BIDDING NOTICE: This is an Online - Internet Only Timed Auction. All bidding activity will take place online. Shipping all items, no local pick-up. Terms & Conditions; STRATFORD GOLD & SILVER LLC (i.e.; SGS) A Bidder's Bid, at all times, represents an irrevocable offer by the bidder to enter into a binding contract to purchase the lot in accordance with the specific provisions of the listing and these general terms and conditions, as applicable, even if a higher bid was received by SGS. In the event that any reserve price of a lot is not exceeded by any bidder's bid, SGS, at its sole discretion, with or without the knowledge of or notice to any bidder, may reduce any reserve price to an amount below the bid of the bidder at any time during an auction and accept the bid made by the bidder. Reserve prices are confidential information of SGS and are not always disclosed to bidders unless specifically stated as such during bidding. Nothing contained in any listing shall be construed to disclose any reserve price unless otherwise stated. In the placing of any bid, the bidder understands and agrees that the bid, once accepted by SGS, will be the winning bid if there is no higher bid by another bidder and if any reserve or reduced reserve on the lot is exceeded by the bid. All bids are binding, irrevocable, and non-cancelable by the bidder. SGS has final discretion on the sale of a lot. All sales are final. The decisions of SGS are final. In the unlikely event that we lose our internet connection, SGS reserves the right, at its sole and absolute discretion, to cancel the remainder of the auction. PAYMENT: All payments shall be performed via CurrencyPay via most major credit cards. Once a bidder wins an item or items, they will receive an Invoice asking them to pay the full amount by following the link provided. No Personal Checks, Money Orders, or Cashiers' Checks are allowed, as these types of payments have to be mailed, received, then cleared by the banks before the release of funds occurs, causing large delays to all parties involved. ACH or Wire Transfers will be required for any invoice totaling $600 or more for all new SGS Auction bidders, or a bidder with a low Bidder Score. Notification will be presented to clarify payment options available per sale. Any charge-backs or credit card disputes will be logged into the auctioneer's system and reported throughout the country for all other auctioneers to view. In summary; if you don't plan to fully purchase the item, don't bid. SHIPPING & HANDLING All shipping & handling is performed in-house by SGS. No local pick-up options are available at this time. Shipping & Handling Fees are generally shown within the invoice received. Once payment has been received within the accounting system, those funds are not released for up to 48 hours. Once payments are cleared, the shipment should occur within 3 business days. IMPORTANT NOTE; To prevent any degree of loss, by either party, all items with a value over $100 will be shipped fully insured, with a delivery confirmation signature required. SGS will always strive to keep this cost to a minimum. Terms Buyer's Premium is set at 15.0% Buyers must pre-qualify to bid using a valid credit card. This card may be charged automatically once a buyer has been awarded an item (if that value does not exceed $600.00). All invoices totaling $600 or more may require an ACH or Wire Transfer. Returns: Before bidding, understand that all items are sold "as-is", without any form of expressed or implied warranty. SGS can not guarantee the level of grading provided by any 3rd party such as NGC, PCGS, ANACS, IGC, etc. Bidder specifically waives any claim to the right of return of any item because of the opinion, determination, or certification, or lack thereof, by any grading services. Third-party graded bank notes are not returnable for any reason whatsoever. Bidders are advised that certain types of plastic may react with a coin's metal or transfer plasticizer to bank notes and may cause damage. Caution should be used to avoid storage in materials that are not inert. For any/all SGS-approved "Returns", the buyer must pay all shipping costs associated with the return, including any insurance, postage, restocking, or handling fee/s. Once the item has been received by SGS in the same condition it was sold, the purchaser's funds will be returned (less any fees expressed above). Any grading or authentication by any third party, including any statements made on certificates of authenticity, grading certificates, valuation certificates, certificates of appraisal, gemological laboratory reports, or any similar reports or valuations are exclusively the opinions of the authors and are not the opinions or statements of SGS. Bidder understands that SGS has not verified any such statements or opinions and does not warrant their accuracy. Bidder relies exclusively on Bidder's own investigation and information and assumes all risk of any inaccuracy in statements or opinions expressed by others. Agreement Not to Dispute Credit Card Charges Bidder agrees that upon processing a credit card, debit card, or other bank cards, such payment shall be immediate and irrevocable, and Bidder shall not dispute, challenge, issue a "Chargeback" or reverse any