If you cannot follow these terms 100%, you are welcome to stay as a spectator, but do not bid. BUYERS PREMIUM: A 15% buyers' premium is added to the high bid to establish the final invoice price. If your winning bid is $100, you will be charged $115 plus any applicable tax. REGISTRATION: You must be at least 18 years old to register and participate in this sale. In order to bid, you must create a username and password. You agree that all information provided during registration is true, accurate and up to date. AUCTION FORMAT: This is an online only auction. Bids will be accepted online for a period of days indicated, after which the high bidder becomes the winner of each lot they successfully bid on. Lots will close at staggered times, 30 seconds apart. If a bid is placed within 1 minute of the scheduled auction close, an addition 1 minute will be added to the bidding for a soft close on that item. ALL SALES ARE FINAL: No returns or exchanges are accepted. Once the item is sold, the winning bidder becomes the new owner of the item and has effected a legally binding contract which cannot be altered or voided. Additionally, bids cannot be changed or cancelled once submitted. NO WARRANTIES: All items are sold as is, where is without warranties or guarantees, expressed or implied as to the quality, character or condition. No refunds will be given for partial, missing or broken items. We do our best to provide detailed titles, descriptions and photos, however, ***WE CANNOT GUARANTEE IF PACKAGED AND/OR UNASSEMBLED ITEMS ARE COMPLETE OR WITHOUT DAMAGE***. In many cases, stock photos have been provided which may not accurately display/reflect condition INSPECTION: The buyer agrees to rely exclusively on his/her personal inspection of the property through photos provided. Photographs are an important part of the item description. SETTLEMENT: High bidders' will be invoiced in U.S. dollars and credit cards provided at registration will charged within 24 hours of the close of the sale. Buyer agrees that valid credit card information has been provided, you will accept all charges and that you will not charge back any charges placed by the auction company in accordance with fees discussed throughout the terms and conditions (ie high bid, buyer's premium, shipping/handling/insurance, no-show and late show fees). All purchases are subject to a 7.75% Lucas County Ohio sales tax unless you have submitted a valid tax exemption certificate prior to the auction's end. DELIVERY/PICKUP: NO SHIPPING. All items are local pickup at 5775 Telegraph Rd. Toledo, OH. Follow the Montrie Auction signs to around the back of the building to reach the loading dock. *NO SHIPPING IS OFFERED. Buyer understands and agrees that auction company will release your items only after you or your agent presents a paid invoice receipt that has been generated by the auction company and emailed to you. Bidders are responsible for providing their own labor, tools and packaging materials if needed for removal. Many items are very heavy, so please come prepared; the auction staff will not remove or load your items for you. Pickup times will be on Tuesday, November 1st from from 10am-2pm and Wednesday, November 2nd, 2022 from 10am-1pm by appointment (appointment link will be provided to high bidders). Buyer understands that Items not picked up during scheduled pickup time are considered abandoned and becomes the property of Montrie Auction & Estate Service L.L.C. Any such items will be resold or disposed of without any reimbursement or refund to the buyer. INJURY & DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by bidder and/or his agent, and further agrees to hold auctioneers and sellers harmless from any personal injury to himself or his agents and any property damage incurred on auction premises. All bidders and their agents enter the site, participate with the auction and remove items at their own risk. Additionally, buyers are responbile for any damage caused by themselves or their agents to the property during removal and also agree that the credit card provided will be charged for any expenses incurred and/or repairs necessary as a result of any damage you cause. Professional removal is recommended. CONSENT TO CONTACT: By registering for this auction, you authorize Montrie Auction & Estate service, it's staff, agents and shipping partners to contact you regarding this auction including, but not limited to, payment, shipping, etc. through all contact information provided during registration including phone calls, text messages and emails. CHANGE WITHOUT NOTICE: Auctioneer reserves the right to modify or cancel lots and extend or change close dates. Additionally, Montrie Auction reserves the right to extend an auction that may have already closed but was not online at the time of closing due to technical problems, system outages, etc. CLAIMS: Any claims or disputes arising out of these terms and conditions or this auction will be settled in Lucas County, Ohio.

Large online only auction of new furniture and home furnishings from a major online retailer. Items may be cancelled orders, open box, returns, overstock, etc. Local pickup only in Toledo, OH. While we do our best to point out any damage that is noticed, items may exhibit damage inside the box/packaging that we are unaware of. Bidders bid and buy solely at their own risk and discretion understanding all sales are final. Please note, the warehouse has asked us to sell a few items that they have used in their office as well. Those items will be described as USED.
