BIDDER’S AGREEMENT This auction is subject to the following terms and conditions. By signing this document, you are agreeing to each and every term and condition contained herein. 1. You must register and receive the Bidder’s card in order to be eligible to bid today. 2. In the event of a “Tie Bid”, the Auctioneer will reopen the bidding between those two people only. Auction personnel may bid for their own personal use, and/or may be transmitting book or telephone bids on behalf of clients throughout th e sale. 3. All Bidders agree to incorporate the terms and conditions contained in this document into the Memorandum of Sale. All Bidders appoint Oglesby and Company Auctioneers, and their employees as attorney - in - fact for the sole purpose of executing the Memorandum of Sale for items purchased. All Bidders agree to allow Oglesby and Company Auctioneers, to subscribe their Bidder’s number to said Memorandum of Sale to stand in place of their individual signature. Said Bidder’s number shall have the same effe ct as if the individual Bidder had previously subscribed his signature to the Memorandum of Sale. 4. Payment must be made in accordance with advertised terms. 5. All terms of sale posted on the auction premises, printed in sale brochures, forms, signs, pub licly announced, or otherwise published are incorporated herein by reference. 6. Bidder agrees to pay any and all charges and expenses resulting from their breach of these terms and conditions, including reasonable attorney’s fees and court costs. 7. Aucti oneer hereby reserves the right to change the foregoing terms of conduct and enforcement of sale by announcement, written or oral, and such change or changes binding on any Buyer by constructive notice, by virtue of this clause. This shall include cancella tion, postponement, or change of property configuration, etc. 8. In the event of any dispute over any matter, the Auctioneer shall resolve it, and his decision will be final. 9. A 10% Buyers Premium will be charged on each item or parcel sold. PERSONAL PROPERTY 1. The Auctioneer reserves the right to group items, add items, or delete items in his sole discretion. 2. Unless the sale of an article is advertised or announced to be otherwise, each lot is offered subject to the reserve price of the Seller. W hen an article is sold with reserve, the Auctioneer may bid on the Seller’s behalf. 3. All small items must be removed today. Large items must be removed as announced from the auction block. Bidder must provide, at his own expense, all labor and cartage to remove the property. 4. Buyer shall pay all city and state sales, use and other taxes assessed, due to or resulting from buyer’s failure to qualify as exempt from such taxes. Buyer also agrees to pay the Buyer’s Premium and any other applicable fees. 5. T he Auctioneer and Seller make no warranties or guarantees, expressed or implied, as to the genuineness, authenticity, or quality of any item. Auctioneer and Seller are not responsible for advertised discrepancies or inaccuracies. Reference in advertising b y goods of letter, words, signs or figures or otherwise are for description only, and are not representations or warranties. Everything is sold “as is” and “where is”, except as expressly made in writing. No warranties, expressed or implied, are made as to the merchantability of any items or their fitness for any purpose, or otherwise. THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. 6. In the event that the Bidder fails to pay the purchase price within the time subscribed by the Auctioneer, or fails to otherwise comply with the terms of this agreement, the Auctioneer may retain any deposit made by the purchaser until the item is later sold by subsequent auction. The Bidder shall be liable to the Auctioneer and Seller for any d eficiency resulting from the subsequent auction, after applying the deposit to said deficiency. The deficiency shall be an amount equal to the original auction sale price plus all charges and expenses incurred as a result of resale, less the resale purchas e price. 7. Bidder agrees to indemnify and holds harmless Auctioneer and Seller of any and all damages resulting from the removal of the property from the auction. Upon acceptance of the bid by the Auctioneer, the risk of loss to the property shifts to the Bidder. 8. The Bidder acknowledges that he has had the opportunity to examine the goods purchased and has exercised this clause.
Listing Information

This sale consists of all the support equipment necessary to run a productive blueberry growing operation.  All tractors run and appear to be in good operating condition.  Equipment Auction to commence following conclusion of 10:00am Real Estate Auction.  Everything sells free & clear of all liens and encumbrances.
