This means after the auction has ended you have 3 days to entirely remove the contents of the unit. The Auctioneer will meet you on site to open the storage unit and close it once all items are removed. This unit has a $200 cleaning deposit. You MUST pay this deposit with: Cash, and show photo ID and your invoice number to the auctioneer at your appointment or you will not be given access to the unit. Auction house will run your credit card on file with hibid unless you call to arrange a cash payment. This auction house accepts the following types of payment for the final bid amount: Cash, Debit, Visa, Mastercard and Venmo. BIDDER/BUYER The Buyer/ Bidder (hereinafter referred to as the "Buyer") is responsible for understanding the following terms. The Buyer hereby agrees to the following terms of this Agreement and accepts the fact that he/she is agreeing to a legally binding contract by placing a bid. Upon winning an auction, the Buyer will be charged a 15% NON-REFUNDABLE BUYERS PREMIUM based on the final winning bid amount immediately after the auction closes. This is an additional fee that a winning Buyer is obligated to pay above the winning bid amount. Unless stated otherwise in the description of the auction, there is a $200.00 refundable cash deposit. The deposits are not included in auction prices. The deposit will be fully refunded upon the unit being cleared of all items and cleaned appropriately. The auctioneer shall not be liable by reason of any defect in or condition of the premises on which the sale is held including but not limited to personal injury, fire or theft. If foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Auctioneer and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, auctioneer at his option may 1) resell the property publicly or privately, with the purchaser being liable for the payment of any deficiency plus all costs incurred or 2) cancel the sale, retaining all liquidated damages on all payment made by purchaser. Auctioneer commission and all other incidental damages will be charged. Auctioneer is acting as an agent and agent only and is not responsible for the acts of his or her principals. Shipping No Shipping Offered Governing Law The laws of the state of Texas govern this agreement. Any and all lawsuits must be filed in Dallas County courts and the Northern District of Texas. Indemnification Buyer shall indemnify Thomas Online Auctions and it's affiliates against any claims, damages, or liability (including reasonable attorney's fees) as a result of an injury or other harm suffered by any person and stemming from the sale, whether arising before, during, or after the sale. Buyer agrees to indemnify TOA for any damages or losses. Buyer will not hold Thomas Online Auctions, its owners or its employees, liable for accidents, injury, theft, or incidents related to this purchase.
