS MUST BE REMOVED WITHIN 20 DAYS OF THE CLOSE OF THE AUCTION! Any items still in our yard after 20 days from the close of auction will incur a $20 per day storage charge per item. Any items still in our yard by the beginning of the next auction will be automatically re-consigned to the next auction regardless of payment status. ITEM PICK-UP LOCATION: 4177 HWY V V, Berger, MO 63014, auction company will have forklifts on site to assist buyers with loading. Please note that we also have a 48" tall dock and a 30" tall dock. BUYER'S PREMIUM: a 3.5% buyer's premium will be added to each purchase. Example: If you bid $100.00, you will be charged $103.50 at check out. PAYMENT: We do not automatically charge your card on file (if you have one on file). Items must absolutely be paid for within 7 days of the close of the auction, no exceptions. Accepted forms of payment include: New bidders (bidders that have not purchased from us before) that spend over $5,000 must pay by bank wire transfer or cash. We will email you our bank wire transfer information the morning after the auction. Visa, MasterCard, Discover or American Express (with a 3% convenience fee). We do not accept credit or debit cards on transactions over $5,000 from new customers. Personal or business check. Checks over $5,000 are not accepted from new bidders. Bank wire transfer Cash Payment must be made when items are picked up or before you send your shipper. Title & possession of auction items does not pass to bidder until item/items are paid for in full according to our payment terms above. SALES TAX: Some items being sold in this auction (items that do not qualify for the agriculture sales tax exemption) require sales tax of 6.975% to be charged and will be noted as such in their description. Titled vehicles may require sales tax to be charged at the time of registration in the buyer's licensing jurisdiction. Sellers of items in this auction are strictly prohibited from bidding on their own items or having someone else bid on or buy back their items. If Seller attempts to bid on or buy back their own items or colludes with someone else to run up the price, the Auction Company has the right to void the bids placed. In addition, the rate of commission for all the Seller’s items in the auction will double, and the Seller (along with anyone colluding with the Seller) will be prohibited from doing business with Schneider Auctioneers LLC as a buyer or seller in all future auctions. At the Auction Companies discretion, it may decide to remove all of Seller’s items from the auction. WARRANTY & CONDITION OF ITEMS SOLD: All items are sold 'AS IS, WHERE IS, with NO WARRANTY expressed or implied. It is the responsibility of the buyer to determine the condition of the items and bid accordingly. Descriptions are believed to be accurate but not guaranteed. When you are not certain of the condition or use of an item please bid accordingly. CATALOG DISCREPANCIES: You are bidding on the described item not the photograph, occasionally the wrong photo may be displayed, always read the item description. The Auction Company reserves the right to add or remove items from the auction. The Auction Company reserves the right to cancel, suspend, extend or reschedule an individual item and or an entire auction event or to make changes to the auction closing times or inspection or removal times. The Auction Company reserves the right to privately disclose to competing bidders who the competing or winning bidder was on a specific lot or lots if they request that information, but only after the auction has ended. In the event a winning bidder does not pick up their items on the advertised pickup dates or make arrangements for payment by the end of the last pick up day the Auction Company has the right to sell the items to a back up bidder if they choose. Additionally, the Auction Company may at their discretion permanently ban the non paying bidder from doing business with Schneider Auctioneers LLC in all future auctions. Miscellaneous: All decisions of the Auction Company are final as to the methods of bidding, disputes among bidders, increments of bidding and any other matters that may arise before, during, or after the auction. Auction Company reserves the right to deny any person the right to participate in the auction for any reason, or to ban anyone from the auction who attempts to disrupt it. Personal and property risk: Persons attending during preview, sale or removal of goods assume all risks of damage of or loss to person(s) and property and specifically release and hold harmless the Auction Company, Auction Staff and Seller from liability or other recourse, therefore neither the Auction Company, nor the Seller shall be liable by reason of any defect in or condition of the premises on which the sale is held. Auction Company at their discretion may ban any bidders from participating in this or future auctions that do not abide by these terms and conditions or is a detriment to the auction process in any way. Server & Software Technical Issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Schneider Auctioneers, LLC reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR SCHNEIDER AUCTIONEERS, LLC SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON.