such payment or charge. Governing Law and Venue: This Agreement and the rights of the Parties shall be governed by and construed in accordance with the laws of the State of Kentucky without the application of any conflict of law principles that would require or permit the application of the laws of any other jurisdiction. Any action at law or judicial proceeding instituted by any Party relating to this Agreement shall be instituted and maintained only in the state or federal courts in Shelby County, Kentucky. This Online Only auction requires that all invoices (including shipping & handling) are paid within two days of the auction closing. The name and address on the credit card must match the name and address on the account. SGS does not accept credit card payments over the phone. If you need to change your payment method after the auction date you will be required to mail a cashier's check or pay by ACH or Wire Transfer. 2. Everything will be sold "as is, where is", with no guarantees of any kind, regardless of the statement of condition made by all others. Buyers shall rely entirely on their own inspection and information. Statements on Certificate(s), Authenticity, Grading Certificates, Valuation Certificates, Certificates of Appraisal, Gemological Lab Reports, and the like (collectively referred to herein as COA) are the opinion of the company or entity which issued the COA and not those of SGS. The information contained on the COA is added to the written descriptions of items solely as an attempt to fully disclose any information accompanying the item, and in no way constitutes a guarantee of the validity of the information on the COA. The bidder's sole responsibility is to verify the claims made on said COA before placing any bids on that item. When placing bids on item(s) accompanied by COA(s) it is the sole responsibility of the bidder to research the company or entity which issued the COA and base bidding activity on the strength of the reputation of the company which issued the COA(s). No refunds will be given due to disputes over the validity of information contained on COA(s). 3. Grading and authentication is not an exact science, and it is possible that two people do not always grade or evaluate the same item alike. Any stated grade or condition or estimated value represents the opinion of the third-party professional whose opinion is quoted in the item(s) description. Lots that are accompanied by a Certificate of Authenticity from a third-party authenticator are not eligible for return. Absolutely no exceptions will be made regarding this policy. Given the opinionative nature of autograph authentication, autographed items that are accompanied by the Third-Party Authentication(s) listed with a lot represent the opinion of the third-party professional, and no further warranties or guarantees of opinion from outside authenticators, or so-called "experts", is being implied or guaranteed in any way. LOTS MAY NOT BE RETURNED BASED ON A DIFFERENCE OF OPINION IN GRADING OR AUTHENTICATION. It is ultimately the Bidder's responsibility to arrive at a final conclusion on their level of satisfaction with authenticity PRIOR to bidding. Please do not bid on a lot if you are not comfortable with the stated authentication(s) that accompany a lot. 4. Every effort is made to "guard" merchandise throughout the auction; however, the bidder becomes solely responsible for all items purchased, immediately following their winning bid. Therefore, the bidder is advised to further guard his items by paying properly so the item can ship. 5. The Bidder is responsible for knowing which item he is bidding on. If he is unsure, he should inquire or not bid. When you become the winning bidder at auction you are bound by this contract and expected to pay for items in which you were evidenced to be the successful bidder. SGS reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the seller. Also, if a bidder has a negative score/rating on other sites those bidders' bids may not be accepted. 8. Buyer's Premium: 15% buyer's fee (buyer's premium) will be added to all invoices. 9. Shipping: At present, SGS is limiting shipping to the continental US & Canada. If you are outside of this territory expect additional shipping costs and a longer delivery timeframe. All packages must be sent to the billing address associated with the credit card used to place the bid or the method by which the bidder pays. If you would like your item shipped to an address other than your billing address you will be required to overnight a Cashier's Check or pay by ACH or Wire Transfer for the full invoice amount. IT IS THE RESPONSIBILITY OF THE BIDDER TO VERIFY AND CONFIRM THE SHIPPING ADDRESS AS IT APPEARS ON EACH INVOICE (Found in the Sold-To section of each invoice). 10. ON-LINE ABSENTEE BIDS ARE ACCEPTED UP TO THE CLOSE OF EACH ITEM. 11. Invoice totals for Out-of-state Bidders and Non-Local Bidders will be charged to the credit card on file on the night of the auction, and at a rate of 15% Buyer's Premium. 12. Some of our auction items are offered without reserves. In the case that an item has a reserve, whether it be a private or stated reserve, SGS may implement such reserve by bidding on those specific items on behalf of the bidder.
