Listing Terms and Conditions
All items sold as is where is with all faults and with no warranties express or implied. Buyer is responsible for inspection of items prior to bidding. We may or may not inspect or call damage or condition of items. Please call us or text us at Silver Lake 903-875-9458 prior to auction day if you are entering an absentee / online bid and have a question about an item. We usually have decent photos of items, but buyers are encouraged to closely physically inspect items prior to the auction during the PREVIEW time. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. A bid is a binding contract. Non paying bidders will be reported to Hibid. There will be a 13 per cent buyers premium added to the total of items purchased for this auction with a 3 per cent discount for cash payment. This is to help cover the cost of auction workers and incidental expenses. There will be Texas Sales Tax of 7.75% unless the buyer has a valid resale tax certificate on file with us or the item being sold is not subject to sales tax, such as U.S. coins and currency. Methods of payment include cash, check, or credit card with valid ID. There is a $35 charge for returned checks. We do not used Hibid's checkout system therefore once you receive your invoice you will need to call us with your card info or come by the auction house to pay. Winning bidders will be sent an email the night of or day following the auction if they win items. All items won must be paid for and picked up by noon on the Saturday following the auction close. Bidders who do not follow through with payment by noon on the following Saturday will have their bids cancelled and the items may be sold to the backup bidder or returned to consignors or storage, or reauctioned. Unless prior storage arrangements have been made, any items left at the auction by buyers past noon on the Saturday following auction close are thereby abandoned and revert to ownership of Silver Lake Auction LLC with no refund given. Storage units may be rented near the auction site if needed, subject to availability. Buyers are responsible for packing and loading items and encouraged to bring their own packing materials and loading help as we have limited personnel available. Once you are declared the winner of an item you are responsible for loss or damage, therefore it is advised that you pick up your items as soon as possible after the auction close. By placing a bid through this website or at the live auction, you are entering into a legally binding contract and agree to follow through with the payment for and pickup of the item as specified above. Bidder expressly agrees not to stop payment, dispute or contest auction transactions and agrees to payment rules and item abandonment rules above stated. Silver Lake Auction LLC and its consignors reserve the right to remove any and all items from a sale at any time, up until the time the item is sold. If the auction is being done as a live auction, all announcements made at the live auction supercede all previous announcements online or offline. Live floor bids have priority over absentee bidders in the case of a TIE BID. For example if an item starts at $5.00, you bid $7.50 absentee, and no other absentee bids are left. The auctioneer will ask for $7.50 to open. If there is a floor bid for $7.50, the absentee bidder (you) will not win the item. If no one at the live auction enters a bid, you will win the item for $5.00. All sales are final with no returns. Anyone who is age 18 or over may bid, however Silver Lake Auction LLC reserves the right to reject a bid from any bidder. Bidders who have negative hibid ratings or who have failed to pay or pickup items previously may have their bids cancelled or denied. Workers at the auction as well as the auctioneer himself may bid. The highest bidder acknowledged by the auctioneer shall be the purchaser. For live auctions, in the event of a dispute between bidders, or if the auctioneer doubts the validity of a bid, the auctioneer shall have sole discretion to name the successful bidder, reopen the bidding between two tie bidders, or resell the item. Bidders are responsible for their own merchandise once they are recognized as the purchaser. The auctioneer may at his discretion combine or divide lots during the auction. Anyone entering the auction premises for any reason does so at their own risk. Neither Silver Lake Auction LLC nor Garitty Pace LLC (owner of the premises) are responsible for accidents, nor is the auctioneer. If you are unable to attend a live auction or are not comfortable using a computer or phone to bid, you may leave an absentee bid by calling the auctioneer at 903-875-9458 by the day preceding the auction close. Shipping may typically be arranged on smaller items by Silver Lake Auction LLC at actual postage rates. For breakable items a charge may be added for bubble wrap at 50 cents per square foot. If you are having ammo shipped, a $10 per lot delivery charge will apply due to the nearest UPS hub which accepts ammo being an hour's drive away. No fees or other charges will occur except in the rare occurrence that shipping the item requires more than 30 minutes to pack and ship, after which the hourly rate will be $30 per hour. Silver Lake Auction LLC makes no warranty with respect to shipping items. If buyer wishes the item to be insured they must notify Silver Lake Auction LLC when arranging shipping. It is recommended that shipping for larger items be arranged with third party shipping companies by the buyer.
