Martin is the Trustee for the O. Francis Toller Living Trust. Per Ohio law, a Trustee Deed will be utilized to convey the property held in the O. Frances Toller Living Trust to the purchaser of the property. A Trustee Deed merely covenants that the Trustee Jessica P. Martin in this case, has the requisite authority to execute the Trustee Deed of transfer to the purchaser. A Trustee Deed does NOT convey good and marketable title to the property. Rather, it would be the responsibility of any prospective purchaser of the property to conduct his or her own title search with regard to the property. The property will be sold in its present “as is” condition. In other words, the seller does make any implied or express warranties with regard to the property or the condition thereof.
